A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING ACCESS TO STATE AND
LOCAL SUMMARY CRIMINAL HISTORY INFORMATION FOR
EMPLOYMENT, CERTIFICATION OR LICENSING PURPOSES
WHEREAS, Penal Code Sections ll105(b)(10) and
13300(b)(10) authorize the Attorney General and local agencies to
furnish state and local summary criminal history information to
cities in order to assist cities in fulfilling employment,
certification or licensing purposes; and
WHEREAS, Sections ll105(b)(10) and 13300(b)(10) allow
summary criminal history information to be furnished only when the
City Council of the city has specifically authorized access to
such information, and when there is a requirement or exclusion
from employment, certification or licensing relating to specified
criminal conduct.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that:
1. The City of Anaheim shall not consider a person to be
eligible for employment, certification or licensing, if such
person has been convicted of a felony or misdemeanor involving
moral turpitude; provided, however, that such conviction may be
disregarded by the City if it is determined that sufficient
mitigating circumstances exist, or that the conviction is not
related to the employment, certification or licensing in question.
2. The City of Anaheim is hereby authorized to access state
and local summary criminal history information in fulfilling
employment, certification or licensing duties.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this l4th day of February, 1989.
