4629FOLLOWS: ORDINANCE NO. 4629 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING VARIOUS SECTIONS, CHAPTERS AND TITLES OF THE ANAHEIM MUNICIPAL CODE RELATING TO OFFICERS AND DEPARTMENTS. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Section 1.04.110 of Chapter 1.04 of Title 1 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "1.04.110 CITY DEPARTMENTS CREATED. There are hereby created for the government of the City the following departments: Police Department Fire Department Public Utilities Department Public Works - Engineering Department Community Development and Planning Department Parks, Recreation and Community Services Department Finance Department Legal Department Human Resources Department City Clerk Department Library Department Convention Center, Stadium and Golf Department Data Processing Department Maintenance Services Department City Treasurer Department." SECTION 2. That Section 1.04.120 of Chapter 1.04 of Title 1 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "1.04.120 PUBLIC WORKS - ENGINEERING DEPARTMENT .010 The Public Works -Engineering Department shall be under the supervision of the Director of Public Works, which office is created. The City Engineer of the City of Anaheim may serve as, and have the title of, the Director of Public Works subject to appointment to such position by the City Manager and approval thereof by the City Council pursuant to Section 604 of the Anaheim City Charter. .020 The Director of Public Works shall exercise supervision and control over all City -owned property, buildings, equipment and public works, except the maintenance and repair thereof, and including the construction of all City -owned buildings and public works. .030 Any and all engineering functions, as defined by Section 6731 of the Business and Professions Code of the State of California, necessary or required to be performed in connection with any of the above-mentioned public works or properties, shall be done and performed by the City Engineer of the City of Anaheim, or such other registered engineer as may be authorized." SECTION 3. That new Section 1.04.140 be, and the same is hereby, added to Chapter 1.04 of Title 1 of the Anaheim Municipal Code to read as follows: "1.04.140 MAINTENANCE SERVICES DEPARTMENT. .010 The Maintenance Services Department shall be under the supervision of the Maintenance Services Director, which office is created. .020 The Maintenance Services Director shall exercise supervision and control over the maintenance and repair of all City -owned property, buildings, equipment and public works, including all mechanical and mobile equipment, welding, building, fabrication of metal parts, maintenance of domestic sewers, street cleaning, refuse collection, maintenance of city streets, maintenance of curbs and sidewalks, maintenance of safety devices, maintenance of minor structures, drains and culverts, and other property, except such City -owned properties or equipment as are, by the provisions of this Code, declared to be under the supervision and control of the head of some other City Department. LZ SECTION 4. That Section 1.04.160 of Chapter 1.04 of Title 1 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "1.04.160 COMMUNITY DEVELOPMENT AND PLANNING DEPARTMENT -- OFFICES OF PLANNING DIRECTOR AND CHIEF BUILDING INSPECTOR .010 The Community Development and Planning Department shall be under the supervision of a Director of Community Development and Planning, which office is hereby created. The Director of Community Development and Planning shall have direct responsibility for the administration and technical operations of the Community Development and Planning Department, the implementation of community redevelopment projects, and the acquisition, maintenance, demolition and repair of City -owned properties purchased with Community Development Block Grant Funds. .020 The Director of Community Development and Planning shall also have the title of Planning Director and shall perform the functions and duties of the Planning Director as set forth in this Code unless such functions and duties, or any of them, are delegated by the Director of Community Development and Planning to a duly authorized designee. .030 The Building Division under the supervision of the Director of Community Development and Planning shall be headed by the Chief Building Inspector, which office is created. It shall be the duty of the Chief Building Inspector, under the supervision of the Director of Community Development and Planning, to perform all duties required of the Chief Building Inspector under the ordinances of the City. The Chief Building Inspector shall be deemed to be the Building Official of the City of Anaheim and said Chief Building Inspector is hereby authorized and directed to perform the functions and duties of the Building Official as prescribed in this Code or in any code adopted by reference by any provision of this Code. The Chief Building Inspector shall have, and is hereby authorized to use, the title of Building Official of the City of Anaheim." -3- SECTION 5. That Section 1.04.210 of Chapter 1.04 of Title 1 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: "1.04.210 DEPUTY CITY MANAGER There is hereby created the office of Deputy City Manager who shall act as an aide to the City Manager in the performance of his duties and shall serve as Acting City Manager during the temporary absence or disability of both the City Manager and Assistant City Manager unless a different officer is appointed to serve in such capacity pursuant to Section 609 of the Anaheim City Charter." SECTION 6. That Section 18.01.170 of Chapter 18.01 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by adding thereto, in proper alphabetical sequence, the following terms and definitions: "'Planning Department.' The Community Development and Planning Department of the City of Anaheim. 'Planning Director.' The Director of Community Development and Planning of the City of Anaheim." SECTION 7. That Section 1.04.560 of Chapter 1.04 of Title 1 of the Anaheim Municipal Code be, and the same is hereby, repealed. SECTION 8. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. am SECTION 9. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 10. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in said City, and Thirty (30) days from and after its final passage, it shall take effect and be in full force.
