03/24/2020 ANAHEIM CITY COUNCIL REGULAR AND REGULAR ADJOURNED MEETING OF MARCH 24, 2020 The regular meeting of March 24, 2020 was called to order at 3:00 P.M. and adjourned for lack of a quorum. The regular adjourned meeting of March 24, 2020 was called to order at 5:05 P.M. telephonically, pursuant to Governor Newsom's Executive Order N-29-20 (superseding the Brown Act related provisions of Executive Order N-25-20) in response to COVID-19. The meeting notice, agenda, and related materials were duly posted on March 20, 2020. PRESENT: Mayor Harry Sidhu and Council Members Stephen Faessel, Denise Barnes, Jordan Brandman, Jose F. Moreno, Lucille Kring, and Trevor O'Neil (all via teleconference). STAFF PRESENT: City Manager Chris Zapata, City Attorney Robert Fabela, and City Clerk Theresa Bass Mayor Sidhu reminded the public the meeting was being held remotely due to the COVID-19 crisis. Additionally, he reminded the public that staff was advised to remove all non-essential items from the City Council agenda. INVOCATION: Mayor Pro Tern Stephen Faessel FLAG SALUTE: Council Member Lucille Kring Acceptance of Other Recognitions (To be presented at a later date): Recognizing March 31, 2020, as Cesar Chavez Day Recognizing April 2020, as Arab American Heritage Month Recognizing April 2020, as Esophageal Cancer Awareness Month City Clerk Theresa Bass advised a proclamation would be mailed to each recipient. At 5:12 P.M., Mayor Sidhu called to order the Anaheim Housing Authority (in joint session with the City Council). ADDITIONS/DELETIONS TO THE AGENDAS: None PUBLIC COMMENTS: Mayor Sidhu reported comments were submitted electronically for City Council consideration, distributed to the City Council, and made part of the official public record of the meeting. Fifty public comments were received electronically related to City Council agenda items and matters within the jurisdiction of the Anaheim City Council (and related governing bodies). —See Appendix. City Council Minutes of March 24, 2020 Page 2 of 13 CITY MANAGER'S UPDATE: City Manager Chris Zapata announced the City was recently awarded $1,385,224.15 by Governor Newsom and the California Homeless Coordinating and Financing Council related to Senate Bill 89 for COVID-related expenses and programs that may impact the homeless community. At 5:13 P.M., Mayor Sidhu recessed the Anaheim City Council to address the Housing Authority agenda, reconvening at 5:40 P.M. CONSENT CALENDAR: At 5:40 P.M., the consent calendar was considered. MOTION: Council Member Kring moved to waive reading of all ordinance and resolutions and adopt the consent calendar as presented, in accordance with reports, certifications, and recommendations furnished each city council member and as listed on the consent calendar, seconded by Mayor Pro Tern Faessel. ROLL CALL VOTE: AYES —7 (Mayor Sidhu and Council Members Faessel, Barnes, Brandman, Moreno, Kring, and O'Neil); NOES —0. Motion carried. AGR- 4. Award the construction contract to the lowest responsible bidder, Horizons Construction 11990 Company International, Inc., in the amount of$665,399.97, for the Concrete Removal — Reconstruction Project at various locations; authorize the Director of Public Works to execute the contract and related documents and to take the necessary actions to implement and administer the contract; determine the project is categorically exempt under the California Environmental Quality Act pursuant to Sections 15301, Class 1, and 15302, Class 2, of Title 14 of the California Code of Regulations; and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions (Arterial Sidewalk Project/Concrete Replacement Citywide). 5. Award the construction contract to the lowest responsible bidder, RenewAge Energy AGR- Solutions, in the amount of$729,331.07, for the Julianna Park Improvements Project; 11991 authorize the Director of Public Works to execute the contract and related documents and to take the necessary actions to implement and administer the contract; determine that the project is categorically exempt from the California Environmental Quality Act pursuant to Section 15303 of Title 14 of the California Code of Regulations; and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions. AGR- 6. Award the construction contract to the lowest responsible bidder, E.E. Electric Inc., in the 11992 amount of$9,502,293.00 plus a 10% contingency, for the Underground District No. 65 Phase I Royal Oak, Crescent and Cerro Vista Electric Reliability Improvement, and Direct Buried Cable Replacement Project; authorize the Director of Public Works to execute the contract and related documents and to take the necessary actions to implement and administer the contract; determine the project is categorically exempt under the California Environmental Quality Act pursuant to Sections 15302(d), 15303(d), and 15303(e) of Title 14 of the California Code of Regulations; and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions. AG R- 