87-058RESOLUTION NO. 87R-58 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM VACATING EXISTING SEWER AND STORM DRAIN EASEMENTS LOCATED NORTH OF THE INTERSECTION OF NOHL RANCH ROAD AND MEATS AVENUE. (86-3A) WHEREAS, the City Council of the City of Anaheim did, by resolution duly adopted, declare its intention to vacate certain public streets, highways or public service easements pursuant to the Public Streets, Highways and Service Easements Vacation Law; and WHEREAS, notice of a public hearing to consider said vacation was posted and published in the manner prescribed by law; and WHEREAS, on the 24th day of February, 1987, a public hearing was held to allow interested persons to submit evidence concerning said proposed vacation; and WHEREAS, the City Council does find, from the evidence submitted, that the street, highway or public service easement hereinafter specifically described is unnecessary for present or prospective public purposes including nonmotorized transportation facilities. WHEREAS, the City Council does determine that the public convenience and necessity require the reservation and exception of the easement(s) and right(s) of way hereinafter specifically described. WHEREAS, if and to the extent that there are in place public utility facilities in use for which easements are not reserved and excepted by this resolution, the City Council hereby determines that the public convenience and necessity requires that no easements be reserved for such facilities. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of existing sewer and storm drain easements, north of the intersection of Nohl Ranch Road and Meats Avenue, more specifically described as follows: The abandonment of easements for sanitary sewer and storm drain purposes set forth as Parcels 1, 2 and 5 in the Judgment and Final Order of Condemnation recorded May 8, 1980 in Book 13602, pages 799 through 805 of Official Records over, under and across that portion of the land in the City of Anaheim, County of Orange, State of California as described in a deed to Peralta Hills Estates Company recorded April 29, 1977, in Book 12170, page 431 of Official Records of said Orange County, described as follows: Beginning at a point in the centerline of Nohl Ranch Road as shown on a Map of Tract No. 9864, recorded in Book 513, pages 16 through 21, inclusive, of Miscellaneous Maps, records of said County, said point being the §outhwesterly terminus of a course shown as N 48 degrees 59' 00" E, 685.15 feet, said point also being the beginning of a tangent curve concave northwesterly having a radius of 600.00 feet; thence Southwesterly along said curve through a central angle of 11 degrees 44' 31", an arc length of 122.96 feet to a point, a radial line through said point bears S 29 degrees 16' 29" E; thence along said radial line, N 29 degrees 16' 29" ~, 50.00 feet to a point lying on the northwesterly right of way line of said Nohl Ranch Road, being 60.00 feet wide, said point also being the True Point of Beginning; thence leaving said radial line, N 28 degrees 28' 23" W, 116.58 feet; thence N 3 degrees 42' 01" E, 352.?7 feet; thence N 7 degrees 57' 53" E, 133.64 feet; thence S 82 degrees 02' 07" E, 20.00 feet; thence N 7 degrees 57' 53" E, 18.30 feet, more or less, to the northerly line of the land described in said deed recorded in Book 12170, page 431 of Official Records; thence along said northerly line, N 87 degrees 22' 47" ~, 48.83 feet; thence S 7 degrees 57' 55" W, 144.01 feet; thence S 3 degrees 42' 01" ~, 424.72 feet; thence N 77 degrees 56' 29" E, 27.72 feet; thence S 26 degrees 35' 47" E, 65.00 feet, more or less, to a point lying on said northwesterly right of way line, said point lying on a curve concave northwesterly and having a radius of 570.00 feet, a radial line through said point bears S 25 degrees 55' 28" E, thence Northeasterly along said curve through a central angle of 3 degrees 45' 01". an arc length of 36.98 feet to the True Point of Beginning. FURTHER RESOLVED that the vacation authorized by shall not be effective until a certified copy of is recorded in the Office of the Recorder of BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a certified copy of this resolution to be recorded in the Office of the Recorder of the County of Orange at such time as the City Engineer shall certify that new easements and facilities have been provided to the City. -2- THE FOREGOING City Council of 1987.
