A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM DENYING AN AMENDMENT TO THE CONDITIONS OF
APPROVAL SET FORTH IN RESOLUTION NO. 88R-243
RELATING TO CONDITIONAL USE PERMIT NO. 3009
WHEREAS, the City Council of the City of Anaheim
heretofore adopted Resolution No. 88R-243 approving Conditional
Use Permit No. 3009, subject to certain conditions specified
therein; and
WHEREAS, the permittee has now requested an
amendment to certain of said conditions of approval; and
WHEREAS, the City Council held a duly noticed public
hearing on August 16, 1988, at which hearing the City Council did
receive and consider evidence, both oral and documentary, relating
to said request; and
WHEREAS, the City Council hereby finds and
determines that the amendment of said conditions of approval is
neither reasonably necessary to protect the public peace, health,
safety or general welfare, nor necessary to permit reasonable
operation under said Conditional Use Permit No. 3009.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that said request to amend the conditions
of approval of Conditional Use Permit No. 3009 as set forth in
Resolution No. 88R-243 be, and the same is hereby, denied and that
said Conditional Use Permit No. 3009 and all conditions heretofore
imposed thereon by Resolution No. 88R-243 shall remain in full
force and effect.
BE IT FURTHER RESOLVED that the time within which
rehearings must be sought is governed by the provisions of Section
1.12.100 of the Anaheim Municipal Code and the time within which
judicial review of final decisions must be sought is governed by
Section 1094.6 of the Code of Civil Procedure and Anaheim City
Council Resolution No. 79R-524.