11993 7. Approve a cooperative agreement with the Cities of Fullerton (as lead agency), La Palma, Buena Park, Placentia, Yorba Linda, and the County of Orange, in the cost match amount of $100,140, to implement traffic signal synchronization on Orangethorpe Avenue from the intersection of Walker Street in La Palma to New River Road in Yorba Linda. Approve the engineering services agreement with Consensus Systems Technologies 11994 Corporation, in an amount not to exceed $712,108.35, to test the National Transportation Communications Intelligent Transportation Systems Protocol (NTCIP) 1202 Standard; authorize the Director of Public Works to execute the agreement and take necessary actions to administer the agreement; and authorize de minimus changes that do not substantially change the term and conditions of the agreement, as long as such changes are determined to be de minim us by the City Attorney. 9. RESOLUTION NO. 2020-031 A RESOLUTION OF THE CITY COUNCIL OF THE P110 CITY OF ANAHEIM vacating a public utility easement located at 1616 South Euclid Street pursuant to California Streets and Highways Code Section 8330, et seq. - Summary Vacation (ABA2019- 00387). 10. RESOLUTION NO. 2020-032 A RESOLUTION OF THE CITY COUNCIL OF THE P124 CITY OF ANAHEIM accepting certain deeds conveying to the City of Anaheim certain interests in real property (City Deed Nos. 12346, 12347, 12348, 12349, 12350, 12351, 12352, 12353, 12354, 12355, 12356, 12357, & 12358; in connection with the provision of utility services). END OF CONSENT CALENDAR: 11. Update on the City's response to COVID-19 D116 Mayor Sidhu introduced the item and thanked Anaheim residents, local businesses, major sports teams, and City employees for their hard work and generous donations in response to the COVID-19 crisis. He thanked essential workers for continuing to work during the crisis. City Manager Chris Zapata provided best wishes for all the families whose health and lives were currently impacted by this virus. He thanked the Anaheim team and partners that are working together to help the entire community. Mr. Zapata recapped the emergency meeting of the City Council when they approved a resolution proclaiming the existence of a local emergency that provides Anaheim access to state and federal funding as well as authorizing additional spending authority for the City Manager. He reported Anaheim is emphasizing teamwork and communication. Fire Chief Pat Russell provided a brief overview of operations from the Emergency Operations Center (EOC). He thanked City staff, department heads, and EOC staff who are working tirelessly to put plans together, develop contingency plans, and continuity of operations. Chief Russell reported the Emergency Preparedness Section had previously completed a pandemic Continuity of Operations Plan which served as a starting point for the EOC and has been changed and expanded upon as necessary for this incident. He reported the EOC is currently in the mitigation phase and moving towards recovery as efficiently and as quickly as possible. He noted the priorities for the incident are life safety for City employees and citizens, to assist citizens to help them maintain continuity of life, and to assist other departments meet the needs of the City. Chief Russell reported the EOC opened on March 17 at Level 3, was escalated to Level 2 on with additional staffing March 18, and is ready to move to Level 1 if needed. He reported the EOC is City Council Minutes of March 24, 2020 Page 4 of 13 currently working to ensure long-term supplies for first responders and citizen employees, coordinating donations with help from the business community, coordinating planning for temporary homeless facilities, and coordinating with impacted businesses and employees for state and federal resources. Chief Russell reported Second Harvest Food Bank recently conducted a food distribution at the Honda Center and were quickly overwhelmed by the number of people seeking food. He reported the Anaheim Police Department helped keep the food distribution going by quickly developing an effective traffic plan to finish the operation for the day. He noted the EOC has coordinated with Second Harvest to provide volunteers and city employees, along with the traffic plan, to assist and distribute food to approximately 10,000 Anaheim residents on Saturday. Chief Russell reported on field operations and advised Metro Net screens calls, identifies patients with potential flu-like symptoms, and passes the information to on-site first responders. He reported first responders use the proper Personal Protective Equipment (PPE) when needed and minimizes contact whenever possible. He reported paramedics, firefighters, and other personnel are receiving twice-daily temperature checks and noted regular heightened cleaning at each station by a cleaning crew. He advised 15 personnel self-isolated due to potential exposure risk but only two remain self- isolated as of