RES-1989-256RESOLUTION NO. 89R-256 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A NEW FEE SCHEDULE OF SANITATION CHARGES AND REPEALING RESOLUTION NO. 89R-85 WHEREAS, the City Council of the City of Anaheim has established a policy to adopt all fees and charges to be collected within the City of Anaheim by resolution; and WHEREAS, the City Council has heretofore adopted Resolution No. 89R-85 establishing certain sanitation charges; and WHEREAS, the City Council desires to establish a new fee schedule for sanitation charges; and WHEREAS, the City of Anaheim has complied with the notice and hearing requirements pertaining to fee revisions as set forth in the Government Code of the State of California; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the following fee schedule be, and the same is hereby, adopted for sanitation charges in the City of Anaheim: 1. RESIDENTIAL SOLID WASTE COLLECTION CHARGES (a) For standard collection (available to all residential dwelling units) consisting of one solid waste collection per week from disposal or reusable containers, the sum of Eight Dollars and 28/100 ($8.28) per dwelling unit per month. (b) For bulk collection (available only to apartments, condominiums, and mobile homes which use the three cubic yard bulk containers supplied by the City's solid waste collection contractor), the basic sum of Seven Dollars and 33/100 ($7.33) per dwelling unit per month. In addition to the basic fee, the contractor is entitled to charge, by direct billing to the owner or manager requesting such service, an additional fee in accordance with the following schedule: Class of Service Frequency of Collections Monthly Charge A 1 per week $24.50 B 2 per week $39.90 C 3 per week $55.30 D 4 per week $70.70 E 5 per week $86.10 F 6 per week $101.50 (c) For special collection (available to residential dwelling units which generate solid waste o£ a character or quantity which requires special collection), the charges shall be the reasonable cost of the removal thereof as determined by the Director of Maintenance of the City of Anaheim. 2. COMMERCIAL AND INDUSTRIAL SOLID WASTE COLLECTION CHARGES Solid waste collection services are available on a regularly scheduled basis to all commercial and industrial establishments. Such establishments include motels, hotels, recreational vehicle parks, restaurant, professional offices, club houses, places of entertainment, manufacturing plants, private schools, and any other organization or business whether of a service, wholesale or retail variety, including nonprofit organizations. (a) For standard collection (available to all commercial or industrial establishments) consisting of one solid waste collection per customer per week from a maximum of four disposable or reusable containers, the sum of Nine Dollars and 52/100 ($9.32) per container per month. (b) For bulk collection (available only to establishments which use the three cubic yard bulk containers supplied by the City's solid waste collection contractor), the following monthly fees shall apply: Class of Service Frequency of Collections Monthly Charge A 1 per week $68.82 B 2 per week $99.22 C 3 per week $129.62 D 4 per week $160.02 E 5 per week $190.42 F 6 per week $220.82 (c) For special collection (available to establishments which generate solid waste of a character or quantity which requires special collection), the charges shall be the reasonable cost of the removal thereof as determined by the Director o£ Maintenance of the City o£ Anaheim. 3. RESIDENTIAL SEWER MAINTENANCE CHARGES (a) For each residential dwelling unit located within the City of Anaheim to which a sewer main, owned and/or maintained by the City of Anaheim, is available, the sum of 28/100 ($0.28) per dwelling unit per month. 060889 -2 - (b) For each residential dwelling unit located outside the corporate limits of the City of Anaheim, which is connected to the Anaheim sewer system and which receives water and/or electric service from the City of Anaheim, the sum of One Dollar and 10/100 ($1.10) per dwelling unit per month. (c) For each residential dwelling unit located outside the corporate limits of the City of Anaheim, which is connected to the Anaheim sewer system but which does not receive water and/or electric service from the City of Anaheim, the sum of Twenty Dollars ($20.00) per year. Said fee is due and payable on, or before the first of July of each year. A penalty sum of Five Dollars ($S.00) per month (not prorated) shall be added to the amount due at the beginning of each month, commencing with the first day of August, for default of full payment. Said fee is non-refundable, in whole or in part, and shall be paid annually, in advance, to the Director of Finance of the City of Anaheim. COMMERCIAL AND INDUSTRIAL SEWER MAINTENANCE CHARGES (a) For each commercial or industrial establishment, including but not limited to, motels, hotels, restaurants, professional offices, club houses, places of entertainment, manufacturing plants, public and private schools, and any other organization or business whether of a service, wholesale or retail variety, including nonprofit organizations (but excluding recreational vehicle parks), a fee of 61/100 ($0.61) per month for each water closet located therein. (b) For each recreational vehicle park, a fee of 61/100 ($0.61) per month for each water closet located therein, and an additional fee of 61/100 ($0.61) per month for each recreational vehicle space equipped with a sewage disposal connection. 5. STREET CLEANING CHARGES (a) For each residential dwelling unit located within the City of Anaheim, a fee of One Dollar and 45/100 ($1.45) per dwelling unit per month. 060889 -3- (b) For each commercial or industrial establishment located within the City of Anaheim, a fee of Two Dollars and 98/100 ($7..98) per establishment per month. BE IT FURTHER RESOLVED that the provisions of this resolution shall be deemed effective July 1, 1989 and that Resolution No. 89R-85 shall be deemed repealed effective as of such date. day of THE FOREGOING RESOLUTION is approved and adopted this 20th June , 1989.
