87-324RESOLUTION NO. 87R- 324 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND DISTRIBUTION OF WATER AS ADOPTED BY RESOLUTION NO. 72R-600 AND AMENDED BY RESOLUTION NOS. 73R-255, 73R-387, 73R-532, 74R-433, 75R-315, 75R-469, 75R-479, 76R-378, 78R-418, 78R-419, 78R-459, 79R-643, 80R-304, 81R-124, 81R-402, 82R-355, 83R-331, 84R-246, 86R-118, and 87R-188. WHEREAS, the City of Anaheim maintains a water distribution system for the furnishing of water to residents and inhabitants of the City of Anaheim and has adopted Water Rates, Rules and Regulations for the sale and distribution of water; and WHEREAS, it is the policy of the City Council that Anaheim's Water Utility shall be self-supporting from charges made by the City for water furnished to consumers and for services rendered in connection therewith; and WHEREAS, the Public Utilities Board held a public hearing on July 23, 1987 and evidence was presented in connection with the proposed revisions of water rates and fees; and WHEREAS, the Public Utilities Board considered the California Environmental Quality Act and made the following findings: The largest single expenditure category during the test period of July 1, 1986 through June 30, 1988 is water supply at an estimated $7,635,000. 2. Other operating expenses and capital expenditures estimated to cost $9,529,000 are due to labor and material costs. Debt service requirements and an increase in reserve amounts estimated to cost $2,524,000 are required to meet financial reserves and requirements. 4J The transfer to the general fund in an amount estimated to be $766,000 is authorized by the City Charter and constitutes an Intra-City transfer. 5. The increase in working capital of $62,000 is required to meet the Utility's cash requirements. The fee increases for temporary service, service connections, meter installations, inspection services, plan check services, and primary distribution main extensions are due to labor cost increases and higher material costs. The matters covered in 1 through 6 above come within Section 21080 (b) (8) of the Public Resources Code of the State of California thus the establishment of these rates are exempt from the California Environmental Quality Act. 1362b072287 3.10.5 WHEREAS, a Notice of Hearing was published as follows: On July 9, 1987, notice of the public hearing on water rates was published in the Anaheim Bulletin and proof thereof is on file with the Secretary of the Public Utilities Board. 20 On July 9, 1987, notice of the public hearing on water rates was- published in the Santa Ana Register and proof thereof is on file with the Secretary of the Public Utilities Board. 0 On July 9, 1987, notice of public hearing on water rates was published in the Orange County Edition of the Los Angeles Times and proof thereof is on file with the Secretary of the. Public Utilities Board. WHEREAS, the Public Utilities Board has considered the proposal of the Public Utilities Department and has considered the evidence presented at the public hearing; and WHEREAS, the Public Utilities Board has made the following findings with respect to the need for an increase in the water rates and fees: The Water System revenue requirement of the Anaheim Public Utilities Department will be established, as set forth below, on the basis of projections for a Test Period consisting of the twelve months July 1, 1987 through June 30, 1988. 2. A reasonable estimate of the revenue requirement for water supply costs for the test period is $7,635,000 as shown in Exhibit MAB-1. 3. A reasonable estimate of the revenue requirement for other operating expenses for the test period is $6,362,000 as shown in Exhibit MAB-1. 4. A reasonable estimate of the revenue requirement for capital expenditures funded from rates for the test period is $3,167,000. 5. A reasonable estimate of the revenue requirement for debt service and reserve increases for the test period is $2,524,000. 6. A reasonable estimate of the revenue requirement for transfer to the General Fund for the test period is $766,000 as shown in Exhibit MAB-1. A reasonable estimate of the revenue requirement for an increase in working capital for the test period is $62,000 as shown in Exhibit MAB-1. A reasonable estimate of the revenue requirement offsets due to other water revenues and interest income for the test period is $468,000 as shown in Exhibit MAB-1. 1362b072287 90 10. 11. The customer class revenue requirements as determined on the basis of an annualized cost-of-service analysis are shown in Exhibit BGT-1 and are appropriate. The estimated total allocated annualized revenue requirement of $20,288,000 as set forth below is appropriate. 12. It is appropriate to continue to fund a Water Capital Replacement Fund with revenues from the sale of water. 15. It is appropriate to continue to gradually increase the portion of the Water Capital Replacement Fund which is funded by revenues from the sale of water. 16. A reasonable estimate for installing service laterals and meter boxes is shown in Exhibit DXV-4. 17. A reasonable estimate for installing meters is shown in Exhibit DXV-4. 18. A reasonable estimate of acreage fees is shown in Exhibit DXV-4. 19. A reasonable estimate for charges for Assignment of Rights for Contracts is shown in Exhibit DXV-5. WHEREAS, based on the findings hereinabove made, the Pu lic Utilities Board of the City of Anaheim recommends to the City Council that the Council adopt the findings of the Public Utilities Board with respect to the matters contained herein and adopt the water rates and fees shown in E~hibit BGT-6 and Exhibits DXV-4 and 5. WHEREAS, the City Council has considered the evidence and concurs with the findings of the Public Utilities Board as set forth hereinabove. NOW, THEREFORE BE IT RESOLVED that the findings of the Public Utilities Board be, and they are hereby, adopted by the City Council of the City of Anaheim. 