today, and there are no confirmed cases of COVID-19. Chief Russell reported Anaheim Fire & Rescue is working at normal staffing and continues to respond to calls with several contingency plans in the event staffing is stretched thin. He noted the Department Operations Center (DOC) continues to work to ensure continuity of personnel and response readiness. He advised there is sufficient PPE to handle the current call volume but the City is facing re-supply issues; however, the EOC is aggressively working on acquiring supplies. Lastly, he reported skilled nursing facilities are being surveyed to ensure they have appropriate PPE and a coordination plan with Orange County Health Care and Anaheim Fire and Rescue to supplement their needs as needed. Chief Communications Officer Mike Lyster provided a brief overview of the City's COVID-19 response. He reported schools, community centers, senior centers, libraries, theme parks, the Anaheim Convention Center, sports venues, golf courses, and sections of Anaheim parks have closed. He noted City Hall is temporarily closed to the public but the City continues to serve residents and businesses. He noted critical operations such as Police, Fire, Water, Power, Public Works, Code Enforcement, and Park Rangers are continuing to operate. Mr. Lyster reported the Anaheim Police Department (APD) continues to keep the City safe and activated its DOC on March 13 to provide personnel and support to the City's EOC with local, state, and federal updates. He noted APD is educating residents and businesses on California's "Stay At Home" order and encouraging everyone to do their part. He noted businesses not complying with California's order are being handled by Code Enforcement and businesses are being educated on price gouging. Lastly, he reported APD's Traffic Bureau is managing large food distribution events and readying to manage potential testing sites should they be needed in Anaheim. Mr. Lyster reported Community Services continues to assist with more than 600 weekly meals from Meals on Wheels OC, which are being provided to seniors at Brookhurst Community Center and Downtown Anaheim Community Center. He noted 35 additional food sites have been identified for seniors, youth, or anyone in need and can be found at Anaheim.net/coronavirus. He reported Community Services is conducting weekly welfare check calls to more than 1,500 seniors in Anaheim. City Council Minutes of March 24, 2020 Page 5 of 13 Mr. Lyster acknowledged that playgrounds, skate parks, and picnic areas were closed but advised green spaces and walking areas remain open and encouraged residents to use these spaces responsibly, practice social distancing, and use the best health etiquette. He advised park bathrooms are open with increased cleaning and disinfection. He reported the Anaheim Library is doing live story times for kids and families on social media with branches offering curbside pickup of books and DVDs and offering other services online. He reported the Haskett Library in west Anaheim is working with Grandma's House of Hope to hand out food to neighborhood families. Mr. Lyster advised homeless outreach continues daily with hopes of getting people off the streets during this critical time. He reported there are some beds available at Anaheim shelters, but staff is working with nonprofit and faith partners to also help get people out of the streets when beds are not available, He advised Anaheim is tracking statewide efforts to provide funding and temporary shelter for those living in homelessness. Mr. Lyster reported both Anaheim shelters continue to uphold their preventive measures, have quarantine plans in place should they need them, and are working with Anaheim Fire and Rescue's Emergency Medical Service Division on plans and supplies. He reported the Armories in Fullerton and Santa Ana are returning to National Guard use as they ready for food distribution and other community support missions. He reported Anaheim has access to Fullerton's new temporary facility. Mr. Lyster reported Planning and Building continues to provide plan checks, inspections, entitlements, code enforcement, and business licensing, as construction and housing is considered an essential service, with the majority of services are being done by phone, email, and online. He reported Building and Code Enforcement inspections are being done by FaceTime and Skype and noted 20% of building inspections completed Monday were completed virtually. Mr. Lyster reported Public Works continues to maintain streets, sidewalks, drainage, and critical paving and repair projects. He advised trash and recycling service by Republic Services continues as normal and the City is helping to temporarily stop service for closed businesses as needed. He advised Public Works is offering online service for plan checks, plan submittals, and permits. Mr. Lyster reported the City stopped issuing parking citations for street sweeping and permit parking