ORDINANCE NO. 2094
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
TITLE 17, CHAPTER 17.08 OF THE ANAHEIM MUNICI-
PAL CODE, RELATING TO LAND DEVELOPMENT AND
RESOURCES, BY ADDING THERETO SECTION 17.08.300.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
AS FOLLOWS:
SECTION 1.
That Title 17, Chapter 17.08 of the Anaheim Municipal
Code be, and the same is hereby amended by adding thereto
Section 17.08.300 reading as follows:
"SECTION 17.08.300 DIVISION OF REAL PROPERTY
DEVELOPED FOR, OR PROPOSED
TO BE DEVELOPED FOR,
RESIDENTIAL USE.
"(a) CONDITIONS OF DIVISION. Any proposed division
of a parcel of real property, including an air
space division, which division results in the
creation of an undivided interest in common in
a portion of said parcel of real property,
together with a separate interest in a portion
of said parcel of real property, may be required
by the City of Anaheim to conform to any or all
of the following conditions:
1. The City Council of the City of Anaheim
may require that any portion of said real
property so divided, which is devoted to
or proposed to be devoted to uses deemed
by the City Council to be recreational or
leisure uses or uses accessory to the
primary residential use, be designated as
not a buildable lot for primary residential
use, and said City Council may require that
any development on, or use of, said
designated non -buildable lot or parcel
shall be limited to certain uses accessory
to the primary residential use as said
accessory uses may be specified and
approved by the City Council from time to
time.
2. The City Council of the City of Anaheim
may require that the persons or entities
dividing or proposing to divide said real
property shall provide, insofar as possible,
for the permanent maintenance of any
portion of the real property devoted to,
or proposed to be devoted to the afore-
mentioned accessory uses and which mainten-
ance provisions shall be subject to the
approval of the City Council.

3. The City Council of the City of Anaheim
may require that the persons or entities
dividing or proposing to divide said real
property shall provide methods and
procedures by which it is proposed to insure,
insofar as possible, the privacy of each
owner of an interest in air space or land
within the aforementioned real property
development by protecting each of said
owners from trespass to his parcel of air
space or land by any other such owner
within the aforementioned real property
development.
"(b) PROCEDURE. Persons or entities desiring to
divide land, as provided in Section 17.08.300,
shall follow the procedures specified in the
law of the State of California for the divi-
sion of land and shall follow the procedures
specified in Chapter 17.08 of the Anaheim
Municipal Code."
SECTION 2.
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be printed once within
fifteen (15) days after its adoption, in the Anaheim Bulletin,
a newspaper of general circulation, printed, published and
circulated in said City, and thirty (30) days from and after
its final passage it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and signed by
me this 19th _ day of January , 1965.

do hereby certify that the foregoing Ordinance No. 2094 was
introduced at a regular meeting of the City Council of the
City of Anaheim held on the 12th day of January , 1965, and
that the same was duly passed and adopted at a regular meeting
of said City Council held on the 19th day of January, 1965,
by the following vote of the members thereof:
AYES: COUNCILMEN: Pebley, Dutton, Krein and Chandler
NOES: COUNCILMEN: None
ABSENT: COUNCILMEN: Schutte
AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said Ordinance No. 2094 on the
19th day of January, 1965.
