98-086RESOLUTION NO. 98R-86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DISAPPROVING ADMINISTPJtTIVE ADJUSTIMENT NO. 135. WHEREAS, an application for an Administrative Adjustment pursuant to the provisions of Section 18.12.080 of the Anaheim Municipal Code was received from Raymond Sharpe, owner, and Independent Development Co., Inc., agent, to construct an automated teller machine (ATM) kiosk on certain real property in the City of Anaheim commonly described as: 1701-1731 West Katella Avenue, Anaheim, California with a waiver of the following provision(s) of the Anaheim Municipal Code: Section 18.06.050.022 18.06.080 18.12.080.020 and 18.44.066.010 Minimum number of parking spaces. (178 existing and required in the commercial center. 175 proposed.) WHEREAS, the Zoning Administrator heretofore approved said Administrative Adjustment pursuant to Decision No. ZA 98-07 on March 19, 1998; and WHEREAS, thereafter, within the time prescribed by law, an interested party, or the City Council by the action of at least two of its members, caused the review of said decision by the City Council; and WHEREAS, the City Council did hold and conduct a duly noticed public hearing upon said application on May 12, 1998, and did give all persons an opportunity to be heard and did receive evidence and testimony and did consider the same; and WHEREAS, the City Council does hereby find and determine as follows: The application is a request for less than a ten percent (10%) deviation from the number of parking spaces required for the project pursuant to Title 18 of the Anaheim Municipal Code; The adjustment would cause an increase in traffic congestion in the immediate vicinity or adversely affect the adjoining land uses; and ~ The approval of the Administrative Adjustment would be detrimental to the peace, health, safety or general welfare of the citizens of the City of Anaheim.
