A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE ASSUMPTION OF
MAINTENANCE AND LIABILITY FOR LANDSCAPING AND
IRRIGATION FACILITIES ON IMPERIAL HIGHWAY FROM
ORANGETHORPE AVENUE TO THE SANTA ANA RIVER.
WHEREAS, the Redevelopment Agency of the City of Anaheim
proposes to improve Imperial Highway from Orangethorpe Avenue to
the Santa Ana River including the installation of landscaping and
irrigation facilities; and
WHEREAS, Imperial Highway is a State of California
highway and prior to issuing a permit for the work, Caltrans
requires a resolution approval from the City Council of the City
of Anaheim assuming responsibility for maintenance and liability
for the landscaping and irrigation facilities; and
WHEREAS, Caltrans also requires a letter of approval for
specific nonconforming encroachment construction; and
WHEREAS, the Engineering Department of the City of
Anaheim has reviewed and approved the plans for said improvement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the City hereby agrees to assume
responsibility for maintenance and liability for the landscaping
and irrigation facilities on Imperial Highway from Orangethorpe
Avenue to the Santa Aha River to be installed pursuant to said
non-conforming encroachment construction.
BE IT FURTHER RESOLVED that the City Engineer be, and he
is hereby, authorized to execute the letter of agreement and
approval attached hereto.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 10th day of March, 1987.