due to school closures but continues to cite for public safety. He encouraged residents to park responsibly and to be respectful of one another. Lastly, he noted Planning has granted an automatic 60-day extension on plan checks, building permits that had been issued, business license renewals, and Code cases that are not an immediate public safety threat. Mr. Lyster reported Anaheim Public Utilities (APU) stopped disconnection of electricity and water for homes and small businesses seeing financial hardship on March 13. He noted APU is helping customers with emergency assistance, income-qualified discounts, payment plans, and medical allowances. Mr. Lyster reported Anaheim Communications continues to share real-time information in English and Spanish during all waking hours and on weekends. He advised Anaheim.net/coronavirus, the central hub for Anaheim to obtain information, has been visited more than 150,000 times. He reported 150 social media posts have been completed and were seen by more than 1,300,000 people. He reported Anaheim's 311 Call Center has been taking 20-50 calls per day on the crisis. City Council Minutes of March 24, 2020 Page 6 of 13 Mr. Lyster reported Anaheim is working with the Emergency Medical Service Division of Anaheim Fire & Rescue who is Anaheim's contact for hospitals, other health care providers, and skilled nursing homes. He reported Community Services is working with nonprofits and places of worship. He advised the EOC and the City Manager's Office are working with Anaheim's business community. Mr. Lyster reported Anaheim received 1,500 surgical facemasks for first responders donated by BYD, the maker of vehicles for Anaheim Resort Transportation. He reported the Anaheim Community Foundation is also now accepting donations to support food supplies and other critical services through the EOC and can be accessed at http://www.anaheimcf.orq. Mr. Lyster thanked all City departments for their hard work. DISCUSSION: Council Member Moreno thanked staff for their communications efforts. In response to Council Member Moreno's inquiry regarding language diversity and community concerns related to government, Mr. Lyster advised he has enlisted the help of Communication Specialists Lauren Gold and Mayra Vega to replicate all communications in Spanish on Anaheim.net/coronavirus. He reported they reached out to the Spanish speaking community in Anaheim to suppress any fears and to advise that Immigration and Customs Enforcement (ICE) has developed an updated policy that shifts their focus to high-level public safety enforcement and will not do any enforcement in places of worship and healthcare facilities. Lastly, he advised Anaheim continues to reach out to non-English speaking communities in Anaheim through partners such as Access California and places of worship. In response to Council Member Moreno's inquiry regarding timeliness and accuracy of information, Mr. Lyster clarified Anaheim.net/coronavirus is updated many times per day and highlighted links on the page useful for Anaheim residents and reported the page will be updated as soon as information becomes available, including ways to report non-compliant businesses and instances of price gouging. He also noted he briefs the 311 staff daily and they follow Anaheim.net/coronavirus for information. Lastly, he cited https://www.anaheim.net/2128/Anaheim-Anytime is another great resource. Council Member Moreno requested staff track the types of services sought to better allocate future efforts. In response to Council Member Moreno's inquiry, Mr. Zapata advised a telecommuting policy was developed and distributed to City staff with 460 of the City's workforce telecommuting. He reports staff is exploring ways to continue telecommuting or complete other duties as assigned to keep staff working and staff would be coming to City Council soon with recommendations. Council Member Moreno reported he has heard reports other cities and industries are asking their staff to use their vacation, sick leave, or parental leave. He encouraged staff to develop a policy that avoids staff using their leave banks during the State of Emergency. D116 12. ORDINANCE NO. 6482 AN UNCODIFIED (URGENCY) ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM imposing a temporary moratorium on the eviction of residential or commercial tenants unable to pay rent because of COVID-19, declaring the ordinance to be an emergency measure to take effect immediately upon adoption, and providing direction to the City Manager regarding other possible assistance to Anaheim residents and businesses. Mayor Sidhu introduced the item by reporting many landlords in Anaheim have voluntarily imposed an eviction moratorium and the California Apartment Association and Orange County Apartment Association have urged their members to do the same. He expressed his support for adopting an City Council Minutes of March 24,2020 Page 7 of 13 eviction moratorium for residents and