RES-1989-236RESOLUTION NO. 89R-236 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ESTABLISHING AN ELECTRICAL UTILITY FACILITIES PLAN FOR THE WEIR CANYON AREA OF BENEFIT. WHEREAS, Section 17.08.437 of Chapter 17.08 of Title 17 of the Anaheim Municipal Code permits the City Council to establish electrical utility facilities plans; and WHEREAS, the City Council does hereby find and determine as follows: 1) That area (hereinafter Area) located south of the Riverside Freeway extending easterly from a point located approximately midway between Fairmont Boulevard and Weir Canyon Road to the present City limits. z) That the Area is about to be developed with large residential and commercial land uses. 5) That the area, when developed, cannot be adequately or properly served without the electrical improvements described in the Plan; and WHEREAS, an Electrical Utility Facilities Plan For The Weir Canyon Area of Benefit (hereinafter the Plan) has been formulated; and WHEREAS, the Plan identifies the electrical utility facilities (including land, structures, and equipment) which the City Council does hereby determine are reasonably necessary to provide adequate electrical utility service to the area of benefit; and WHEREAS, the Plan does establish the boundaries of the area of benefit, the actual cost of the Electrical Utility Facilities and the method of apportionment of the cost of said facilities; and plan; and WHEREAS, a public hearing was held to consider the WHEREAS, the boundaries of the area of benefit are outlined on that map (marked Exhibit A) entitled "Weir Canyon Area of Benefit - Electrical Utility Facilities Plan" on file in the Office of the City Clerk which boundaries are incorporated herein by reference; and WHEREAS, the estimated cost of the Electrical Utility Facilities is Five Hundred Thirteen Thousand Five Hundred Ninety-Three Dollars ($513,595.00); and WHEREAS, the method of apportionment is based on a net acreage basis. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby adopt and establish that plan entitled "Electrical Utility Facilities Plan for the Weir Canyon Area of Beneift." BE IT FURTHER RESOLVED that the fees established by the PLAN shall be collected in accordance with Title 17 of the Anaheim Municipal Code. BE IT FURTHER RESOLVED that the fees established by the PLAN shall not apply to any plan for any structure which has been flied with, and the plan check fee paid to, the Building Division prior to the date o£ adoption of this resolution. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 13th day of June, 1989.
