RES-2020-020 RESOLUTION NO. 2020- 0 2 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM MODIFYING THE RATES, RULES AND REGULATIONS, WHICH DO NOT INCREASE RATE- RELATED REVENUES,FOR THE SALE AND DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION NO. 72R-600 AND MOST RECENTLY AMENDED BY RESOLUTION NO. 2019-037 AND DETERMINING THAT SAID ACTIONS ARE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT(CEQA)PURSUANT TO PUBLIC RESOURCES CODE SECTION 21080(B)(8) AND SECTIONS 15061(B)(3) AND 15273(A) OF TITLE 14 OF THE CALIFORNIA CODE OF REGULATIONS. WHEREAS, the City of Anaheim ("Anaheim") maintains a water production, transmission, and distribution system for the distribution of water to residents and businesses of Anaheim and has adopted Water Rates, Rules and Regulations for the sale and distribution of water; and WHEREAS,the Anaheim Municipal Code authorizes the Anaheim City Council to approve reasonable Water Rates, Rules and Regulations for water services,which are provided by the Anaheim Public Utilities Department("APU"); and WHEREAS,APU is a publicly owned utility,but nonetheless strives to operate like a business and continuously seeks opportunities to minimize administrative and fiscal burdens while remaining in a position to maintain service reliability and high industry standards; and WHEREAS, in support of the foregoing,APU staff reviewed and recommends the modification of Rule Nos. 1, 2, 9, 10, 11, 12, and 26 of, and addition of Rule No. 21 to,the Water Rates,Rules and Regulations, including the renumbering of the"Smart Meter Program Residential Customer Opt Out Option"rule from Rule No. 26 to Rule No. 21, and the adoption of a new Rule No. 26 entitled"Water Bill Assistance for Income-Qualified Customers"; and WHEREAS, it is reasonable and appropriate to modify the Water Rates, Rules and Regulations, as set forth in Attachment A, to provide water service customers more payment flexibility, payment options, and bill assistance; and to clarify terms related to recovery of costs for customer-specific water facilities; and WHEREAS, the Public Utilities Board considered the requirements of the California Environmental Quality Act (CEQA) and found that the proposed modifications to the Water Rates, Rules and Regulations, as set forth in Attachment A, come within Public Resources Code section 21080(b)(8)and Title 14 of the California Code of Regulations, sections 15061(b)(3) and 15273(a). Thus, these modifications are exempt from CEQA; and WHEREAS,based on the findings hereinabove made and the public hearing record, the Public Utilities Board recommended that the City Council determine that the modifications to the Water Rates, Rules and Regulations are exempt under CEQA, Public Resources Code section 21080(b)(8) and Title 14 of the California Code of Regulations, sections 15061(b)(3) and 15273(a); and WHEREAS, based on the findings hereinabove made, the Public Utilities Board recommended that the Anaheim City Council adopt the findings of the Public Utilities Board with respect to the matters contained herein and adopt the modifications to the Water Rates, Rules and Regulations, as reflected in Attachment A, which is on file with the Office of the City Clerk; and WHEREAS, the City Council has considered the evidence and concurs with the findings of the Public Utilities Board as set forth hereinabove. NOW,THEREFORE BE IT RESOLVED by the Anaheim City Council as follows: 1. The findings set forth herein are hereby adopted by the Anaheim City Council. 2. The Anaheim City Council hereby determines that, in accordance with CEQA and the State CEQA Guidelines, the modifications to the Water Rates, Rules and Regulations, as reflected in Attachment A, are exempt from CEQA pursuant to Public Resources Code section 21080(b)(8)and sections 15061(b)(3)and 15273(a)of Title 14 of the California Code of Regulations,because it can be seen with certainty that there is no possibility that the proposed modifications will have a significant effect on the environment as the modifications primarily recover costs and are administrative in nature. 3. The Anaheim City Council hereby adopts the following modifications to the Water Rates, Rules and Regulations, as reflected in Attachment A, (a) modifications to Rule Nos. 1,2, 9, 10, 11, and 12, and 26 of the Water Rates, Rules and Regulations; (b)renumbering of Rule No. 26 of the Water Rates, Rules and Regulations as Rule No. 21 of the Water Rates, Rules and Regulations; and (c) the adoption of a new Rule No. 26 of the Water Rates, Rules and Regulations. Rule No. 12 is hereby deleted.These modifications shall be effective March 1,2020. 4. The Anaheim Public Utilities General Manager is hereby authorized and directed to prepare, promulgate, publish, and implement changes to the Water Rates, Rules and Regulations as set forth herein. Added Facilities: The facilities provided by the Utility at the request of an Applicant, which are over and above the Utility's standard facilities as further set forth in Rule No.2 of these Rates,Rules and Regulations. Advanced Water Meter: A Meter that wirelessly transmits Customer water consumption data for operation and billing purposes to the Utility on a periodic or event-driven basis. APU: Anaheim Public Utilities. Applicant: The Person,association,corporation or governmental agency applying for Service. Application: A request to the Utility for Service as distinguished from an inquiry as to the availability of or charges for such Service. Balancing Account: An account designated to account for the Water System Reliability Adjustment rate collections and payment of Water System Capital Expenditures and capital-related Debt Service. Billing Period: The time interval between gathering the data used for billing purposes. Capital Expenditures: Funds used to acquire or upgrade physical assets such as Water System property or equipment. This type of outlay is made to maintain or increase the scope of Water System operations. CDPH: California