small businesses and believed the ordinance will prevent any further disruption and harm to Anaheim. MOTION: Mayor Sidhu moved to approve ORDINANCE NO. 6482 AN UNCODIFIED (URGENCY) ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM imposing a temporary moratorium on the eviction of residential or commercial tenants unable to pay rent because of COVID-19, declaring the ordinance to be an emergency measure to take effect immediately upon adoption, and providing direction to the City Manager regarding other possible assistance to Anaheim residents and businesses, as amended, to change the payback period in Section 5 from 90-days to 120-days to be repaid in four(4) equal installments, to ensure non-profits are included within the definition of commercial tenants, and to include sub-letters within the provisions of the ordinance, seconded by Council Member Kring. Deputy City Manager Greg Garcia reported the item is the consideration of an uncodified Urgency Ordinance imposing a temporary moratorium on the eviction of residential or commercial tenants unable to pay rent because of COVID-19. He advised the action would declare the ordinance an emergency measure to take effect immediately upon adoption and provides further direction to the City Manager regarding other possible assistance to residents and businesses. Mr. Garcia reported Anaheim schools have closed and residents have been advised to avoid public gatherings and stay home to prevent the spread of this disease by the directives of federal, state, and local health officials. He reported many Anaheim businesses have temporarily closed or have suspended operations, which is resulting in workers experiencing loss of wages due to business closures, loss of working hours, layoffs, or out of pocket medical costs caused by COVID-19 and will impact both residential and commercial tenants' ability to pay rent. Mr. Garcia advised the proposed ordinance would prohibit a landlord from initiating proceedings or otherwise take steps to evict tenants for non-payment of rent from any residential dwelling that includes single-family and multi-family homes, mobile homes, or other structures lawfully used as a residential dwelling if the tenant demonstrates the inability to pay rent is due to COVID-19. He advised the ordinance would also apply to commercial tenants, such as a business or commercial enterprise, renting or leasing a structure used for business purposes. Mr. Garcia explained both residential and commercial tenants would be required to notify the landlord in writing before the rent is due that the tenant has a covered reason for the payment delay, provide verifiable documentation to support the assertion of a covered reason for delayed payment, and pay a portion of the rent that the tenant can pay. Lastly, he clarified the ordinance does not waive a tenant's obligation to pay back rent owed once the ordinance is no longer in effect. Mr. Garcia reported the ordinance provides a tenant up to 90 days after the expiration of the ordinance to pay the landlord unpaid rent. He noted Mayor Sidhu offered an amendment to make that period 120 days to be paid in equal monthly installments beginning 30 days after the rent becomes due. He advised no late fees, costs, or other penalties shall be assessed or due from the tenant based on the delay in paying rent as provided for in the ordinance. Lastly, he advised the moratorium on residential and commercial evictions would remain in effect until April 30, 2020 unless extended by the City Council at a later date. Mr. Garcia advised the ordinance asks the City Manager to widely disseminate materials related to the moratorium to both tenants and landlords and to begin requesting federal housing assistance and funding to support tenants and landlords that are negatively impacted by COVID-19. He noted the City Council Minutes of March 24,2020 Page 8 of 13 ordinance also asks the City Manager to explore the feasibility of expanding the Senior Safety Net Program to include all impacted residents. Additionally, the ordinance directs the City Manager to report on the City's implementation plan for the state's "Stay At Home" order and to work with affected stakeholders on a package of economic assistance and recovery recommendations for future consideration by the City Council. DISCUSSION: Mayor Sidhu clarified his amendment should include nonprofits under the commercial portion. Mayor Pro Tern Faessel expressed his support for the item. Council Member Kring expressed her support for the item, noted it will help the bulk of businesses and residents facing this problem, and felt it was a good compromise. Council Member Brandman expressed his support for the item. He also noted the item can be revisited should conditions change in the next few weeks. Council Member Moreno expressed his support of a policy direction that supports residents and small businesses. In response to Council Member Moreno's inquiry, Mr. Garcia advised