12-20-19_special_ActionANAHEIM CITY COUNCIL ACTION AGENDA DECEMBER 20, 2019 SPECIAL MEETING  ORDER OF BUSINESS: A special meeting of the City Council scheduled for December 20, 2019 at 2:00 P.M. to be held in the Anaheim City Hall, Council Chambers, 200 S. Anaheim Blvd., Anaheim, CA 92805.  REPORTS: All agenda items and reports are available for review in the City Clerk’s Office, the Central Library, and www.anaheim.net. Any writings or documents provided to a majority of the City Council regarding any item on this agenda (other than writings legally exempt from public disclosure) will be made available for public inspection in the Office of the City Clerk, located at 200 S. Anaheim Blvd., 2nd Floor, Anaheim, CA 92805, during regular business hours.  PUBLIC COMMENTS: There is a Public Comment period with speakers having one opportunity to address the City Council, except for the scheduled public hearing items. The time limit established for public comments is three minutes per speaker unless a different time limit is announced. The City uses speaker cards that must be submitted to the City Clerk in order to address the City Council. For public hearings, the Mayor or Chairperson will separately call for testimony at the time of each public hearing. Testimony during public hearings is subject to the following time limits: Project applicant or issue initiator: twenty minutes for initial presentation and ten minutes for rebuttal; Residents within the noticed area of the subject property: ten minutes; All other members of the public: three minutes. Public hearings regarding legislative matters: five minutes. The Mayor or Chairperson may limit the length of comments during public hearings due to the number of persons wishing to speak or if comments become repetitious or irrelevant. Pursuant to Government Code Section 54954.2(a)(2), no action or discussion by the City Council shall be undertaken on any item not appearing on the posted agenda, except to briefly provide information, ask for clarification, provide direction to staff, or schedule a matter for a future meeting.  ADDITIONS/DELETIONS: Items of business may be added to the agenda upon a motion adopted by a minimum 2/3 vote finding that there is a need to take immediate action and that the need for action came to the attention of the City or Agency subsequent to the agenda being posted. PUBLIC HEARING – SPECIAL MEETING 2:05 P.M. 1. This is a public hearing to take public testimony and consider the Summary Report prepared pursuant to California Government Code section 52201, and a resolution approving a Purchase and Sale Agreement with SRB Management Company, LLC, in the purchase price of $325,000,000, for real property generally located at 2000 E. Gene Autry Way and 2200 E. Katella Ave, upon which exists certain improvements, including Angel Stadium of Anaheim, City National Grove of Anaheim and their surrounding parking areas and environs (approximately 153 acres generally bounded by Orangewood Avenue, State Route 57, Katella Avenue, and State College Boulevard) that will assist in the creation of economic opportunity pursuant to California Government Code section 52201 (APNs 232-011-02, -06, -35, -36,-37, -38, -39, -40, -41, -42, - 43, -44, -47, -48, -49 -50). RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM approving the Purchase and Sale Agreement for the sale of approximately 153 acres of city-owned property generally located at 2000 E. Gene Autry Way and 2200 East Katella Ave. containing improvements including Angel Stadium of Anaheim and City National Grove of Anaheim and finding that the sale will assist in the creation of economic opportunity pursuant to California Government Code section 52201. Determine that per the California Environmental Quality Act (CEQA) and CEQA Guidelines Section 15168, these actions are within the scope of Final Subsequent Environmental Impact Report No. 339 for the Revised Platinum Triangle Expansion Project including Mitigation Monitoring Plan No. 106C, and associated Addenda. SUBSIDIARY MOTION: JM/DB to amend the original motion by removing the $325M price and insert that price to be determined/negotiated at the end of the inspection period. SUBSIDIARY MOTION: JM/DB to amend the original motion to amend the $325 price to $539,000,000 plus actual dollar value of “Anaheim” marketing value and for the entire purchase price to be deposited in an escrow account upon completion of the inspection period.