Department of Public Health. City: The City of Anaheim,a municipal corporation. City Clerk: The City Clerk of the City of Anaheim,California City Council: The City Council of the City of Anaheim,California Class of Service: The categories of Service established by the various water Rate Schedules. County: The County of Orange,California. Customer: The Person in whose name Service is rendered as evidenced by the signature on the Application,contract or agreement for that Service or,in the absence of a signed instrument,by the receipt of bills or Summary Bills regularly issued in his name regardless of the identity of the actual Person using the Service.A Customer may also be a party with whom the City of Anaheim is doing business, with or without a billing relationship, or who is receiving benefit of Service under another party's name. Date of Presentation: The date upon which a bill or notice is Mailed or delivered by the Utility to the Customer. Debt Service: Cash required over a given period of time for the repayment of interest and principal on borrowed funds. Distribution Mains: Pipelines located in streets, highways,public rights-of-way, easements or private rights-of-way, exclusive of Service Connections,which are owned and operated by the Utility and are used to serve the general public. Diversion: Any activity described in California Penal Code section 498(b),as may be amended from time to time. General Manager General Manager of the City of Anaheim,Public Utilities Department or a designee. General Water Service: The Class of Service of all Customers, with the exception of Private Fireline Service Customers. Gross Area of Applicant's Property: The contiguous land area owned or controlled by an Applicant,including streets, but excluding open areas for which Service will not be required within a Special Facilities District,plus one-half of the land area of the abutting streets to which legal,recorded access exists at the time of application for Service. HCF: The unit of quantity measurement, which the Department uses to measure the amount of Potable Water or Recycled Water delivered to a Customer in hundreds of cubic feet.One HCF is 748 gallons. Jurisdiction: A specified area within which a Rate Schedule or schedules apply. Mailed: Any notice or other communication will be considered "mailed" when it is enclosed in a sealed envelope, properly addressed,and deposited in any United States Post Office Box,postage prepaid. Main Enlargement: The enlargement of Distribution Mains beyond existing facilities in accordance with the applicable provisions of the Rates,Rules and Regulations. Main Extension: The extension of Distribution Mains beyond existing facilities in accordance with the applicable provisions of the Rates,Rules and Regulations. Meter: The instrument used for measuring the amount of Potable Water or Recycled Water delivered to a Customer. Month:A thirty-day period. Hotels, guest or resort ranches, tourist camps, motels, auto courts, and trailer courts, consisting primarily of guest rooms and/or transient accommodations,are not classed as Multi-family Accommodations. Municipal Code:The Municipal Code of the City of Anaheim. Municipal Service: Utility Services supplied to City of Anaheim departments. On-Site Recycled Water System:That portion of the On-Site System composed of Recycled Water facilities. On-Site System: The Potable and/or Recycled Water facilities under the control of the Applicant,owner or Customer. The On-Site System is located downstream of the POD,which is normally downstream of the Utility's Meter tailpiece. Permanent Service: Service which, in the opinion of the Utility, is of a permanent and established character. This Service may be continuous,intermittent,or seasonal in nature. Person: Any individual,partnership,corporation,public agency,or other organization operating as a single entity. Planning Department: The Planning Department,and/or its Building Division,of the City of Anaheim,California. Point of Delivery(POD): The point where the piping of the Utility is connected to the piping of the Customer,which is normally downstream of the Utility's Meter tailpiece,regardless of the location of the Meter. Potable Water: Water that meets the standards for human consumption set by the applicable federal, state and local authorities. Premises: All of the real property and apparatus employed in a single enterprise on an integral parcel of land undivided, excepting in the case of industrial, agricultural, oil field, resort enterprises, and public or quasi-public institutions, by a dedicated street, highway, or other public thoroughfare, or a railway. Automobile parking lots constituting a part of and adjacent to a single enterprise may be separated by an alley from the remainder of the Premises served. Private Fireline Service: The piping, fittings, and valving necessary to conduct Potable Water for fire protection purposes from the Distribution Main to the Private Fireline Service assembly backflow prevention device. Public Utilities Board: The Public Utilities Board as appointed by the City Council. Public System: The system of facilities under the control of the Utility. The Public System facilities shall be those upstream of the POD to the Customer. Rate Charges: Charges in the Rates,Rules and Regulations may include the following: Commodity Charge: That portion of the charge for Service which varies with the amount of Potable Water or Recycled Water consumed in accordance with the Rate Schedule. Customer Charge: That portion of the charge for Service which is a fixed amount without regard to Potable Water or Recycled Water consumption in accordance with the Rate Schedule. Minimum Charge: The least amount for which Service will be rendered in accordance with the Rate Schedule. WATER RATES,RULES Utilities Financial Services AND REGULATIONS 201 S.Anaheim Blvd. Page No.3.1.4 Anaheim,CA 92805 RULE NO. 1 DEFINITIONS Rates, Rules and Regulations: The rate structure, the Rules, and