88-362 RESOLUTION NO. 88R-362 A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 3827. WHEREAS, after a request for variance by JACK NOSEK, et al., 1206 W. Ash Avenue, Fullerton, California 92633, owner, and THOMAS MAURER & ASSOCIATES, ATTENTION: RICK CRANE, 150 E1 Camino Real, No. 200, Tustin, California 92680, agent, was received, a the Zoning Administrator of the City of due and proper notice, a result of which denied covering the following described public hearing before Anaheim was held upon Variance No. 3827 was property: THE LAND REFERRED TO iN THIS REPORT IS SITUATED IN THE STATE OF CALIFORNIA, COUNTY OF ORANGE, AND IS DESCRIBED AS FOLLOWS: THE WESTERLY 74 FEET OF THE NORTHERLY 195 FEET OF THAT PORTION OF LOT 11 OF THE MILES RANCHO, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE, STATE OF CALIFORNIA, AS SHOWN ON A MAP THEREOF RECORDED IN BOOK 4, AT PAGE 7 OF MISCELLANEOUS MAPS, RECORDS OF SAID ORANGE COUNTY, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE SOUTH LINE OF SAID LOT, 332.35 FEET FROM THE SOUTHEAST CORNER OF SAID LOT; THENCE NORTH 0 DEGREES 9' 15" WEST 1318.71 FEET, MORE OR LESS, TO A POINT IN THE NORTH LINE OF SAID LOT 11; THENCE WESTERLY ALONG THE NORTH LINE OF SAID LOT, 174 FEET TO A POINT; THENCE SOUTHERLY ON A DIRECT LINE 1318.71 FEET, MORE OR LESS, TO A POINT ON THE SOUTH LINE OF SAID LOT 11; THENCE EASTERLY ALONG THE SOUTH LINE OF SAID LOT 174 FEET TO THE POINT OF BEGINNING; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there no special circumstances applicable to the property which do not apply to other property in the same vicinity and zone. 2. That strict application of the zoning code does not deprive the property of privileges enjoyed by other property in the same vicinity and zone. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that said Variance be, and the same is hereby, denied. BE IT FURTttER RESOLVED that the time within which rehearings must be sought is governed by the provisions of Section 1.12.100 of the Anaheim Municipal Code and the time within which judicial review of final decisions must be sought is governed by Section 1094.6 of the Code of Civil Procedure and Anaheim City Council Resolution No. 79R-524.
