RES-2020-080RESOLUTION NO. 2020- 0 8 0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE DONATION AND TITLE TRANSFER OF CITY EQUIPMENT TO THE SALVATION ARMY. WHEREAS, in February 2019, the Anaheim Emergency Shelter (the "Shelter") opened in partnership with the Salvation Army; and WHEREAS, The Shelter has served 793 homeless individuals in receiving wrap- around shelter services since opening; and WHEREAS, on June 1, 2020, the Shelter was expanded from 224 beds to 325 beds at the direction of City Council to provide services to additional homeless individuals in need of assistance; and WHEREAS, in order to support the high number of people served daily, the Shelter requires the use of motorized equipment for its daily site operations that includes transporting goods and deliveries, performing site maintenance, and moving supplies more efficiently throughout the Shelter campus.; and WHEREAS, when the Shelter opened, the Salvation Army received a used utility golf cart donation from City Net to make daily operations as efficient as possible. WHEREAS, the existing utility golf cart has come to the end of its useful life and the Shelter is in need of a replacement utility cart; and WHEREAS, Anaheim Department of Public Works has identified a 2006 Taylor Dunn electric utility cart ("Asset") that is still operable and is available for donation to the Salvation Army; and WHEREAS, it is agreed and understood between the parties that Salvation Army, at Salvation Army's sole cost and expense and without further contribution by Anaheim beyond donating the Asset, shall pay for all equipment, material, labor and supervision necessary to relocate the Asset including but not limited to, all necessary loading, transport and storage of the Asset; and WHEREAS, the Donation Waiver and Release Agreement, the proposed form of which has been presented to the City Council; and WHEREAS, Anaheim Charter Section 1222 empowers the City Council, by resolution, to transfer and/or convey title to personal property owned by Anaheim on such terms as are in the best interest of Anaheim; and WHEREAS, the public interests are served by donating and transferring title of the Asset to The Salvation Army. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The findings set forth herein are hereby adopted by the City Council of the City of Anaheim. 2. The City Council hereby waives Administrative Regulation 425 — Disposition of City Owned Surplus Personal Property, in order to donate the Asset to the Salvation Army for its use in operating a temporary homeless shelter. 3. The City Council approves the Donation Waiver and Release Agreement as presented to City Council, together with such additions, deletions, and changes thereto as are approved by the Public Works Director and the City Attorney, or their respective designees, such approvals to be conclusively evidenced by the execution. and delivery thereof. 4. Upon receipt of the executed Donation Wavier and Release Agreement from the The Salvation Army and the City of Anaheim's filing of the Department of Motor Vehicle Notice of Transfer and Release of Liability, the Public Works Director or designee is authorized to release and transfer such Asset to The Salvation Army or designee. 5. The Public Works Director or designee is further authorized and directed to take any and all actions necessary or advisable to implement the aforesaid Asset donation to The Salvation Army.
