88-377RESOLUTION NO. 88R-377 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING LEASE AGREEMENT AS SATISFYING REQUIREMENTS OF MUNICIPAL CODE SECTION 18.06.010.020. WHEREAS, the installment sale agreement which previ- ously satisfied the requirements of Anaheim Municipal Code Section 18.06.010.020 for the Anaheim Hilton and Towers located at 777 Convention Way (which requirements were formerly contained in Section 18.06.020.010) has terminated; and WHEREAS, Anaheim Hotel Partnership has initiated an application for a determination that a lease agreement to be entered into between Anaheim Hotel Partnership and Anaheim Realty Corporation will satisfy the requirements of Anaheim Municipal Code Section 18.06.010.020; and WHEREAS, the City Council did hold a public hearing upon said application on October 4, 1988 in the Council Chambers of the Anaheim Civic Center in the City of Anaheim, notices of which public hearing were duly given as required by the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did give all persons interested therein an opportunity to be heard and did receive reports and evidence, both oral and documentary; and WHEREAS, on OCTOBER 4, 1988, the City Council heretofore approved a Negative Declaration pursuant to the provisions of the California Environmental Quality Act relating, in part, to said application; and WHEREAS, the City Council hereby finds that the off-street parking described in Conditional Use Permit No. for the Hotel constitutes off-site parking as described in Municipal Code Section 18.06.010.020; 2288 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the lease agreement to be entered into by the owner of the Hotel and entity owning the parking spaces described in Conditional Use Permit No. 2288, as it may be amended, allowing the Hotel exclusive use of said 1539 spaces ("Lease Agreement") shall satisfy the requirement contained in said Section 18.06.010.020 so long as the Lease Agreement remains in effect (in lieu of the installment sale agreement), provided that such agreement is approved as to form by the City Attorney and is recorded in the office of the county recorder. BE IF FURTHER RESOLVED, that at the time said lease Agreement is effective and has been approved by the City Attorney, compliance with said Section 18.06.010.020 shall be deemed to relate back to the date of termination of the installment sale agreement.
