A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING CERTAIN IRRIGATION EASEMENTS
LOCATED SOUTH OF CORONADO STREET AND EAST OF
RED GUM STREET. (87-1A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS,
vacation was posted
and
notice of a public hearing to consider said
and published in the manner prescribed by law;
WHEREAS, on the 21st day of April, 1987, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW, THEREFORE, BE IT RESOLVED that the City Council
the City of Anaheim does hereby order the vacation of those
irrigation easements, more specifically described as follows:
of
A PORTION OF THE ANAHEIM EUCALYPTUS WATER COMPANY
EASEMENT, IN THE CITY OF ANAHEIM, COUNTY OF ORANGE,
STATE OF CALIFORNIA, AS DESCRIBED IN DEEDS RECORDED
IN BOOK 209, PAGE 391: BOOK 204, PAGE 291 BOTH OF
DEEDS; AND IN BOOK 11335, PAGE 1389 OF OFFICIAL
RECORDS, DESCRIBED AS FOLLOWS:
A RIGHT OF WAY NOT EXCEEDING FIVE (5) FEET ON EITHER
SIDE OF THE BOUNDARY LINES OVER, UNDER AND ACROSS
LOTS 139, 140, 141, 142 AND 143 OF "EUCALYPTUS FOREST
TRACT", IN THE CITY OF ANAHEIM, COUNTY OF ORANGE,
STATE OF CALIFORNIA, AS PER MAP RECORDED IN BOOK 5,
PAGES 29 AND 30, OF MISCELLANEOUS MAPS, RECORDS OF
SAID ORANGE COUNTY, TOGETHER WITH THAT PORTION OF
SANTA ANA STREET ADJOINING SAID LOTS ON THE SOUTHERLY
SIDE ABANDONED BY ORDER OF THE BOARD OF SUPERVISORS
OF SAID ORANGE COUNTY, DESCRIBED AS FOLLOWS:
BEGINNING AT THE SOUTHEASTERLY CORNER OF SAID LOT
139, AND RUNNING THENCE WESTERLY ALONG THE NORTHERLY
LINE OF SAID SANTA ANA STREET TO THE SOUTHWESTERLY
CORNER OF SAID LOT 143; THENCE AT RIGHT ANGLES
SOUTHEASTERLY 20 FEET TO THE CENTERLINE OF SAID SANTA
ANA STREET; THENCE EASTERLY ALONG THE CENTERLINE OF
SAID SANTA ANA STREET TO THE SOUTHEASTERLY EXTENSION
OF THE NORTHEASTERLY LINE OF SAID LOT 139; THENCE
NORTHERLY 20 FEET TO THE POINT OF BEGINNING.
RESERVING THEREFROM FOR WATER AND ELECTRICAL
FACILITIES THE WESTERLY 25 FEET OF SAID LOT 143,
EXCEPTING THEREFROM THE NORTHERLY 18 FEET THEREOF;
AND THE WESTERLY 30 FEET OF THE NORTHERLY 18 FEET OF
SAID LOT 143.
BE IT FURTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange.
THE FOREGOING RESOLUTION is approved and adopted by the