1362b072287 3.10.5 NOW, THEREFORE BE IT FURTHER RESOLVED that based on the findings hereinabove made and adopted, the budget for fiscal year 1987-88 should be modified as follows: Control Center 82, Fund 51, Utilities Debt Service - From $2,268,078 to $2,142,011 as shown: FA Fees Object 06605 from $24,000 to $44,000 New Bond Interest Object 06842 from $350,000 to #233,333. New Bond Principle Object 06847 from $30,000 to $0. BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that the Water Rates, Rules and Regulations adopted by City Council Resolution No. 72R-600 and amended by City Council Resolution Nos. 73R-255, 73R-387, 73R-532, 74R-433, 75R-315, 75R-469, 75R-479, 76R-378, 78R-418, 78R-419, 78R-459, 79R-643, 80R-304, 81R-124, 81R-402, 82R-355, 83R-331, 84R-246, 86R-118 and 87R-188 be amended as follows, to wit: BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that the amended Water Rates, Rules and Regulations be made effective for service rendered on and after August 5, 1987. Primary Distribution Mains Primary Distribution Mains which supply water to all areas of the system shall be paid for by acreage fees assessed on all properties in the system except those properties excluded in (1) above. The fees will be based upon gross acreage served by domestic water service and/or fire protection, and will be due prior to signature approval of the final water improvement plans by the Water Engineering Manager. This does not apply to application for temporary or irrigation service. The water main extension fees shall be $2,225.00 per acre. The above fees will be calculated to the nearest one hundredth (.01) acre. Public-owned facilities such as freeways, flood control channels, and water spreading basins may not be required to pay the water main extension fees if water service for these properties is not required. If a portion of these facilities require water service, the water main extension fees shall be paid on that portion requiring service. When a Primary Distribution main must be extended to a new subdivision or development, the Utility will extend the main up to five hundred (500) feet. If an extension greater than 500 feet is required, the developer will pay for the extension that is in excess of 500 feet, in addition to the normal water main extension fees. The developer's portion of the cost shall be reimbursed to him without interest as acreage fees are collected from others connecting to the extended main within a refund area designated by the Utility at the time the advance is made. In unusual circumstances, the applicant for water service who requires Primary Distribution Mains may be permitted, if qualified in the judgment of the Utility, to construct and install the mains himself, or arrange for their installation pursuant to competitive bidding procedures initiated by him, and limited to contractors who possess a current California Contractor's License permitting them to do this type of construction work. The cost, including the cost of inspection and supervision by the Utility, shall be paid directly by the applicant. The applicant shall provide the Utility with a statement of actual construction cost in reasonable detail. The installation shall be in accordance with the plans and specifications prepared by the Utility. If, in the opinion of the General Manager, additional funds are required to construct terminal storage and transmission main facilities in excess of the terminal storage and transmission main fees, the applicant shall enter into an agreement with the City which provides for the advance of additional funds to construct the required facilities. The agreement shall provide for the reimbursement of funds in excess of the terminal storage and transmission main fees which are in effect at the time the agreement is entered into. In the event the advance consists only of the terminal storage and transmission main acreage fees, the fees shall be paid prior to recordation of the final tract map. Acreage fees shall be required on tracts in their entirety. Payment of acreage fees for portions of a tract shall not be accepted. c. Primary mains in the East Santa Ana Canyon Area shall be treated in the manner set forth in Rule No. 15-A. de Revision of Advances Due - The Water Utility shall revise the East Santa Ana Canyon Area Documents periodically to reflect acreage adjustment, actual cost of facilities in place, current cost estimates and such other costs which may be directly related to the Santa Ana Canyon Area. Where Applicant is required to advance funds for construction of Transmission and Terminal Storage Facilities within the East Santa Ana Canyon Area in excess of the prevailing Transmission and Terminal Storage Fees, pursuant to Rule 15-C-3, said excess advances shall be subject to reimbursement by the following method. Thereafter, reimbursements shall be made as transmission acreage fees are collected from subsequent Applicants. (2) Reimbursements shall be made for funds advanced as adjusted by any change in the Engineering News Record (ENR) construction cost indexes. The initial adjustment shall reflect the period of time from the date in which the notice of completion for those Transmission Facilities constructed, until the date of the reimbursement to the nearest month. The ENR construction cost indexes will be adjusted annually by the Water Utility on the unrefunded portion due Applicants. The proportional amount of reimbursement shall be deter- mined by multiplying the gross amount available for reimbursement times a weighted factor for each eligible Applicant. The numerator of this factor is the product of the Applicant's original Advance, multiplied by the number of years since the date of record of the Appli- cant's Advance. The denominator of this factor is the sum of the numerators for all Applicants eligible for reimbursements. The number of years shall be calculated to the nearest month. b. Terminal Storage Facilities Should the General Manager, Public Utilities Department, determine that it would be in the best interests of the East Santa Ana Canyon Area to construct a portion of the required terminal storage facilities, the cost of which exceeds the Applicants fees due and monies paid by previous applicants together with interest, Rule 15-C-4 shall prevail. For all services, other than those where the developer is installing the main, the Utility shall furnish and install the service connection and meter box, after applications is made and all applicable fees are paid. 2. In new subdivisions, and in other cases where the developer installs the mains, the developer shall furnish and install the service connection and meter box, and the Utility shall furnish and install the meter. 3. The service connection, meter, and meter box will generally be installed at a convenient location between the curb or edge of pavement and the property line. If it is considered impractical to install the facilities in this location, they may be installed upon the customer's premises, in which case a casement will be required. B. SERVICE CONNECTION AND WATER METER INSTALLATION CHARGES For service connections and water meter installations under (3) and (4) below, all materials shall be furnished and installed by the Water Division. Fees: A fee of $450.00 per application, plus $50.00 for each additional service connection, when processed as part of a single application shall be required to cover the cost of plan check and inspection.
