4654ORDINANCE NO. 4654 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING THE ZONING MAP REFERRED TO IN TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES FIND THAT: WHEREAS, the Planning Commission did adopt its Resolution No. PC85-35 determining that a change or changes in the zone or zones hereinafter mentioned and described should be made as hereinafter set forth after a duly noticed hearing; and WHEREAS, certain conditions and requirements were made as conditions precedent to the making of a change or changes of said zone or zones, which conditions have been complied with. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the Zoning Map referred to in Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by rezoning and reclassifying that certain property situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: THAT PORTION OF LOT 4 OF ANAHEIM EXTENSION, AS SHOWN ON A MAP OF SURVEY BY WILLIAM HAMEL, A COPY OF WHICH IS SHOWN IN BOOK 3, PAGES 162 TO 164, INCLUSIVE, OF LOS ANGELS COUNTY MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF ORANGE COUNTY, CALIFORNIA, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT OF INTERSECTION OF THE EASTERLY LINE OF EAST STREET, 66.00 FEET WIDE, WITH A LINE THAT IS PARALLEL WITH AND DISTANT NORTHERLY 480.00 FEET FROM THE CENTER LINE OF CENTER STREET, AS SAID CENTER LINE IS SHOWN ON A MAP FILED IN BOOK 28, PAGE 22 OF RECORD OF SURVEYS; THENCE NORTH 74° 37' 25" EAST PARALLEL WITH SAID CENTER LINE OF CENTER STREET 150.00 FEET; THENCE SOUTH 150 24' 15" EAST PARALLEL WITH SAID EASTERLY LINE OF EAST STREET 305.00 FEET TO A POINT IN A LINE THAT IS PARALLEL WITH THE DISTANT NORTHERLY 175.00 FEET FROM SAID CENTER LINE OF CENTER STREET; THENCE SOUTH 74° 37' 25" WEST PARALLEL WITH SAID CENTER LINE 150.00 FEET TO A POINT IN SAID EASTERLY LINE OF EAST STREET; THENCE NORTH 150 24' 15" WEST ALONG SAID EASTERLY LINE OF EAST STREET 305.00 FEET TO THE POINT OF BEGINNING, into the "RM -1200" RESIDENTIAL, MULTIPLE -FAMILY ZONE, subject to the following conditions: -1- 84-85-24 1. That all engineering requirements of the City of Anaheim along East Street, including preparation of improvement plans and installation of all improvements such as curbs and gutters, sidewalks, street grading and pavement, water, sewer and drainage facilities, or other appurtenant work including relocation of existing curb, gutter, sidewalk and pavement to ultimate width on the southerly parcel shall be complied with as required by the City Engineer and in accordance with specifications on file in the Office of the City Engineer; and that security in the form of a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of said improvements. Said security shall be posted with the City prior to issuance of building permits to guarantee installation of the above -required improvements prior to occupancy. 2. That prior to issuance of a building permit, appropriate park and recreation in -lieu fees shall be paid to the City of Anaheim in an amount as determined by the City Council. 3. That prior to issuance of a building permit, the appropriate traffic signal assessment fee shall be paid to the City of Anaheim in an amount as determined by the City Council for each new dwelling unit. 4. That the driveway shall be designed to accommodate ten (10) foot radius curb returns as required by the City Traffic Engineer. 5. That drainage of subject property shall be disposed of in a manner satisfactory to the City Engineer. 6. That subject property shall be served by underground utilities. 7. That prior to commencement of structural framing, fire hydrants shall be installed and charged as required and determined to be necessary by the Chief of the Fire Department. 8. That trash storage areas shall be provided and maintained in accordance with approved plans on file with the Street Maintenance and Sanitation Division. 9. That street lighting facilities along the northerly 205 feet adjacent to East Street shall be installed as required by the Utilities General Manager in accordance with specifications on file in the Office of Utilities General Manager, and that security in the form of a bond, certificate of deposit, letter of credit, or cash, in an amount and form satisfactory to the City of Anaheim, shall be posted with the City to guarantee the satisfactory completion of the above-mentioned improvements. Said security shall be posted with the City of Anaheim prior to approval of improvement plans. The above -required improvements shall be installed prior to occupancy. -2- 10. That prior to issuance of a building permit, primary water main fees shall be paid to the City of Anaheim, in an amount as determined by the Office of the Utilities General Manager. 11. That gates shall not be installed across any driveway in a manner which may adversely affect vehicular traffic in the adjacent public street. Installation of any gates within a distance of forty (40) feet from said public street right-of-way shall be subject to the review and approval of the City Traffic Engineer. 12. That the proposed parking structure design shall conform to Engineering Standard Plan No. 402 pertaining to standard details for parking structures and ramp requirements. 13. That the basement level containing the covered parking structure shall be located more than of 50% below natural grade level as measured from the exterior walls of the building. 14. That fire sprinklers shall be installed as required by the City Fire Marshal. 15. That prior to final street inspections, "No parking for street sweeping" signs shall be installed as required by the Street Maintenance and Sanitation Division and in accordance with specifications on file with said division. 16. That all air conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent properties. 17. That prior to issuance of building permits, the applicant shall present evidence satisfactory to the Chief Building Inspector that the proposed project is in conformance with Council Policy Number 542 "Sound Attenuation in Residential Projects" and with noise insulation standards specified in the California Administrative Code, Title 25. 18. That a 6 -foot high masonry block wall shall be constructed and maintained along the north, east and south property lines. 19. That prior to issuance of a building permit, or within a period of one year from the date of this resolution, whichever occurs first, Condition Nos. 1, 2, 3, 9, 10, 12 and 17, above-mentioned, shall be complied with. Extensions for further time to complete said conditions may be granted in accordance with Section 18.03.090 of the Anaheim Municipal Code. 20. That prior to final building and zoning inspections, Condition Nos. 4, 5, 6, 8, 11, 13, 14, 16, 18, above-mentioned, shall be complied with. -3- SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and the property above-described shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the City Engineer is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in said City, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