any regulations as approved by the City Council, governing the use and delivery of Potable and Recycled Water. Rate Schedule:Maybe one or more Tariff Pages setting forth the charges and conditions for a particular class or type of Service at a given location. A Rate Schedule,as referred to herein,shall include all the wording on the applicable Tariff Page or pages,including but not limited to,the following:Class of Service,Applicability,Rates,Special Conditions,and reference to a Rule or Rules. Recycled Water:Water that is approved for purposes other than human consumption and meets the criteria set forth in Division 4 of Title 22 of the California Code of Regulations,as may be amended from time to time. Recycled Water does not include gray water. Recycled Water Service: The Class of Service supplying Recycled Water to Customers for landscape irrigation; agricultural irrigation; toilet and urinal flushing; cooling towers; construction water; industrial process water, commercial use;groundwater recharge;and enhancement of wildlife habitats. Recycled Water Site Supervisor: The individual designated by the User and approved by the Utility who provides a liaison to the City; oversees the use of Recycled Water on the User's Premises; has the authority to carry out any requirements of the City,is responsible for the operation and maintenance of an On-site Recycled Water System;and prevents potential violations. The individual must have completed a Utility-approved Recycled Water Site Supervisor training program. Recycled Water System: The infrastructure needed to provide and deliver Recycled Water to Customers within the Utility's Service Area, including, but not limited to, all pipelines, Service Connections, Meters, pumping stations, reservoirs,and other related facilities. Recycled Water Users'Guide:The Utility's guidelines to be used by an Applicant,Customer,Person,Recycled Water Site Supervisor,User,owner,tenant,property manager,engineer,or contractor in the design,installation,operation and maintenance of On-Site Recycled Water Systems within the Service Area. Regulatory Agency:A public entity legally constituted by federal,state,and local statutes that is authorized to protect public health and water quality within the Service Area. Revenue: Amount realized from the selling of goods or services before customer discounts or uncollectible write-offs are applied. This does not include amounts collected from sources that are to be deferred in accordance with Governmental Accounting Standards Board(GASB)Statement No.62. RWQCB:The Regional Water Quality Control Board of the State of California,Santa Ana Region. Service: The furnishing of Potable or Recycled Water to a Customer from and out of the Water System or Recycled Water System owned and operated by the Utility through a Meter to the Customer's piping. Service shall only refer to the furnishing of Potable Water where used in Rule No. 15. Service Area: The geographic area wherein the City of Anaheim is the designated public Potable Water or Recycled Water Service provider. Service Connection:The pipe or tubing,fittings,and valves necessary to conduct Potable Water or Recycled Water from the Distribution Main to and through the Meter. Single-Family Dwelling or Accommodation: A house,apartment,or other dwelling unit which is used as a residence by a single family. School: A public or private K-12 school recognized by the Orange County Department of Education or the Western Association of Schools and Colleges. Special Facilities Charge: The charge made to cover the cost of the special facilities in the high elevation system. This charge shall be computed by multiplying the Gross Area of Applicant's Property times the special facilities charge rate. Special Facilities District: An area within the high elevation system where a Special Facilities Charge is calculated by the Utility to pay for the special facilities within that area. Summary Bill: A Customer account billing statement that includes charges for multiple Service locations. Tariff Page: An individual page of the Tariff Schedules. Tariff Schedules: The entire body of effective rates,rentals,charges,and Rules collectively of the Utility,as set forth herein,and including title page,preliminary statement,Rate Schedules,and Rules. Temporary Service: Service for enterprises or activities which are temporary in character or where it is known in advance that Service will be of limited duration. Service, which in the opinion of the Utility, is for operations of a speculative character or the permanency of which has not been established,also is considered Temporary Service. Tract or Subdivision: An area which may be identified by filed subdivision plans or an area in which a group of dwellings may be constructed about the same time,either by a large scale builder or by several builders working on a coordinated basis. User: Any Person,Persons or firm issued an approved User Permit by the Utility.They may be the owner,Customer, tenant or property manager,as appropriate. User Permit: A permit issued by the Utility to a Recycled Water Service Applicant after the satisfactory completion of the Service application procedures set forth in the Rates,Rules and Regulations and the Recycled Water Users'Guide. This permit constitutes a contract that legally binds the User to all conditions in the Rates,Rules and Regulations,the Recycled Water Users'Guide,and any and all applicable Regulatory Agency requirements. Utility: The City of Anaheim-Public Utilities Department. Water Utility: The water division of the Utility. Water System: The infrastructure needed to provide and deliver Potable Water to Customers within the Utility's Service Area including,but not limited to,all Distribution Mains, Service Connections,Meters,fire hydrants,pressure reducing stations,groundwater wells,pumping stations,reservoirs,and other related facilities. The Utility will endeavor to supply Potable Water dependably and safely in adequate quantities to meet the reasonable needs and requirements of Customers. 