4653FOLLOWS: ORDINANCE NO. 4653 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING VARIOUS SUBSECTIONS AND SECTIONS OF CHAPTERS 18.21, 18.24, 18.25, 18.26 AND 18.27 OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS SECTION 1. That subsection .010 of Section 18.21.061 of Chapter 18.21 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.010 Minimum Lot Area. Each lot or parcel shall have a minimum area of 43,000 square feet exclusive of any public or private street or alley rights-of-way and any public or private easements for ingress and egress; provided that any lot of lesser area which was legally existing and of record, or any division of land approved by the City, on or before the effective date of this subsection or any amendment thereto which would render such lot nonconforming to the provisions thereof shall be deemed to comply with the provisions of this subsection." SECTION 2. That subsection .010 of Section 18.24.061 of Chapter 18.24 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.010 Minimum Lot Area. Each lot or parcel shall have a minimum area of 10,000 square feet exclusive of any public or private street or alley rights-of-way and any public or private easements for ingress and egress; provided that any lot of lesser area which was legally existing and of record, or any division of land approved by the City, on or before the effective date of this subsection or any amendment thereto which would render such lot nonconforming to the provisions thereof shall be deemed to comply with the provisions of this subsection. Where the Planning Commission or City Council determines that the terrain is such that the enforcement of the minimum lot area of 10,000 square feet set forth herein is impractical, said body may approve a division of land containing lots having an area of less than 10,000 square feet provided that the average area of all lots within such division of land shall be not less than 10,000 square feet and no lots therein shall have an area of less than 8,000 square feet. Said minimum lot size shall consist of a contiguous area of land not divided into two (2) or more separate parts by public or private streets or easements of ingress and egress." SECTION 3. That subsection .010 of Section 18.25.061 of Chapter 18.25 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: 11.010 Minimum Lot Area and Density. Each lot or parcel shall have a minimum area of 10,000 square feet exclusive of any public or private street or alley rights-of-way and any public or private easements for ingress and egress; provided that any lot of lesser area which was legally existing and of record, or any division of land approved by the City, on or before the effective date of this subsection or any amendment thereto which would render such lot nonconforming to the provisions thereof shall be deemed to comply with the provisions of this subsection. No person, firm, corporation, association or entity shall hereafter erect, construct or locate more than one (1) single-family dwelling and its accessory buildings upon any one (1) lot, parcel or building site within this zone. The minimum square footage of area required by subsection .012 hereof shall be deemed exclusive of the rights-of-way and easements hereinabove designated." SECTION 4. That subsection .011 of Section 18.25.061 of Chapter 18.25 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, repealed. SECTION 5. That subsection .010 of Section 18.26.061 of Chapter 18.26 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".010 Minimum Lot Area and Density. Each lot or parcel shall have a minimum area of 7,200 square feet exclusive of any public or private street or alley rights-of-way and any public or private easements for ingress and egress; provided that any lot of lesser area which was legally existing and of record, or any division of land approved by the City, on or before the effective date of this subsection or any amendment thereto which would render such lot nonconforming to the provisions thereof shall be deemed to comply with the provisions of this subsection. The minimum square footage of area required by subsections .011 or .012 hereof shall be deemed exclusive of the rights-of-way and easements hereinabove designated. -2- SECTION 6. That subsection .010 of Section 18.27.061 of Chapter 18.27 of Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended to read as follows: ".010 Minimum Building Site and Building Pad Area. The minimum building pad area for each lot or parcel in this zone shall be 5000 square feet. The term "building pad area" as used herein shall mean the level buildable area of the lot or parcel including any required setbacks, but excluding (i) any material or manufactured slopes and (ii) any public or private street or alley rights-of-way and any public or private easements for ingress and egress; provided that any lot of lesser area which was legally existing and of record, or any division of land approved by the City, on or before the effective date of this subsection or any amendment thereto which would render such lot nonconforming to the provisions thereof shall be deemed to comply with the provisions of this subsection." SECTION 7. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal hereby of any other ordinance of this City shall in any manner affect the prosecution for violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provisions of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. SECTION 8. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination herefrom of any such portion as may be declared invalid. SECTION 9. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force. -3- THE FOREGOING ORDINANCE is approved and adopted by the City Council of the City of Anaheim this lst day of October, 1985.
