88-323RESOLUTION NO. 88R-323 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING AN AMENDMENT TO THE CIRCULATION ELEMENT AND TEXT OF THE ANAHEIM GENERAL PLAN DESIGNATED AS AMENDMENT NO. 210. WHEREAS, the City of Anaheim, pursuant to the recommendations of the Planning Commission of the City of Anaheim, adopted a General Plan for the City of Anaheim including a Circulation Element which sets forth the parameters (roadway widths and generalized location) of arterial highways within current City boundaries and the City's ultimate sphere of influence; and WHEREAS, Section 65302(b) of the Government Code requires the adoption of a Circulation Element of the General Plan consisting of the general location and extent of existing and proposed major thoroughfares, transportation routes, terminals and other public utilities and facilities, all correlated with the Land Use Element of the Plan; and WHEREAS, the City's existing Circulation Element does not provide enough capacity at certain key intersections to demonstrate consistency with the Land Use Element, and even though many intersections have not yet been developed with the types and densities of land use allowed for by the General Plan, the twenty-four (24) intersections ("Critical Intersections") under consideration are currently experiencing unacceptable levels of congestion; and WHEREAS, design standard for said Critical Intersections contains three (3) through-travel lanes, dual left-turn lanes, a right-turn-only lane, a raised median and bus turnouts, and is intended for the prevention of possible future gridlock; and WHEREAS, pursuant to the provisions of law, the City Engineer and Traffic Engineer have requested an amendment to the Circulation Element of the General Plan to incorporate the following 24 additional Critical Intersection designations: Ball/Beach Ball/Brookhurst Ball/Euclid Ball/Harbor Beach/Lincoln Brookhurst/Katella Brookhurst/La Palma Convention Way/Harbor Convention Way/Haster Euclid/La Palma Euclid/Lincoln Harbor/Katella Harbor/La Palma Haster/Katella Kraemer/La Palma Kraemer/Orangethorpe La Palma/Imperial Highway La Palma/Lakeview La Palma/Magnolia La Palma/State College La Palma/Tustin Lincoln/Magnolia Lincoln/State College Orangethorpe/Imperial Highway WHEREAS, on the 9th day of May, 1988, the Planning Commission of the City of Anaheim did hold a public hearing to consider an amendment to the Circulation Element of the General Plan identifying the aforesaid Critical Intersections and their design standards; and WHEREAS, at said public hearing, the City Planning Commission did duly adopt its Resolution No. PC88-117 containing a report of its findings, a summary of the evidence presented at said hearing, and recommending that said Amendment to the Circulation Element of the General Plan designated as General Plan Amendment No. 210 be adopted by the City Council; and WHEREAS, upon receipt of said Resolution, summary of evidence, report of findings and recommendations of the City Planning Commission, the City Council did fix the 12th day of July, 1988, as the time, and the City Council Chamber in the Civic Center as the place for a public hearing on said proposed General Plan Amendment No. 210 and did give notice thereof in the manner provided by law; and WHEREAS, the City Council did duly hold and conduct such public hearing and continued the same to July 26 and subsequently to August 16, 1988, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports and did consider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine: 1. That the hereinafter specified major street intersections in the City are currently operating at service levels at or above maximum street design capacity which condition often results in severe traffic congestion, lengthy travel time delays, unnecessary fuel consumption and increased air pollution. 2. That evidence was presented which substantiates the need for an amendment to the Circulation Element of the Anaheim General Plan to designate the following 24 additional Critical Intersections and provide for the design standard at such intersections as hereinabove specified to make the Circulation Element consistent with the Land Use Element of the General Plan: Ball/Beach Ball/Brookhurst Bali/Euclid Ball/Harbor Beach/Lincoln Brookhurst/Katella Brookhurst/La Palma Convention Way/Harbor Convention Way/Haster Euclid/La Palma Euclid/Lincoln Harbor/[atella Harbor/La Palma Haster/Katella Kraemer/La Palma Kraemer/Orangethorpe La Palma/Imperial Highway La Palma/Lakeview La Palma/Magnolia La Palma/State College La Palma/Tustin Lincoln/Magnolia Lincoln/State College Orangethorpe/Imperial Highway NOW, THEREFORE, BE IT RESOLVED that after considering Draft Environmental Impact Report No. 285 for the proposed General Plan Amendment So. 210 and reviewing evidence, both written and oral, presented to supplement Draft EIR No. 285, the City Council finds that EIR So. 285 is in compliance with the California Environmental Quality Act and the State and City Guidelines; and that EIR No. 285 identifies the following impacts which are considered to be both unavoidable and adverse in nature and not fully mitigated to a level of ~ns~gnificance: a. Noise levels at certain locations may exceed CNEL 65dB(A) exterior noise standards for abutting noise sensitive land uses. b. Residential uses encroach within the proposed right-of-way at nine (9) of the 24 intersections, resulting in the potential for approximately 128 displaced households (or approximately 346 people) at critical intersection buildout. Residential properties for which no City approvals are sought would experience no impact, unless implementation of a critical intersection is City-initiated. c. There will be a short- and long-term diminution in the usability of many parcels, due to the dedication or acquisition of additional right-of-way and ultimate street widening activities, resulting in smaller usable lot areas. This could serve as a deterrent for property owners to improve upon their land in order to avoid City review of permits and requirements for dedication; and, for those who do seek to make improvements, the size of their site will be reduced. d. That although certain inconsistencies with site development standards associated with the zoning classification of those properties fronting the critical intersection approaches may be eliminated by the granting of variances and conditional use permits, the relocation of structures, and the consolidation of adjacent yard areas, inconsistency with the original intent of the site development standards may still occur. BE IT FURTHER RESOLVED, however, that the benefits of the project have been weighed against the unavoidable adverse environmental impacts and, pursuant to Section 15093 of the State CEQA Guidelines, the occurrence of the significant environmental effects identified in EIR No. 285 as set forth above, may be permitted without further mitigation due to the £ollowing overriding considerations: a. Economic, social and physical considerations make unfeasible to eliminate ali of the significant environmental impacts which have been identified in the final EIR. it b. Such environmental impacts will be reduced by compliance with City Codes, policies and procedures. -3- c. BE IT FURTHER RESOLVED, that the City Council certifies Environmental Impact Report No. 285 for General Plan Amendment No. 210 and adopts the above Statement of Overriding Considerations. BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that Amendment No. 210 to the Circulation Element of the General Plan on file with the City be, and the same is hereby, adopted and approved. BE IT FURTHER RESOLVED that the Planning and it is hereby, instructed to amend the General text to conform to General Plan Amendment No. 210 adopted and approved.