2. The Utility will endeavor to supply Recycled Water when such Recycled Water becomes available and is feasible at the Utility's determination. B. PRESSURES 1. The Utility will generally maintain minimum operating pressures at the Service Connection of not less than twenty-five pounds per square inch (25 psi). Pressures may be lower at times of maximum demands,or because of unusual topography or other special conditions. 2. The Utility will generally maintain maximum operating pressures at the Service Connection of not more than one hundred seventy-five pounds per square inch (175 psi). Pressures may be higher at times of minimum demands,or because of unusual topography or other special conditions. 3. If it is deemed appropriate to either increase or decrease a Customer's on-site pressure,it shall be the responsibility of the developer or Customer to install and maintain any booster pumps, pressure regulators,relief valves,and such other equipment or facilities required by the Utility.The Utility will provide a recommendation as to such requirements to the Planning Department who has full authority to require such installations. C. METHOD OF MEASURING SERVICE All Customer water use will be based on metered volume usage except as provided in these Rates,Rules and Regulations. D. ADDED FACILITIES Added Facilities are considered to be existing,upgraded, or new services or facilities installed and/or used by the Utility at an Applicant's request, except in the instance of a School Applicant who shall install, own, maintain, and/or use the Added Facilities, in addition to the standard facilities, which the Utility would normally install or use, and which represent additional costs to the Utility over normally installed facilities. Added Facilities may include,but are not Iimited to,those facilities necessary to supply quality,pressure,data monitoring services, or other non-standard services or facilities. Except where provided by Rate Schedule, authorization for or installation of Added Facilities will be made, provided the type of Added Facilities requested is acceptable to the Utility and the Utility agrees to the installation of the Added Facilities,under the following conditions: 1. The Applicant for Added Facilities is also an Applicant for Permanent Service or is a Customer for Permanent Service at the same location. 2. Prior to the Utility authorizing, in the instance of a School Applicant,or installing Added Facilities, the Applicant shall agree to pay for the Added Facilities in the amount determined by the Utility based upon the applicable costs of the services or facilities and,where applicable,ongoing maintenance.At its option,the Utility may finance the Added Facilities when these facilities require capital outlay for water utility equipment or, in the instances of a School Applicant, when D.4 applies, subject to a creditworthiness evaluation. The amount financed by the Utility shall not exceed, on a per project basis,the Applicant's cumulative annual water bill for all accounts over the duration of the repayment schedule for the capital outlay for water utility equipment,and the Applicant shall be responsible for the associated financing costs as set forth in an Added Facilities worksheet mutually agreed to by the Applicant and the General Manager. The Utility may include the Added Facilities charges on the Applicant's Customer bill. ADDED FACILITIES(Continued) 3. In the event that the Added Facilities are no longer requested by the Applicant,the Utility may charge the Applicant the balance owed on the cost of installed Added Facilities, less the estimated salvage value of equipment removed,if any. 4. The Utility may provide upfront capital funding assistance to a School Customer, as set forth in an Added Facilities worksheet mutually agreed to by the Applicant and the General Manager,to be used to pay for water facility upgrades under the following conditions:(1)the upgrades are determined by the Utility to meet reliability,sustainability, or efficiency program parameters and are-within budget allocations;(2)the repayment duration shall not exceed the estimated useful life of the upgrades;(3) the Applicant shall have documented site control of the facility where the upgrade is to be made;and (4)that facility shall be within the Utility's service territory. • ISSUED BY: Effective: by Resolution No.: Dated: Dukku Lee Superseding Resolution No.: 2019-037 Dated: 04-16-19 General Manager CITY OF ANAHEIM WATER RATES,RULES Utilities Financial Services AND REGULATIONS 201 S.Anaheim Blvd. Page No.3.9.1 Anaheim,CA 92805 RULE NO. 9 RENDERING AND PAYMENT OF BILLS A. RENDERING OF.BILLS OR SUMMARY BILLS 1. Billing Period. Bills or Summary Bills for Service will be rendered bimonthly,monthly,or as otherwise provided in the Tariff Schedules. 2. Metered Service. a. Bills or Summary Bills for metered Service will be based on Meter registrations. Meters will be read as required for the preparation of regular bills,Summary Bills, opening bills and closing bills. b. If,because of unusual conditions or for reasons beyond its control,the Utility is unable to read the Customer's Meter on the scheduled reading date, the Utility may bill the Customer for estimated consumption during the Billing Period and make any necessary corrections when a reading is obtained. Estimated consumption for this purpose will be calculated considering the Customer's prior usage, the Utility's experience with other Customers of the same class in that area, and the general characteristics of the Customer's operations. Adjustments for any underestimation or overestimation of a Customer's consumption will be reflected on the first regularly scheduled bill or Summary Bill rendered and based on an actual reading following any periods when estimation is required. When a Service start date can be reliably estimated, the undercharge can be computed back to that date,exclusive of Rule No. 17. Physical access to the Meter,sufficient to permit its being read by the Utility, shall be provided by the Customer as a prerequisite to the Utility making any adjustment for consumption billed on an estimated basis. 