RES-1989-239RESOLUTION NO. 89R-239 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO CERTAIN CONDITIONS OF APPROVAL IN CONDITIONAL USE PERMIT NO. 3117, AMENDING RESOLUTION NO. 89R-118 ACCORDINGLY, AND GRANTING A WAIVER OF MINIMUM OFFSTREET PARKING REQUIREMENTS. WHEREAS, the City Council of the City of Anaheim heretofore adopted Resolution No. 89R-118 approving Conditional Use Permit No. 3117, in part, subject to certain conditions specified therein; and WHEREAS, the permittee has now requested an amendment to certain of said conditions of approval; and WHEREAS, the City Council held a duly noticed public hearing on June 13, 1989, at which hearing the City Council did receive and consider evidence, both oral and documentary, relating to said request; and WHEREAS, the City Council hereby finds and determines that the amendment of said conditions of approval in the manner hereinafter set forth is reasonably necessary to protect the public peace, health, safety or general welfare, or necessary to permit reasonable operation under said Conditional Use Permit. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the conditions of approval heretofore imposed in Conditional Use Permit No. 3117 be, and the same are hereby, amended by the deletion of Condition No. 5, as set forth in Resolution No. 89R-118, therefrom. BE IT FURTHER RESOLVED that, except as expressly amended herein, Resolution No. 89R-118 shall remain in full force and effect. BE IT FURTHER RESOLVED that the City Council hereby grants a waiver of the minimum number of off-street parking requirements for the aforesaid use from the Code requirement of five spaces (two enclosed) to the currently existing four spaces (two enclosed), subject to the conditions heretofore imposed in Conditional Use Permit No. 3117 (as amended herein), based upon the following findings: 1. The waiver will not cause an increase in traffic congestion in the immediate vicinity nor adversely affect the adjoining land uses; and CUP 3117 'T 2. The granting of the waiver under the conditions imposed will not be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 13th day of June, 1989.
