A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING THE DONATION AND TITLE
TRANSFER OF CITY VEHICLES, EQUIPMENT, AND LIGHT
FIXTURES TO THE CITY OF PENJAMO, A MUNICIPALITY
IN GUANAJUATO, MEXICO.
WHEREAS, the City of Penjamo ("Penjamo"), a municipality located in
Guanajuato, Mexico, is in need of certain vehicles, equipment, and light fixtures; and
WHEREAS, the City of Anaheim ("Anaheim") Fire & Rescue, the Public Works
Department,and the Public Utilities Department("APU")identified vehicles and equipment which
have exceeded their useful life; and
WHEREAS, APU identified high pressure sodium ("HPS") street lights that are
being phased out and replaced with light emitting diode ("LED") street light fixtures as well as
older technology Dusk-to-Dawn outdoor light fixtures; and
WHEREAS,Anaheim has determined that such vehicles,equipment,and street and
outdoor light fixtures("Assets") are available for donation Penjamo; and
WHEREAS, Penjamo, at Penjamo's sole cost and expense and without further
contribution by Anaheim beyond donating the Assets, shall pay for all equipment, material, labor
and supervision necessary to relocate the Assets including but not limited to,all necessary loading,
transport and storage of the Assets; and
WHEREAS, the Donation Waiver and Release Agreement, the proposed form of
which has been presented to the City Council; and
WHEREAS, Anaheim Charter Section 1222 empowers the City Council, by
resolution, to transfer and/or convey title to personal property owned by Anaheim on such terms
as are in the best interest of Anaheim; and
WHEREAS,the public interests are served by donating and transferring title of the
Assets to Penjamo.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The findings set forth herein are hereby adopted by the City Council of the
City of Anaheim.
2. The City Council hereby approves the Donation Waiver and Release
Agreement as presented to City Council, together with such additions, deletions, and changes
thereto as are approved by the Public Works Director and the City Attorney, or their respective
designees, such approvals to be conclusively evidenced by the execution and delivery thereof.
3. Upon receipt of the executed Donation Wavier and Release Agreement from the
City of Penjamo and the City of Anaheim's filing of the Department of Motor Vehicle Notice of
Transfer and Release of Liability, the Public Works Director or designee is authorized to release
and transfer such Assets to the City of Penjamo or designee.
4. The Public Works Director or designee is further authorized and directed to take
any and all actions necessary or advisable to implement the aforesaid Assets donation to the City
of Penjamo.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 17 day of December 2019, by the following roll call vote:
AYES: Mayor Sidhu and Council Members Kring, Barnes, Brandman,
Moreno, Faessel, and O'Neil
