A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING A WAIVER AND A CONDITION
OF APPROVAL OF VARIANCE NO. 3585 AS SET FORTH
IN RESOLUTION NO. 86R-469, NUNC PRO TUNC.
WHEREAS, the City Council heretofore adopted its Resolution
No. 86R-469 granting Variance No. 3585 on October 14, 1986; and
WHEREAS, said resolution contained two waivers of sections
of the Anaheim Municipal Code and twenty express conditions upon
which said variance was granted; and
WHEREAS, one section waiver and one provision of Condition
No. 14 contained a numerical error.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that Variance No. 3585 as set forth in Resolution
No. 86R-469 be, and the same is hereby, amended by amending and
restating, nunc pro tunc, the waiver concerning maximum structural
height as set forth herein to read as follows:
"SECTION 18.34.062.012
Maximum structural height.
(One story permitted within
150 feet of single-family
zoning; One story over
basement garage within 23
feet of single-family zoning
and two stories over
basement garage at 103 feet
proposed)"
BE IT FURTHER RESOLVED that provision (b) of Condition No.
14 be, and the same is hereby, amended by amending and restating,
nunc pro tunc, as set forth herein to read as follows:
"(b) That ail apartments located within one
hundred three (103) feet of the north property line shall
be single-story above a basement parking garage which is
located entirely in the ground; provided, however, that
the four (4) apartments located above the ramp (and the
parking spaces thereon) descending into the garage from
the entrance on Western Avenue will be approximately one
and one-half story above the ground."
BE IT FURTHER RESOLVED that, except as expressly set forth
herein, Resolution No. 86R-469 shall remain in full force and effect.
THE FOREGOING RESOLUTION is approved and~adopted by the
City Council of the City of Anaheim th~d~y~ 1987.
