RES-1989-183RESOLUTION NO. 89R-183 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING A SLOPE EASEMENT ADJACENT TO SHORT STREET. WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 16th day of May, 1989, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation; and WHEREAS, the City Council does find, from the evidence submitted, that the street, highway or public service easement hereinafter specifically described is unnecessary for present or prospective public purposes including nonmotorized transportation facilities. WHEREAS, if and to the extent that there are in place public utility facilities in use for which easements are not reserved and excepted by this resolution, the City Council hereby determines that the public convenience and necessity requires that no easements be reserved for such facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the city of Anaheim does hereby order the vacation of a slope easement adjacent to Short Street more specifically described as follows: THAT PORTION OF LOT 4, IN BLOCK 34 OF THE YORBA LINDA TRACT, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON MAP FILED IN BOOK 5, PAGES 17 AND 18, OF MISCELLANEOUS MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF SAID COUNTY DESCRIBED AS FOLLOWS: BEGINNING AT THE INTERSECTION OF THE CENTER LINE OF SHORT STREET WITH THE CENTER LINE OF KELLOG DRIVE, AS SAID INTERSECTION IS SHOWN ON TRACT NO. 9857, IN SAID CITY, COUNTY AND STATE, AS SHOWN ON MAP FILED IN BOOK 456, PAGES 11 AND 12, OF MISCELLANEOUS MAPS, IN THE OFFICE OF SAID COUNTY RECORDER; THENCE ALONG THE CENTER LINE OF SAID SHORT STREET NORTH 55° 00' 24" WEST 255.55 FEET, THENCE SOUTH 54° 59' 36" WEST 21.00 FEET TO A POINT ON A LINE PARALLEL WITH AND 21.00 FEET 88-18A SOUTHWESTERLY MEASURED AT RIGHT ANGLES FROM THE CENTER LINE OF SAID SHORT STREET, SAID POINT BEING ALSO THE TRUE POINT OF BEGINNING; THENCE ALONG SAID PARALLEL LINE, SOUTH 55° 00' 24" EAST 188.23 FEET TO THE BEGINNING OF A TANGENT CURVE CONCAVE SOUTHWESTERLY HAVING A RADIUS OF 33.00 FEET; THENCE SOUTH EASTERLY ALONG SAID CURVE THROUGH A CENTER ANGLE OF 75° 36' 10" AN ARC DISTANCE OF 43.54 FEET TO THE BEGINNING OF A REVERSE CURVE CONCAVE SOUTHEASTERLY HAVING A RADIUS OF 1042.12 FEET; THENCE SOUTHWESTERLY ALONG SAID REVERSE CURVE THROUGH A CENTRAL ANGLE OF 0° 14' 35" AN ARC DISTANCE OF 4.42 FEET; THENCE NORTH 41° 40' 26" EAST 34.98 FEET TO THE TRUE POINT OF BEGINNING. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded in the Office of the Recorder of Orange County. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange.