3. Level Pay. a. The Utility offers certain eligible Customers participation in a level pay program,which allows an eligible Customerto have level payments over a twelve-month period ("Level Pay"). A Customer shall be eligible for Level Pay when(1)there is an Advanced Water Meter available; (2) Customer agrees to the installation of an Advanced Water Meter; and (3)Customer is not delinquent on any of their Utility accounts prior to their enrollment in Level Pay. b. Under Level Pay,the Utility will calculate a Customer's bill for a Billing Period based on their average bill over the previous twelve-month period at the time of initiation. At the end of every Level Pay twelve-month period ("Level Pay Period"), the Utility will determine whether the Customer overpaid or underpaid based on their applicable Rate Schedule and actual water consumption.If the Customer overpaid or underpaid during the Level Pay Period,the Utility will either(1)refund or credit the overpayment,as requested by the Customer,or(2)issue a bill to be due in accordance with Rule No. 11.At the end of each Level Pay Period or soon thereafter,the Utility will adjust the Customer's payment for the next Level Pay Period based on the Customer's applicable Rate Schedule and actual water consumption over the prior twelve-month period. Thereafter,Customer will pay the adjusted Level Pay amount. c. If a Customer fails to make their Level Pay payment within fifteen (15) business days of bill issuance,the Utility will remove the Customer from the Level Pay program,and that Customer will not be eligible for reinstatement into the program for the next twelve (12) months. The Utility will issue a final bill or credit based on the Customer's Rate Schedule and actual water consumption during the applicable portion of the Level Pay Period and, if the Customer underpaid for this period,the Customer shall pay that final bill in accordance with Rule No.11. Customer shall make payment to the Utility at the City of Anaheim,Division of Collections,by mail to City of Anaheim,201 South Anaheim Boulevard, P.O. Box 3069, Anaheim, CA 92803, by telephone at 714-765-3300, online at www.anaheim.net,or as determined by the General Manager. 2. Customer shall pay the Utility bills for connection or reconnection of Service and deposit payments as required under the Rules before Service will be connected or reconnected,or as determined by the General Manager. The Utility shall not provide a Service Connection for a Premises where past due charges,fees and/or penalties exist and the Service Connection requested is from an adult who lived at the Premises when those charges, fees, and/or penalties accrued. That adult person shall pay the Utility all past due charges before a Service Connection will be provided. D. RETURNED CHECK CHARGE The Utility may require payment of a returned check charge(item handling fee)equal to that permitted under the City of Anaheim Municipal.Code for any check or other negotiable instrument returned from the bank unpaid. In the event that the Utility determines that the returned check or other negotiable returned instrument did not occur as a result of any actions or omissions by the Customer, the Utility may waive the returned check charge (item handling fee). E. LATE PAYMENT CHARGE A late payment charge of 1.0%may be applied to the total unpaid balance of a Customer account if the Customer's payment is not received by the date indicated on the Customer account bill or Summary Bill. C. Failure of the Customer to file a written statement with the General Manager within ten(10)business days after receipt of the review explanation from the Customer Service Division will constitute acceptance by the Customer of the bill or Summary Bill as rendered,and authorize discontinuance of service in accordance with Rule No. 11. D. Upon timely receipt of the written statement,the General Manager or designee will review the basis of the billed amount,and communicate the results of the review and decision to the Customer. E. If,before completion of the General Manager's review,additional bills or Summary Bills become due which the Customer wishes to dispute, the Customer will not be required to file the dispute with the Customer Service Division,as stated in Section A above,but will be required to send his/her remittance(payable to the City of Anaheim) for the entire amount of the additional bills or Summary Bills disputed to the General Manager and file additional written statements within fifteen(15)business days of the bill or Summary Bill issuance date setting forth the reasons why the Customer believes the additional bills or Summary Bills are incorrect.Failure to do so will authorize discontinuance of service in accordance with Rule No. 11. F. If the bill or Summary Bill is not satisfactorily resolved with the General Manager or designee,the Customer may appeal to the Public Utilities Hearing Board who will then make the final determination on any unresolved bill or Summary Bill disputes. The appeal must be submitted in writing to the chairman of the Public Utilities Board,with the reasons for the dispute within fifteen(15)business days following receipt of the General Manager's review. In the absence of a timely filed appeal,the decision of the General Manager shall be final. Upon receipt of a timely appeal,a hearing will be held by the Public Utilities Hearing Board within sixty(60)calendar days of receipt of a request for appeal. A written decision of the Public Utilities Hearing Board shall be delivered to the Customer by personal delivery or certified mail within fifteen(15) business days following the appeal hearing. The decision of the Public Utilities Hearing Board shall be final. G. If, before the Public Utilities Hearing Board