88-096RESOLUTION NO. 88R-96 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING THAT EASEMENT FOR ELECTRICAL UTILITY PURPOSES LOCATED AT THE NORTHEAST CORNER OF BROOKHURST STREET AND LINCOLN AVENUE. (87-15A) WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and ~HEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 25rd day of February, hearing was held to allow interested persons to concerning said proposed vacation; and 1988, a public submit evidence WHEREAS, the City Council does find, from the evidence submitted, that the street, highway or public service easement hereinafter specifically described is unnecessary for present or prospective public purposes including nonmotorized transportation facilities. WHEREAS, if and to the extent that there are ill place public utility facilities in use for which easements are not reserved and excepted by this resolution, the City Council hereby determines that the public convenience and necessity requires that no easements be reserved for such facilities. NOW, TItEREFORE, BE iT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of that public utility easement, more specifically described as follows: An easement granted to Southern California Edison Company by deed recorded October 6, 1954, as Document No. 81503, more particularly described as £ollows: An underground electric system consisting of underground conduits and a pull box with the wires therein and necessary appurtenances for conveying electric energy to be used for light, heat, power, telephone, and/or other purposes. The Grantee shall have the right to place and maintain in said underground electric system as many wires and other necessary appliances as it shall desire to do in the conduct of its business. Said real property is described as follows: A 10-foot strip of land in the West 165 feet of the South 194 feet of the Southwest one-quarter of the Southwest one-quarter of Section 8, Township 4 South, Range 10 West, S.B.B.&M., the centerline of which is described as follows: Beginning at a point in the East line of Brookhurst Avenue as now established 80 feet wide along the West side of said Section which point is 70 feet Northerly measured thereon from the North line of Lincoln Avenue as now established 60 feet wide along the South side of said Section; thence Easterly parallel with said North line of Lincoln Avenue 72 feet. Said easement was subsequently transferred to the City of Anaheim. BE IT FURTHER RESOLVED that the vacation authorized by this resolution shall not be effective until a certified copy of this resolution is recorded itt the Office of the Recorder of Orange County.
