A RESOLUTION MAKING FINDING WITH RESPECT TO THE
NEGOTIATED SALE OF THE CITY OF ANAHEIM COMMUNITY
FACILITIES DISTRICT NO. 1989-2 (THE HIGHLANDS) SPECIAL TAX
BONDS
Community Facilities District No. 1989-2 (The Highlands)
RESOLVED, by the City Council of the City of Anaheim (the "City") that:
WHEREAS, this City Council has heretofore approved the sale and issuance of
City of Anaheim Community Facilities District No. 1989-2 (The Highlands) Special Tax
Bonds (the "Bonds"); and
WHEREAS, the documents approved by this City Council in connection with the
sale of the Bonds contemplate a negotiated sale to Stone & Youngberg (the
"Underwriter") and the Mello-Roos Community Facilities Act of 1982, as amended,
requires that this City Council make a finding and determination in order to sell the
Bonds on a negotiated basis; and
WHEREAS, the Underwriter and the City's Financial Advisor for the Bonds have
submitted documentation indicating that the sale of the Bonds on a negotiated basis will
result in a lower overall cost.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. This City Council with the aid of the City staff, has reviewed the information
supplied by the Underwriter and the City's Financial Advisor with respect to the pricing
of the Bonds and, based upon such information, hereby finds and determines that the
negotiated sale of the Bonds to the Underwriter will result in a lower overall cost.
2. This resolution shall take effect from and after its adoption.
