87-093RESOLUTION 87R-93 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DESCRIBING STATUS OF THE LINCOLN AVENUE REALIGNMENT, PHASE II, GRADE SEPARA- TION PROJECT AND AUTHORIZING THE FILING OF AN APPLICATION FOR FUNDING WITH THE DIRECTOR OF TRANSPORTATION, STATE OF CALIFORNIA. WHEREAS, the State of California Department of Transportation has required certified copies of a resolution stating that all matters prerequisite to the awarding of the construction contract for the Lincoln Avenue Realignment, Phase II, can be accomplished within one year after allocation of funds for the project by the California Highway Commission; and WHEREAS, the City Engineer has filed, on October 27, 1986, an application for an Order to Construct with the California Public Utilities Commission; and WHEREAS, the Atchison, Topeka and Santa Fe Railway Company and the City of Anaheim have executed a construction- maintenance agreement for the project; and WHEREAS, the City Council, at its regular meeting of June 24, 1986, allocated the amount of Eight Million One Hundred Thousand Dollars ($8,100,000.00), one hundred percent (100%) total cost of the project and will have sufficient local funds available as the work of the project progresses; and WHEREAS, the Environmental Coordinator of the City of Anaheim has determined that the project is Categorically Exempt under Public Resources Code Section 21080.13 and a Notice of Exemption has been filed; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does herewith authorize the City Engineer to file an application for funding with the California Highway Commission, Department of Transportation under the provisions of Section 190 of the Streets and Highways Code. BE IT FURTHER RESOLVED that the City Council has determined that all matters prerequisite to the awarding of the construction contract can be accomplished within one year after allocation of the funds for the project by the California Highway Commission and that sufficient local funds will be available as the work on the project progresses. BE IT FURTHER RESOLVED that the City Clerk is authorized and directed to forward certified copies of this resolution to the Director of Transportation, Department of Transportation, State of California, through the City Engineer the City of Anaheim. of THE FOREGOING RESOLtJTION is approved and adopted by the City Council of the City of Anaheim this 24th day of >larch, 1987.
