88-422RESOLUTION NO. 88R-422 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A POLICY CONCERNING STREET CLOSURES OR PROttlBITION OF STREET ACCESS. WHEREAS, California Vehicle Code Section 21101 authorizes local authorities to adopt rules or regulations concerning the closure of highways or prohibition entry to, or exit from, or both, any street; and WHEREAS, California Vehicle Code Section 21101 such rules or regulations to be adopted by ordinance or resolution; and requires WHEREAS, a policy of the City Council entitled "Street Closures and Prohibited Street Access" has been drafted, the terms and conditions of which are acceptable to the City Council. NOW, THEREFORE, BE IT RESOLVED that that policy entitled "Street Closures and Prohibited Street Access" be, and it is hereby, adopted and shall constitute the City's rules and regulations concerning such matters. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this 13th day of December, 1988. CITY CLERK OF THE CITY OF ~NAHEIM CITY OF ANAHEIM - CALIFORNIA COUNCIL POLICY Subject: Policy Effective Number Date Page STREET CLOSURE 209 12/13/88 1 It shall be the policy of the City Council that any permanent street closure, or prohibition of entry to, or exit from, any street by means of barriers, will be done according to the provisions in Section 21101 of the California Vehicle Code. STREET CLOSURE The street is no longer needed for vehicular through traffic. PROHIBITION OF ACCESS P~GULATION$ 1. The trip generation rate is 15% higher than ITE Traffic Generation Standard and the street is not a through street serving adjacent developments, and 2. A petition representing 100% compliance in favor of closure from affected residents* has been received, and 3. Concurrence by emergency services such as the Police and Fire Departments, and 4. Concurrence by all other City Departments, and 5. Concurrence by all affected utilities, and 6. Should right of way be required, it shall be obtained by a voluntary dedication rather than by eminent domain, and 7. The cost of the closure shall be borne by the petitioners in the form of a cashier's check or other acceptable negotiable instrument. Acceptability shall be determined by the City. *"Affected residents" shall mean persons or entities owning record title to properties located contiguous to such street and between the point at which access is prohibited and the next closest street over which such owner has access to the public street system.
