A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AN AMENDMENT TO CERTAIN
CONDITIONS OF APPROVAL IN CONDITIONAL USE
PERMIT NO. 2770.
WHEREAS, the City Planning Commission of the City of
Anaheim heretofore adopted Resolution No. PC86-66 approving
Conditional Use Permit No. 2770, subject to certain conditions
specified therein; and
WHEREAS, the permittee subsequently requested an
amendment to certain of said conditions of approval; and
WHEREAS, the City Planning Commission held a duly noticed
public hearing at which hearing the City Planning Commission did
receive and consider evidence, both oral and documentary, relating
to said request and after due inspection and after consideration
of all evidence and reports offered at said hearing did adopt its
Resolution No. PC87-126 amending certain conditions of approval
set forth in Resolution No. PC86-66; and
WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action at a duly noticed
public hearing; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hearing
and did give ail persons interested therein an opportunity to be
heard and did receive evidence and reports; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval in the manner
hereinafter set forth is reasonably necessary to protect the
public peace, health, safety or general welfare, or necessary to
permit reasonable operation under said conditional use permit.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in Conditional Use Permit No. 2770 be, and the same are hereby,
amended by deleting Condition No. 8 and amending and renumbering
Condition No. 9 to Condition No. 8 to read as follows:
"8. That prior to the commencement of the
activity authorized under this resolution, or final
building and zoning inspections whichever occurs
first, Condition Nos. 1, 2, 3, 5 and 7,
above-mentioned, shall be complied with."
BE IT FURTHER RESOLVED that Resolution No. PC86-66 be
further amended by renumbering Condition No. 10 as Condition No. 9.
BE IT FURTHER RESOLVED that, except as expressly amended
herein, Resolution No. PC86-66 shall remain in full force and
effect.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 18th day of August, 1987.
