4639FOLLOWS: ORDINANCE NO. 4639 AN ORDINANCE OF THE CITY OF ANAHEIM REPEALING SECTIONS 15.16.001 THROUGH 15.16.080 OF TITLE 15, CHAPTER 15.16 OF THE ANAHEIM MUNICIPAL CODE AND ADOPTING THE 1984 EDITION OF THE NATIONAL ELECTRICAL CODE, WITH AMENDMENTS THERETO, AND AMENDING TITLE 15, CHAPTER 15.16, BY ADDING THERETO NEW SECTIONS 15.16.001 THROUGH 15.16.110. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That Sections 15.16.001 through 15.16.080 of Title 15, Chapter 15.16 of the Anaheim Municipal Code be, and the same are hereby, repealed. SECTION 2. That Title 15, Chapter 15.16 of the Anaheim Municipal Code be, and the same is hereby, amended by adding thereto new Sections 15.16.001 through 15.16.110 to read as follows: "SECTION 15.16.001 APPROVAL OF CODE The City Council does find and determine, as a result of study and investigation conducted by the City and its building officials, that the National Electrical Code, 1984 Edition, is an approved Code for adoption by reference within the meaning of Section 50022.1 of the Government Code of the State of California. SECTION 15.16.010 ADOPTION OF NATIONAL ELECTRICAL CODE, 1984 EDITION Pursuant to the provisions of Sections 50022.1 to 50022.8, inclusive, of the Government Code of the State of California, the City Council of the City of Anaheim does hereby adopt, by reference, the National Electrical Code, 1984 Edition (hereinafter in this chapter referred to as the "National Electrical Code"), with amendments thereto as set forth in this chapter; at least one copy of the Code shall be filed in the Office of the City Clerk and shall be kept there for public inspection while the Code is in -1- force. The City Clerk shall at all times maintain a reasonable supply of copies of the Code available for purchase by the public at a moderate price not to exceed the actual cost thereof to the City of Anaheim. SECTION 15.16.020 CONDUCTORS Section 110-5 of the National Electrical Code is hereby amended to read as follows: Conductors normally used to carry current shall be of copper unless otherwise provided in this Code. Where the conductor material is not specified, the sizes given in this Code shall apply to copper conductors. Where other materials are used, the size shall be changed accordingly. All sections of this National Electrical Code allowing the use of aluminum conductors are subject to the limitation that no aluminum conductor smaller than #6 AWG shall be used. SECTION 15.16.030 SCOPE Section 210-1 of the National Electrical Code is hereby amended to read as follows: Section 210-1. The provisions of this Article apply to branch circuits supplying lighting or appliance loads or combinations of both. Where motors or motor -operated appliances are connected to any branch circuit that also supplies lighting or other appliance loads, the provisions of both this Article and Article 430 shall apply. Article 430 shall apply where a branch circuit supplies motor loads only. Exception: See Section 668-3(c), Exceptions No. 1 and No. 4 for electrolytic cells. (a) Accessory uses or other buildings, signs, etc., separately located on the same lot or premises shall have connecting conductors run underground. (Agricultural areas excepted.) (b) Where space circuit protective devices are provided or space for future circuit protective devices is provided on the buss in any flush or semiflush mounted panel, then raceways of sufficient capacity to permit utilization of such space or spaces shall be provided to an approved accessible location. Such accessible location is normally defined as follows: Where sufficient attic space is available or underfloor space is available, a raceway shall terminate conveniently for future use in each such space. Where this condition does not exist or other factors govern, then such terminations shall be approved by the electrical inspector. -2- "' , SECTION 15.16.040 DWELLING UNIT RECEPTACLE OUTLETS Section 210-52(f) of the National Electrical Code is hereby amended to read as follows: (f) Basements and Garages. For a one -family dwelling, at least one receptacle outlet, in addition to any provided for laundry equipment, shall be installed in each basement and in each garage. See Section 210-8(a)(2). SECTION 15.16.050 LIGHTING OUTLETS REQUIRED Section 210-70(a) of the National Electrical Code is hereby amended by amending