the April 30 date was given at the direction of the Mayor's Office but City Council could extend the date. Council Member Moreno expressed concern that April 30 would be too short of a timeframe as is being indicated by public health officials and suggested an alternative future date be selected. In response to Council Member Moreno's inquiry, City Attorney Robert Fabela advised sub-letters are not explicitly stated in the ordinance, but that would be a fair interpretation; however, he would prefer clarification. In response to Council Member Moreno's inquiry, Mayor Sidhu agreed sub-letters could be part of the ordinance. Council Member Moreno reported he received questions from Public Interest Lawyer Donovan Rinker-Morris, who expressed concerns regarding the conditions one must meet to be eligible. He expressed concern the request may be rejected if it is not written appropriately or in alignment with the ordinance. In response to Council Member Moreno's inquiry, Mr. Garcia reported the conditions are in place to ensure residents notify landlords they are impacted by COVID-19 and covered by the ordinance. He advised tenants could verify through an email or letter from their employer or a letter from their doctor if they have contracted COVID-19. He also noted the structure was adopted by other jurisdictions to show good faith that tenants need to notify their landlords they are impacted by COVID-19, provide some documentation, and provide some sort of arrangement on payment. In response to Council Member Moreno's inquiry, Mr. Fabela clarified it needs to be some kind of verifiable documentation that is reasonable. He advised landlords who insist on some sort of unreasonable level of verification would do so at their own risk and noted many services provide representation for low-income residents who might be suffering from unfair treatment by an unreasonable landlord. In response to Council Member Moreno's inquiry, Mr. Fabela advised the landlord and tenant would need to work together to determine a reasonable good faith payment. He also advised City Council could add language to the ordinance that would lower the threshold of documentation. Mayor Sidhu clarified he would like to have a policy in place that requires the landlord and the tenant to work together to verify the hardship. City Council Minutes of March 24, 2020 Page 9 of 13 Council Member Moreno suggested the City Attorney's Office create a sample or template notification letter that residents can download and fill out to give to their landlords which is legally aligned with the ordinance, provide some sample verification documentation, and suggested the 90-day repayment period be extended to six (6) months. Mayor Sidhu expressed his support for the City Attorney's Office to draft a sample notification. Mr. Fabela advised his office would provide guidance for consistency for future enforcement. In response to Council Member Barnes' inquiry regarding outreach to local landlords, Mayor Sidhu advised he has not been in touch with landlords but had been in contact with the California Apartment Association and Orange County Apartment Association and they expressed their support for the item. Mayor Sidhu also noted the Anaheim Chamber of Commerce was in full support of the item. Council Member Moreno reported he received emails from some local landlords who support the item but are concerned about their economic future. Council Member Barnes expressed her support for the development of a template for notification. She expressed concern that families who are living in motels were not included in stakeholder communications. In response to Council Member Barnes' inquiry, Mr. Garcia clarified the item is an uncodified Urgency Ordinance which would go into effect immediately if adopted. He did clarify the ordinance requires the City Manager to complete several actions but does not give a specific timeline; he assured it would be returned to City Council through a memo as soon as possible. In response to Council Member Barnes' inquiry, Mayor Sidhu advised he expedited this request so it could be implemented as soon as possible and explore a variety of options. Mr. Garcia reported staff has already begun preparing some statements. He advised the City Attorney's Office has been discussing a template and a letter that residents can use and advised information could be disseminated immediately. Council Member Barnes requested an amendment be made to exempt families living in motels be exempted from moving every 30 days. In response to Mayor Sidhu's inquiry, Mr. Fabela requested additional information before he could provide an opinion. Council Member Barnes clarified the amendment would exempt residents who rent motel rooms and are required to leave the room for seven (7) days to avoid establishing tenancy before returning to the motel from the seven (7) day rule. Mayor Sidhu advised the item should be bought up at the next City Council