87-195RESOLUTION NO. 87R-195 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORDERING A MUNICIPAL REORGANIZATION FOR THE TRANSFER OF CERTAIN UNINHABITED TERRITORY FROM THE CITY OF YORBA LINDA TO THE CITY OF ANAHEIM DESIGNATED AS ORANGE COUNTY MUNICIPAL REORGANIZATION NO. 80. WHEREAS, a resolution for a proposed municipal reorganization designated Orange County Municipal Reorganization No. 80 (transfer of territory from the City of Yorba Linda to the City of Anaheim) was heretofore filed by the City of Anaheim and accepted For filing on March 6, 1987, by the Executive Officer of the Local Agency Formation Commission ("Commission") pursuant to Part 3 o£ Title 5, Division 3, commencing with Section 56000 et seq. of the Government Code; and WHEREAS, the Executive Officer of the Commission, pursuant to Government Code Section 56838 set April 1, 1987, the hearing date of said proposal; and as WHEREAS, the Executive Officer of the Commission, pursuant to Government Code Section 56833 reviewed said proposal and prepared a report including his recommendation thereon, and furnished a copy of said report to each person entitled to a copy; and WHEREAS, said resolution was accompanied by proof satisfactory to the Commission that the sole land owner within the territory proposed to be reorganized has given its signed consent to such reorganization; and WHEREAS, said Commission on April 1, 1987, considered the proposal and report of the Executive Officer, and considered the factors determined by the Commission to be relevant to said proposal including, but not limited to, factors specified in Government Code Section 56841; and WHEREAS, said Commission has reviewed and considered the negative declaration issued by the City of Anaheim, as lead agency, on the underlying activity; and WHEREAS, said Commission adopted its Resolution No. 87-18 on April 1, 1987, making certain determinations and authorizing the City of Anaheim, as the conducting authority, to reorganize said territory without notice and hearing and without election pursuant to Section 56837 of the Government Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Orange County Municipal Reorganization No. 80 (Transfer of Territory from the City of Yorba Linda to the City of Anaheim) for that certain territory within the City of Yorba Linda, County of Orange, State of California, more particularly described in Exhibits A and B to this Resolution, be, and the same is hereby, approved and ordered without notice and hearing and without election pursuant to the authority of Section 56837 of the Government Code. BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim shall immediately transmit a certified copy of this resolution along with a remittance to cover the fees required by Sections 57200 and 54902.5 of the Government Code to the Executive Director of the Local Agency Formation Commission.
