88-308 RESOLUTION NO. 88R-308 A RESOLUTION OF THE CITY COUNCIL OF THE OF ANAHEIM DENYING VARIANCE NO. 3802. CITY WHEREAS, after a request for variance by CHANDER P. SHARMA AND VENU SHARMA, 3356 West Ball Road, Anaheim, California 92804, owners, and DEVELOPERS' ENGINEERS, ATTN: GARY PERKINS, 1401 N. Batavia, Suite 104, Orange, California 92667, agent, to permit a two (2)-story, twenty-nine (29)-foot high, single-family residence, was received, a public hearing before the Zoning Administrator of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 3802 was granted covering the following described property: Parcel 3 in the City of Anaheim, County of Orange, State of California, as shown on a map filed in Book 223, Pages 32 and 33 of Parcel Maps, in the office of the County Recorder of said County. Reserving therefrom: a non-exclusive easement for ingress, egress, public utilities and incidental purposes over those portions of said Parcel 3 of said Parcel Map shown as "Private Drive" on said Parcel Map; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That the applicant failed to present evidence that there are special circumstances applicable to the property which do not apply to other property in the same vicinity and zone. 2. That the applicant failed to present evidence that strict application of the zoning code would deprive the property of privileges enjoyed by other property in the same vicinity and zone. the City denied. NOW, THEREFORE, BE of Anaheim that said IT RESOLVED by the City Council of Variance be, and the same is hereby, BE IT FURTHER RESOLVED that the time within which rehearings must be sought is governed by the provisions of Section 1.12.100 of the Anaheim Municipal Code and the time within which judicial review of final decisions must be sought is governed by Section 1094.6 of the Code of Civil Procedure and Anaheim City Council Resolution No. 79R-524.