provides a written decision, additional bills or Summary Bills become due which the Customer wishes to dispute,the Customer will not be required to file the dispute with the Customer Service Division,as stated in Section A above,but will be required to send his/her remittance (payable to the City of Anaheim)for the entire amount of the additional bills or Summary Bills disputed to the General Manager and file additional written statements within fifteen (15)business days of the bill or Summary Bill issuance date setting forth the reasons why the Customer believes the additional bills or Summary Bills are incorrect. Failure to do so will authorize discontinuance of service in accordance with Rule No.11. H. STATE LAW Should there be a conflict between this Rule No. 10 and State law, as amended from time to time, State law shall govern,except to the extent that the provisions of this Rule are more favorable for the Customer or residential occupants of a detached Single-Family Dwelling or Multi-family Accommodation. If in a landlord/residential tenant relationship a landlord is responsible for payment of the water utility bill and the Service is through a master Meter, the Utility shall not terminate residential occupant(i.e., tenant) Service during the pendency of an investigation by the Utility of a Customer dispute or complaint,even if the Customer does not keep current the account for Services or if the Customer has been granted an extension of the period for payment of a bill. 2. Services to a residential Customer will not be discontinued for non-payment when the Customer has established to the satisfaction of the City that such termination would be especially dangerous to the health of the Customer or a full-time resident of the Customer's household. Certification from a licensed physician, public health nurse, or a social worker may be required by the City. The City shall make available to Customers, upon request, information regarding agencies and/or organizations that may provide financial assistance. If in a landlord/residential tenant relationship a landlord is responsible for payment of the water utility bill and the Service is through a master Meter,the Utility shall not terminate residential occupant(i.e., tenant) Service if a public health or building officer certifies that termination would result in a significant threat to the health or safety of the residential occupants or the public. Such ten-day period shall not commence until five(5)business days after the mailing of the notice.However,in no case shall residential Service be discontinued for nonpayment until payment has been delinquent for at least sixty (60) calendar days.No less than seven(7)business days before discontinuation of residential Service for nonpayment,the Utility shall contact the Customer named on the account by telephone or provide written notice.Notwithstanding the foregoing,residential Customers, who are delinquent under the terns of an amortization agreement,shall be subject to disconnection procedures required by State law. 4. If a Customer is receiving morethan one Service, any or all Services may be discontinued when any Service,regardless of location,is discontinued for nonpayment. However,residential Service will not be discontinued because of nonpayment of bills or Summary Bills for other Classes of Service. The Utility shall not terminate residential occupant(i.e.,tenant)Service if a delinquent account relates to another property owned,managed,or operated by the Customer. 5. Under no circumstances may Service be discontinued for nonpayment of a bill or Summary Bill to correct previously billed incorrect charges for a period in excess of the preceding three months, unless such incorrect charges have resulted from the Customer not abiding by the applicable Tariff Schedules. 6. On any Saturday, Sunday,legal holiday recognized by the City of Anaheim,or at any time during which the business office of the City is not open to the public,Service will not be discontinued on those days by reason of delinquency in payment for Services. 7. The Utility may offer an amortization agreement if a residential Customer meets certain State law requirements,and any such agreement shall contain terms consistent with that State law. C. UNSAFE EOUIPMENT AND SERVICE DETRIMENTAL TO OTHER CUSTOMERS The Utility may refuse or immediately discontinue Service to a Customer if the Utility determines(1)that any part of their plumbing or other equipment, or the use thereof, is unsafe or in violation of applicable laws,ordinances, rules or regulations of public authorities,or(2)that any condition or use existing upon the Customer's Premises is detrimental to the Utility's facilities or impairs the ability of the Utility to provide Service to its Customers. The Utility shall not provide Service or continue Service until the conditions described in(1)and(2) of the previous sentence no longer exist. The Utility may provide written or telephonic notice prior to discontinuation of Service when the Utility determines circumstances allow for such notice. The Utility.does not assume any responsibility for inspecting or repairing the Customer's plumbing or other equipment or any part thereof and assumes no liability therefor. The Utility will not provide Service to any equipment,the operation of which will be detrimental to the Service of the Utility or its other Customers, and will discontinue Service to any Customer who continues to operate such equipment after having been given written or telephonic notice by the Utility to cease doing so. A fee will be collected for the investigation of acts of fraud and/or Diversion as set forth in Rule No.23,provided,however,that said fee shall not limit Customer's liability for any fraud or other Diversion. The Utility may provide written notice prior to discontinuation of Service when the Utility determines circumstances allow for such notice. E. FAILURE TO ESTABLISH OR REESTABLISH CREDIT If, for an Applicant's