meeting. Mr. Fabela agreed it was a separate issue and expressed concerns with this topic straying from what was agendized. Council Member Barnes disagreed but requested Mayor Sidhu raise this issue with stakeholders. Mr. Fabela clarified the current motion on the floor is from Mayor Sidhu which was seconded to approve the item with an amendment to change the 90-day payback period to a 120-day payback period and to change the default payments from three (3) to four (4). He also noted a friendly amendment was added to include sub-letters. Council Member Kring noted she spoke to the City Attorney's Office regarding renting a hotel room beyond 30 days and was told it was not being enforced. She noted the verifiable documentation could include rental agreements since they indicate the renter's place of employment. City Council Minutes of March 24, 2020 Page 10 of 13 Council Member O'Neil stated motels are not permanent dwelling units and do not require a long-term lease and therefore should be a separate discussion. He expressed his opposition to lowering the burden of proof and felt tenants and landlords should be able to negotiate fair repayment amounts during the hardship. He expressed concerns this may not mitigate any outstanding financial obligations for a commercial or residential property owner and a disruption in the cash flow can put them at a financial risk. He expressed concern regarding the ripple effect of residents who manage the property such as maintenance workers, groundskeepers, and landscapers. He expressed his support for the item but felt a broader conversation needed to be had about how to help mitigate the impact City Council's action will have on these property owners. Council Member O'Neil encouraged the City to look at other options such as deferring utility payments, spending other fees the property owners pay to the city, leveraging Housing Authority funds to help, or providing short term loans to help the bridge the gap and prevent insolvency. In response to Council Member O'Neil's inquiry, Mr. Garcia advised there have been discussions at the federal level about how to assist property owners but staff has been hearing that there will likely be some action to provide relief to landlords from the mortgage companies. He advised City staff is investigating some relief options and will return to City Council shortly to provide recommendations. Council Member O'Neil would like to see Anaheim lead the way. Mayor Pro Tern Faessel noted it was critical action be taken on the item this evening. He expressed his support for developing a template. In response to Council Member Moreno's inquiry, Mr. Fabela advised the ordinance does not intend to intervene in the landlord-tenant relationship in regards to whether or not to renew month-to-month rental agreements. Council Member Moreno reported Public Interest Lawyer Donovan Rinker-Morris advised him that a landlord motivated by profit may respond to a COVID-19 notice by issuing a three (3) day Cure Covenant or Quit Notice instead of a three (3) day Pay or Quit Notice and thereby avoid the entire protection that Anaheim is seeking for its residents in the ordinance. In response to Council Member Moreno's inquiry, Mr. Fabela advised he was not fully versed in landlord-tenant law but did advise there are many ways unscrupulous landlords may try to evade the ordinance. He did advise they could investigate to determine if the language could be solidified to ensure that kind of thing happens infrequently. Council Member Moreno asked City Council to consider extending that the payback period to six (6) months as a shorter period may create an unreasonable rent increase for residents. SUBSIDIARY MOTION: Council Member Moreno moved to amend the payback period in Section 5 from 90-days to six-months. Motion failed for lack of a second. DISCUSSION: Mayor Sidhu stated he felt the 120-days was the appropriate timeframe and noted it could be revisited if needed. SUBSIDIARY MOTION: Council Member Moreno moved to amend the existing motion to include a change to Section 2(A) for the ordinance to remain in effect until May 31, 2020, seconded by Council Member Barnes. Council Member O'Neil called for a point of order. Mr. Fabela advised Council Member Moreno was asking for a motion to amend the current motion on the floor to change the date of April 30 to May 31. He advised if there is a vote and it does not pass, the item on the floor is the previous motion. Mayor Sidhu expressed his support for amending the date to May 31, 2020. Council Member Barnes expressed her support for the amending the date to May 31, 2020. Mr. Fabela clarified the motion on the floor is the motion to amend so a yes vote means there is a new motion on the floor, which is the previous motion, with the exception that April 30 will be changed to May 31, and if passed, City Council will vote again. SUBSIDIARY MOTION: Council Member Moreno moved to amend the existing motion to include a