87-067RESOLUTION NO 87R- 67 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 75R-565 RELATING TO PERSONNEL RULE 6, PREMIUM PAY WHEREAS, the Human Resources Director has recommended in a staff report dated February 24, 1987, that Personnel Rule 6 (Premium Pay) be amended to include certain part-time recreation classifications as exempt from overtime as provided in the Fair Labor Standards Act, and WHEREAS, as a result thereof, the need exists to amend Resolution No. 75R-565, which establishes Personnel Rule 6, Premium Pay, and WHEREAS, the City Council of the City of Anaheim does find that the recommended change to Personnel Rule 6, Premium Pay. is in the best interests of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 75R-565 be amended to read as follows: RULE 6. PREMIUM PAY Sub-Section 6.04 Certain job classes in the classified service shall be exempt from the above overtime provisions upon the recommendation of the Human Resources Director and the approval of the City Council. These job classes shall be designated in the resolution establishing rates for Job classes by an "X" before schedule numbers. Compensatory time off (at the rate of straight time) for overtime worked by employees in these job classes may be authorized and administered by the appropriate department head. Certain part-time classifications working in designated Recreation Programs shall be exempt from overtime. The programs of Playgrounds, Day Camp and Pearson Park Theatre have been designated as meeting the Recreational Employee Exemption as specified in Section 260 of the Fair Labor Standards Act. Specified part-time employees working in these programs shall be compensated at the straight time hourly rate for all hours worked. BE IT FURTHER RESOLVED that except for Section 6.04 as amended, Personnel Rule 6, Premium Pay shall remain unchanged and Resolution No. 75R-565 shall remain in full force and effect. BE IT FURTHER RESOLVED that the effective date of this amendment to Personnel Rule 6 shall be March 6, 1987. THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City of Anaheim this lOth day of March j 1987.