convenience, the Utility provides Service before Applicant establishes creditworthiness or continues Service to a Customer when creditworthiness has not been reestablished and the Customer fails to establish or reestablish their creditworthiness in accordance with Rule No.6,the Utility may discontinue Service the following business day after this failure. F. NONCOMPLIANCE Except as otherwise specifically provided in this Rule No. 11,the Utility may discontinue Service to a Customer for noncompliance with the Rates,Rules and Regulations it after at least five(5)business days written notice to the Customer,the Customer has not complied with the notice. The Utility may dispense with the giving of such notice in the event the Utility determines the existence of dangerous conditions or other circumstances that require the immediate discontinuation of Service. CUSTOMER'S REQUEST FOR PERMANENT SERVICE DISCONTINUANCE When a Customer desires to terminate their responsibility for Service,the Customer shall give the Utility not less than two (2) business days notice of their intention and provide (1) the date on which the Customer wishes the termination to become effective,and(2)the address to which the closing bill or Summary Bill is to be mailed. A Customer may be held responsible for all Service furnished at the Customer's Premises until two(2)business days after receipt of such notice by the Utility or until the date of termination specified in the notice,whichever date is later. H. CUSTOMER'S REQUEST FOR TEMPORARY SERVICE DISCONTINUANCE Where the use of water is seasonal or intermittent,no adjustment will be made for a temporary reduction of usage. Any Customer who resumes Service within twelve(12)months must pay all charges that would have been billed had Service been continuous. I. RESTORATION-RECONNECTION CHARGE Prior to restoring Service that has been discontinued for nonpayment of bills or Summary Bills or for failure otherwise to comply with the Rates,Rules and Regulations,the Customer shall pay a reconnection charge for each incident in which the Service(s)was disconnected. In the event that the Utility determines that the Customer is not at fault,including situations such as a payment being lost in the mail or other such situations,the Utility may waive the reconnection charge. If Service(s)has been restored illegally or damaged due to tampering,the Customer must compensate the Utility for all damage incurred by the Utility prior to reconnection. The Customer is responsible for all damage incurred by the Utility whether or not Service is reconnected. If Customer requests to expedite the restoration/reconnection,the Utility may fulfill the request after the Utility's regular restoration/reconnection hours to the extent resources are available.In such cases,an additional charge will be assessed on the Customer in the amount set forth in Rule No.23. J. REQUEST FROM RESIDENTIAL OCCUPANT(TENANT).TO BECOME CUSTOMER If a landlord in a landlord/residential tenant relationship is responsible for the payment of the water utility bill and the account is in arrears, the residential occupant(i.e.,tenant) shall have the right to become the Customer without being required to pay the amount due on the landlord's delinquent account. In order for the Utility to make Service available,the residential occupant(i.e.,tenant)must agree to the terms and conditions of Service. K. STATE LAW Should there be a conflict between this Rule No. 11 and State law,as amended from time to time,State law shall govern, except to the extent that the provisions of this Rule are more favorable for the Customer or residential occupants of a detached Single-Family Dwelling or Multi-family Accommodation. B. TERMS OF ADVANCED METER OPT OUT OPTION In addition to this Rule No.21,Advanced Water Meters shall be governed by the Meter provisions within these Water Rates,Rules and Regulations,including,but not limited to,Rule Nos.2, 16,and 17.Customers are required to provide the necessary accessible location and Customer-owned equipment for the Utility to install an Advanced Water Meter.Notwithstanding the foregoing,a Customer may refuse the installation of an Advanced Water Meter if the Customer(i)is a residential Customer and(ii)has refused such installation in accordance with the procedures set forth in Section B.1 below. 1. Prior to the installation of an Advanced Water Meter for any account of a residential Customer,the Utility shall provide the residential Customer with written notice(Utility Notice)of(i)the Utility's intent to install an Advanced Water Meter; (ii) the approximate date of installation;and (iii)the residential Customer's option to refuse the installation of an Advanced Water Meter.If a residential Customer desires to exercise the option to refuse the installation of an Advanced Water Meter,the residential Customer shall notify the Utility and,upon receipt of that notification,the Utility will not install an Advanced Water Meter at the location described in the applicable Utility Notice. 2. A residential Customer who refuses the installation of an Advanced Water Meter in compliance with Section B.1 above, shall be referred to hereinafter as a Non-Participating Customer. Non- Participating Customers shall not be able to participate in programs and services that require Advanced Water Meter features and/or data until such time that they elect to authorize the installation of an Advanced Water Meter, and shall be required to provide full access to their _ property for Meter reading activities. 3. Notwithstanding anything to the contrary within this Rule No.21,the Utility reserves the right to install Advanced Water Meters when the Utility determines that(i)a Non-Participating Customer, after proper notifications,has not kept his/her account in good standing,requiring disconnection of Service;(ii)there is a history of tampering or manipulation of Meters at the Customer location;or (iii)it is difficult to access the Meter for any reason. WATER DISCOUNT FOR INCOME-QUALIFIED SENIOR, LONG-TERM DISABLED, OR • MILITARY VETERAN CUSTOMERS The Income-Qualified Senior/Long-Term Disabled/Military Veteran Water Discount Program provides a 10% discount on residential water charges for income-qualified senior, long-term disabled, and military veteran Customers,as set forth in Paragraphs A.1 and A.4. This Program remains in effect until terminated by the City Council. 