A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING AN EASEMENT DEED CONVEY-
ING TO THE CITY OF ANAHEIM CERTAIN REAL PROP-
ERTY FOR AN EASEMENT FOR ROAD AND PUBLIC
UTILITY PURPOSES. (R/W #3500-87)
WHEREAS, the
desirous of purchasing
for municipal purposes,
utility purposes; and
City Council of the City of Anaheim is
the hereinafter described real property
to wit: An easement for road and public
WHEREAS, the owners of said property have offered to
sell and convey the same to the City; and
WHEREAS, the City Council of the City of Anaheim finds
that it is for the benefit and best interest of the City of
Anaheim to accept said offer and purchase said real property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of ABEL MENDEZ and CAROL A.
MENDEZ to sell to the City of Anaheim the following described
real property situated in the City of Anaheim, County of Orange,
State of California, to be used for an easement for road and
public utility purposes, and more particularly described as
follows:
That portion of Lots 4 through 8 inclusive of the
Babinger Subdivision as shown on a map recorded in
Book 7, page 25, Miscellaneous Maps, records of
Orange County, California, lying Westerly of the
following described line:
Commencing at a point in the South line of Lot 1
Easterly thereon 18.69 from the Southwest corner of
said Lot 1, said point being in the Westerly line of
Zeyn Street as conveyed to the City of Anaheim by
deed recorded March 1, 1924 in Book 512, page 257, of
Deeds, Records of said Orange County;
Thence South 89° 55' 00" West along the Southerly
line of Lots 1, 2, 5, 4 and 5 of said Subdivision a
distance of 170.95 feet to the TRUE POINT OF
BEGINNING of the aforementioned line;
Thence North 00° 25' 00" West a distance of 80.00
feet;
Thence North 26° 37'
feet, more or less,
Subdivision.
00" East a distance of 88.98
to the Northeasterly line of said
Excepting therefrom that portion in Los Angeles
Street, now Anaheim Boulevard, described as Parcel 2
in the Deed to the City of Anaheim, recorded May 11,
1934, in Book 676, page 1, Official Records of said
Orange County.
Also Excepting therefrom that portion in Lemon Street
as described in Parcels 1, 2 and 4 of the final
judgment of the Superior Court of the State of
California, in and for the County of Orange, in
action No. 23578 as recorded November 18, 1929 in
Book 325, page 281, Official Records of said Orange
County,
be, and the same is hereby, accepted by the City Council of the
City of Anaheim, and that the City of Anaheim accept a conveyance
of said property; provided, however, that nothing herein shall be
construed to be an acceptance of any parcel or property into the
City street system (Section 1806, Streets and Highways Code).
BE IT FURTHER RESOLVED that the Accounting Officer of
the City of Anaheim be, and he is hereby, authorized to issue a
warrant and pay to the owners of said real property, out of
General Funds of the City of Anaheim and charged to Account No.
46-792-7101-E2740 the sum of Two Hundred Twenty-Five Thousand
Dollars ($225,000.00).
BE IT FURTHER RESOLVED that the Senior Real Property
Agent be, and he is hereby, (1) authorized to execute escrow
instructions to effectuate this acquisition; (2) directed to
deposit the warrant authorized herein with the escrow agent along
with a certified copy of this resolution to be recorded upon close
of escrow.