the first sentence thereof to read as follows: At least one wall switch controlled lighting outlet shall be installed to every habitable room; in hallways, stairways, garages, and carports; and at outdoor entrances. SECTION 15.16.060 BRANCH CIRCUITS IN DWELLINGS Section 210-70 of the National Electrical Code is hereby amended by adding new paragraph (c) thereto, to read as follows: (c) Carports. At least one lighting outlet shall be required in each carport. Switch -controlled lighting outlets in carports shall be prohibited. SECTION 15.16.070 FEEDER CONDUCTORS Section 215 of the National Electrical Code is hereby amended by adding new subsection 215-10 thereto, to read as follows: 215-10. Feeder Conductors. All feeder conductors to sub -panels shall be installed in an approved raceway. SECTION 15.16.080 WIRING METHODS FOR 600 VOLTS OR LESS Section 230-43 of the National Electrical Code is hereby amended to read as follows: -3- T" _ _.__ 1., Section 230-43. Wiring Methods for 600 Volts, Nominal, or Less. Service -entrance conductors shall be installed in accordance with the applicable requirements of this Code covering the type of wiring method used and limited to the following methods: (1) rigid metal conduit; (2) wireways; (3) busways; (4) auxiliary gutters or (5) rigid nonmetallic conduit. Approved cable tray systems shall be permitted to support cables approved for use as service -entrance conductors. See Article 318. SECTION 15.16.090 MAXIMUM NUMBER OF DISCONNECTS Section 230-71(a) of the National Electrical Code is hereby amended to read as follows: (a) General. Disconnection from service conductors. A single fusible switch or automatic circuit breaker shall be provided to disconnect all ungrounded conductors supplying each separately metered occupancy. SECTION 15.16.100 CONDUCTORS FOR GENERAL WIRING Section 310 of the National Electrical Code is hereby amended by deleting Tables 310-20, 310-20A, 310-21, 310-22, 310-23, 310-24, 310-25, 310-26, 310-27, 310-28, 310-29 and 310-30 therefrom. SECTION 15.16.110 USES PERMITTED OR NOT PERMITTED Section 336-3 of the National Electrical Code is hereby amended to read as follows: 336-3. Uses Permitted or not Permitted. Nonmetallic sheathed cable shall not be used for exposed wiring and shall only be used for concealed wiring in one and two-family dwellings or multi -family dwellings not exceeding three floors above grade. (a) TYPE NM. This type of nonmetallic sheathed cable may be installed for concealed work in normally dry locations. It may be installed or fished in air voids in masonry block or tile walls where such walls are not exposed or subject to excessive moisture or dampness. TYPE NM cable shall not be installed where exposed to corrosive fumes or vapors, nor shall it be embedded in masonry or concrete, nor covered with plaster or similar finish. (b) TYPE NMC. Type NMC cable shall be permitted for concealed work in dry, moist, damp or corrosive locations, and in outside and inside walls of masonry block or tile. -4- (c) Uses not permitted for either TYPE NM or NMC. Types NM and NMC cables shall not be used: (1) in commercial garages, (2) in theaters and similar locations, except as provided in ARTICLE 518, Places of Assembly, (3) in motion picture studios, (4) in storage battery rooms, (5) in hoist -ways, (6) in any hazardous (classified) locations, or (7) embedded in poured cement, concrete or aggregate." SECTION 3. PENALTY It shall be unlawful for any person, firm or corporation to violate any provision or to fail to comply with any of the requirements of this ordinance. Any person, firm or corporation violating any provision of this ordinance or failing to comply with any of its requirements shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding One Thousand Dollars ($1,000.00) or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of which any violation of any of the provisions of this ordinance is committed, continued or permitted by such person, firm or corporation, and shall be punishable therefor as provided for in this ordinance. SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 5. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. -5- SECTION 6. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in said City, and Thirty (30) days from and after its final passage, it shall take effect and be in full force.