1. Qualifications To receive the assistance as an income-qualified senior Customer,the following guidelines must be met: a. Have an annual household income level of 80% or less of the Orange County median, according to the annual Housing and Urban Development Section 8 income guidelines. b. Be at least 62 years of age as demonstrated by submitting a copy of state issued identification. c. Be a residential Customer of record or Sub-metered master-metered Customer. To receive the assistance as an income-qualified long-term disabled Customer, the following guidelines must be met: a. Have an annual household income level of 80% or less of the Orange County median, according to the annual Housing and Urban Development Section 8 income guidelines. b. Submit to the Utility Social Security Supplement to Income (SSI) documentation or a letter from a licensed physician. c. Be a residential Customer of record or Sub-metered master-metered Customer. To receive the assistance as an income-qualified military veteran Customer, the following guidelines must be met: a. Have an annual household income level of 80% or less of the Orange County median, according to the annual Housing and Urban Development Section 8 income guidelines. b. Submit to the Utility identification establishing military service such as a copy of a DD-214,Veteran Health Identification Card(VHIC),or Common Access Card(CAC). c. Be a residential Customer of record or Sub-metered master-metered Customer. Adjustment of Water Bills Income-qualified senior,long-term disabled,and military veteran residential water Customers will receive a ten percent (10%)discount applied to the water charges on their bill.For the purpose of this Rule, these water charges include the Customer Charge, Commodity Charge, Schedule W-CA charge, and Schedule W-SRA charge. The discount shall appear as a line item on the Customer's bill. The discount shall be calculated separately for each Customer individually metered by the Utility,based upon the water charge. Master-metered Customers that provide water Sub-metering to qualified tenants are also eligible for the water discount.The master-metered Customer shall be issued a flat discount amount equal to $5 per month. This will be multiplied by the number of income-qualified senior, long-term disabled,and military veteran tenants who are Sub-metered to the master meter. 3. Termination of Billing Discount Once instituted,the discount shall remain in effect until any one of the following occurs: 1. The annual household income of the income-qualifying senior,long-term disabled,or military veteran person exceeds 80% of the Orange County median, according to the annual Housing and Urban Development Section 8 income guidelines. 2. For individually metered accounts, the income-qualifying senior, long-term disabled, or military veteran person is no longer named on the Customer account. 3. For master-metered accounts, the income-qualifying senior, long-term disabled, or military veteran person is no longer named as the tenant. 4. Funds allocated to the program are exhausted. 5. The Income-Qualified Senior/Long-term Disabled/Military Veteran Water Discount Program is terminated by the City Council. 4. Billing Discount 1. Income-qualified senior, long-term disabled, and military veteran Customers who are individually metered by the Utility will receive a ten percent (10%) discount applied to the water charges on their bill,including the Customer Charge,Commodity Charge,Schedule W- CA charge,and Schedule W-SRA charge,as shown in the following formula: (Customer Charge+Commodity Charge+WCA+WSRA)X.10=Water Discount 2. Master-Metered Customers a. Master-metered Customers that provide water Sub-metering and issue water bills to their tenants shall be issued a flat monthly discount for their income-qualifying senior, long- term disabled,and military veteran tenants using the following formula: Number of income-qualified senior,long-term disabled,and military veteran tenants X$5 =Water Discount. The master-metered Customer shall pass this savings directly on to the income-qualified senior,long-term disabled,and military veteran tenants. b. The master-metered Customer shall maintain records of proof of payment of Customer credits to qualified tenants. The records of proof of payment of Customer credits to qualified tenants are subject to periodic review and audit by the Utility. Credits that are misappropriated are subject to recapture on the master-metered Customer bill by the Utility. EMERGENCY ASSISTANCE Emergency Water Utility bill payment assistance is offered by the Utility to income-qualified residents, subject to available funding. Customer service representatives will provide information regarding Water Utility bill payment assistance,including the application process.Customers approved for emergency Water Utility bill payment assistance receive assistance in the form of a bill credit applied to the water charges portion of the Customer's bill. C. THIRD PARTY FINANCIAL ASSISTANCE Customers experiencing financial difficulty may qualify for Water Utility bill payment assistance from a third-party local, state, or federal agency. The Utility is not directly affiliated with these agencies but provides a list of such agencies on its website. Assistance from these agencies is subject to Customers meeting the agency's eligibility requirements and is dependent upon available funding. Payments received by the Utility from such agencies, on behalf of the Customer,shall be applied to the water charges portion of the Customer's Utility bill.
