88-031RESOLUTION NO. 88R-31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE REPORT OF THE SUPERINTENDENT OF STREETS FOR CERTAIN IMPROVEMENTS TO BE MADE BY THE CITY UNDER THE STREET LIGHTING ACT OF 1931. WHEREAS, the City Council of the City of Anaheim did require the Superintendent of Streets to make and file with the City Clerk a written report with reference to proposed street lighting improvements under the Street Lighting Act of 1931; and WHEREAS, the Superintendent of Streets did make such written report and filed said report with the City Clerk of the City of Anaheim; and WHEREAS, the City Clerk of the City of Anaheim did present said report to the City Council for consideration; and WHEREAS, the City Council of the City of Anaheim did consider the report and did consider the cost estimate of the Superintendent of Streets, did consider the period of time recommended for the improvements, did consider the diagram or map showing the streets affected by the proceedings, did consider the lots or parcels of land abutting upon such streets, did consider the proposed assessment of the total amount of the probable or estimated cost and expenses of the proposed improvements upon the several lots or parcels of land shown upon the diagram or map in proportion to the estimated benefits to be received by each such lot or parcel of land for the period of rime recommended for the continuance of the improvements, and did consider the plans and specifications of the street lighting system. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Report of the Superintendent of Streets, as submitted, is hereby approved and shall stand hereafter as the Report for the purpose of all subsequent proceedings in Street Lighting Assessment District 1984-1. BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, directed to keep a copy of said Report on file ~n her office for reference by any party interested in the proposed assessment district. LEGAL NOTICE RESOLUTION NO. 88R- 3~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO MAKE CERTAIN IMPROVEMENTS UNDER THE AUTHORITY OF THE STREET LIGHTING ACT OF 1931, DESCRIBING THE IMPROVEMENTS TO BE MADE, NAMING THE STREETS UPON WHICH THE IMPROVEMENTS ARE TO BE MADE, REFERRING TO THE REPORT OF THE SUPERINTENDENT OF STREETS ON FILE IN THE OFFICE OF THE CITY CLERK, FIXING THE PERIOD OF TIME FOR WHICH THE IMPROVEMENTS ARE TO BE MADE. AND SETTING A TIME AND PLACE FOR HEARING PROTESTS. WHEREAS, the City Council of the City of Anaheim is of the opinion that public interest and convenience requires that a portion of the street lighting system be maintained and serviced upon certain streets in the City of Anaheim, as hereinafter set forth: and WHEREAS, the City Council did require the Superintendent of Streets to make and file with the City Clerk a written report with regard to the contemplated improvements; and WHEREAS, said report of the Superintendent of Streets was approved by the City Council of the City of Anaheim on the 26th day of January, 1988, by Resolution No. 88R-31 and filed with the City Clerk. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim, as follows: 1. Public interest and convenience does require that improvements be made to certain property in the City of Anaheim, and the City Council of the City of Anaheim does hereby declare its intention to make the following described improvements under the authority of the Street Lighting Act of 1931. 2. The improvements to be made are the maintenance and servicing of a street lighting system along and upon: Citron Street between South Street and Santa Ana Street, and Indiana Street, Ohio Street, Resh Street, Janss Street, and Pine Street between South Street and Water Street in Tract Nos. 1453, 1401, 1400, 1374, 335, and 217. 3. A report of the Superintendent of Streets has been approved by the City Council of the City of Anaheim and is on file with the City Clerk of the City of Anaheim, designated "Street Lighting Maintenance District 1984-1." Said report contains an astimate of the cost of the improvements and incidental expenses for the period of time the improvements are to be made, a diagram or map showing the street affected and showing each lot or parcel of land abutting such street, a proposed assessment of the total amount of the estimated cost and expenses upon the several lots or narcels of land shown on the diagram or map in proportion to the stimated benefits to be received by each lot or parcel of land or the period of time of the improvements, and plans and specifications setting out the general type of street lighting system and the location of the lights to be serviced and maintained: and reference to such report is hereby made as though set forth in full herein, and all persons are directed to such report on file with the city Clerk for more particulars. 4. The period of time for which the improvements are to be made is hereby set at five (5) years, to commence on or about July 1, 1988, and to continue for five (5) years from such date. AND BE IT FURTHER RESOLVED that the 16th day of February, 1988, at the hour of ]:30 o'clock p.m. in the Council Chamber of the civic Center in the City of Anaheim, is hereby declared as the day, hour and place, when and where any and all persons having any objections to the proposed improvements or to the assessment as set forth in the report of the Superintendent of Streets, may appear before the legislative body and show cause why the proposed improvements should not be carried out in accordance with the report of the Superintendent of Streets on file with the City Clerk. Protests must be in writing and must contain a description of the property in which each signer thereof is interested, and be delivered to the City Clerk not later than the time set for the hearing. Protests may be against the proposed improvements or against the estimated amount of the assessment. BE IT FURTHER RESOLVED that the Superintendent of Streets of the City of Anaheim shall cause notice of the improvements and of the passage of this Resolution of Intention to be conspicuously posted along the lines of the contemplated improvements, at not more than 300 feet apart, but not less than three (3) in all, and such posting shall be fully completed at least ten (10) days before the date set for hearing of protests of objections. The contents of such notice shall be in conformity with the requirements of the Street Lighting Act of 1931. BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby directed to publish this Resolution of Intention by insertion in the Anaheim Bulletin, a daily newspaper of general circulation, published and circulated in the ~ity of Anaheim.
