A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ESTABLISHING A GRADING
PERMIT APPEAL FEE
WHEREAS, the City Council of the City of Anaheim has
heretofore adopted Chapters 17.04 and 17.06 of the Anaheim
Municipal Code relating to grading and excavation of property in
the City of Anaheim; and
WHEREAS, certain provisions of said chapters authorize
the filing of appeals to the City Council from decisions rendered
thereunder by the City Engineer and further provide that any such
appeal shall be accompanied by an appeal fee in an amount as
established by resolution o£ the City Council; and
WHEREAS, the City Council desires to establish said
appeal fee in the amount hereinafter set forth; and
WHEREAS, the fee hereinafter established does not exceed
the estimated reasonable cost of providing the service for which
the fee is charged; and
WHEREAS, prior to approving said fee, the City Council
has held at least one duly noticed public hearing at which oral
and written presentations could be made concerning said proposed
fee as part of a regularly scheduled meeting of the City Council;
and
WHEREAS, the City of Anaheim has heretofore complied with
the applicable requirements of Chapter 15.1 of Part 1 of Division
2 of Title S of the Government Code of the State of California
concerning local agency service fees and charges.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that an appeal fee of One Hundred Fifty Dollars
($150.00) is hereby established for appeals filed pursuant to
sections 17,04.160 or 17.06.281 of the Anaheim Municipal Code.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council o{ the City of Anaheim this 23rd day of May, 1989.
