88-285RESOLUTION NO. 88R-28~5 A RESOI, UTION OF ANAHEIM UNUERSTANDIN6 THE ANAHEIM OF ANAHEIM OF THE G1TY COIJNCII, OF THE CITY APPROVING A LETTER OF DATED JUNE 15, 1988, BETWEEN POLICE ASSOCIATION AND THE CITY WHEREAS, the Human Resources Director met and conferred with officials and employee representatives of the Anaheim Po]ice AssoclatJon and reached an agreement to amend subsection 44.1 of Article 44, General Overtime of the Memorandum of Understanding between the Anaheim Police Association and the City of Anaheim to read as follows: "44.1 Employees assigned to work overtime at events held in facilities operated by the City of Anaheim for which the City is reimbursed shall not be allowed compensatory time for such work but shall be compensated ut the overtime rate of pay." WHEREAS, a Letter of Understanding dated June 15, 1988, between the parties reflecting said amendment has been prepared and signed. WHEREAS. the City Council of the City of Anaheim does fiad that approval of said Agreement is in the best interest of the City of Anaheim. NOW. THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the Letter of Understanding dated Apri] 15, 1988, between the Anaheim Police Association and the City of Anaheim be, and the same is hereby, approved and the Haman Resources Director is authorized to sign said Agreement on behalf of the City of Anaheim. C£TY CLERK OF THE CITY OF ANAHEIM LETTER OF UNDERSTANDING between the CITY OF ANAHEIM and the ANAHEIM POLICE ASSOCIATION The Anaheim Police Association and the City of Anaheim after meeting and conferring, have reached an agreement to amend Article 44, General Overtime to read as follows: ARTICLE 44 GENERAL OVERTIME 44.0 A full time employee who performs authorized work in excess of his normal work period, regular work week, work day or shift shall be compensated for such work at the rate of one and one-half times his regular hourly rate of pay. 44.01 Overtime shall be calculated to the nearest one-quarter hoar of overtime worked, except any overtime of less than one-half (1/2) hour duration shall be calcalated to the nearest one-half (1/2) hour, 44.02 All overtime must be authorized by the appropriate division head. 44.03 Compensatnry time at the overtime rate for employees may be authorized by the appropriate supervisor in lieu of pay on the basis of the best interests of the Police Department and ANAHEIM; but, the employee shall have the option of being paid in (:ash for any overtime work performed, or accepting the half time portion in pay and accumulating the straight time. He shall also have the option of accruing up to a maximum of eighty (80) hours compensatory time per year. Such compensatory time shall be paid off to a balance of forty (40) hours on the last payday in Juae of each year. A terminatiug employee shall be compensated in cash at his current rate of pay for accrued compensatory time. 44.04 Notwithstanding the above overtime provisions, there shall be no compensation for the time spent in attending meetings of any kind which are for the purpese of education or training. 44.1 Employees assigned to work overtime at events held in facilities operated by the City of Anaheim for which the City is reimbursed shall not be allowed compensatory time for such work I)u~ shall be compensaled at the overtime ra~e of pay.