change to Section 2(A) for the ordinance to remain in effect until May 31, 2020, seconded by Council Member Barnes. DISCUSSION: In response to Mr. Fabela's inquiry, Mayor Sidhu clarified he would like to explicitly define nonprofits as organizations covered by the provision for commercial tenants. Council Member O'Neil clarified month-to-month renters are required to be given a 30-day notice for evictions and if they have resided in the location for more than one (1) year, it requires a 60-day notice. He expressed his opposition to extending the payback time to six (6) months as he felt it was not sustainable. In response to Council Member Kring's inquiry, Mr. Fabela clarified the motion will be for the emergency ordinance as provided in the agenda with four (4) variations. He advised one is Section 5(A) which changed the payback period from 90 days to 120 days and three (3) payments to four(4) payments. He advised another provision is being added to Section 1 which will protect sub-letters. He noted changes to Sections 2(A) and 3(A) change the end date from April 30 to May 31. Lastly, he advised a provision is being added to Section 3(B) which clarifies commercial tenants include nonprofit businesses. Mayor Sidhu expressed his support for the item and felt it was the right thing to do for Anaheim. AMENDED MOTION: Mayor Sidhu moved approve ORDINANCE NO. 6482 AN UNCODIFIED (URGENCY) ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM imposing a temporary moratorium on the eviction of residential or commercial tenants unable to pay rent because of COVID-19, declaring the ordinance to be an emergency measure to take effect immediately upon adoption, and providing direction to the City Manager regarding other possible assistance to Anaheim residents and businesses, as amended, to change the payback period in Section 5(A) from 90-days to 120-days to be repaid in four (4) equal installments, to ensure non-profits are included within the definition of commercial tenants in Section 3(B), to include sub-letters within the provisions of Section 1, and to include a change to Sections 2(A) and 3(A) for the ordinance to remain in effect until May 31, 2020, seconded by Council Member Kring. City Council Minutes of March 24, 2020 Page 12 of 13 PUBLIC COMMENTS (non-agenda items): None COUNCIL COMMUNICATIONS/AGENDA REQUESTS: Mayor Sidhu addressed the unprecedented times, the public health risk, and the economic harm caused by the shut-down of Anaheim's economic engines. He stated schools are closed, businesses are closed or struggling, and the workforce is having trouble buying goods, paying rent, etc. He reported he had been working with staff, organizations, and stakeholders on an economic recovery plan to get the economy going again as soon as shut-down orders are lifted. He explained the plan would seek to expand support for the eviction moratorium to stabilize the housing market and small businesses; ensure utilities are not shut off for those who cannot pay their bills; provide support to small businesses through buy/dine/hire/use local programs to focus on helping as many businesses as possible keep people employed; ensure the Planning and Building Department continues to function to support the pace of development and improvements do not slow down including incentives such as fee deferrals, waivers, and entitlement extensions; to partner with local economic development banks to offer no/low-interest loans to small businesses; provide an infusion of support to city employees to help with expedited plan checks, inspections, and hiring; and work with long-time partners such as Visit Anaheim to make sure Anaheim is the destination to come back online and welcome guests and visitors again. As they were in the final stages of developing the program and wanting to announce details soon for Council consideration, Mayor Sidhu called for a Special Meeting on Thursday, March 26, 2020, at 5:00 P.M. Mayor Pro Tem Faessel reported he facilitated a phone call last week between business stakeholders and the Emergency Operations Center to facilitate the distribution of much-needed supplies from hotels and restaurants to the community. He further met with various business partners to keep abreast of what recovery might look like and he appreciated the mayor for looking at ways to restore Anaheim's economy. He reported he and his wife assisted the Sunkist Mobile Home Park by providing toilet paper and thanked Ace Hardware for facilitating the provision of distilled water to the residents for their CPAP machines. He reported that last Saturday, they joined hundreds of volunteers at the Honda Center to distribute food to about 4,000 families, announced there would be another distribution this Saturday, March 28, 2020, and thanked Second Harvest Food Bank for organizing the events. He requested the meeting adjourn in memory of longtime Anaheim resident, Jerome Reiss Sr., the father of Police Captain Joe Reiss. Council Member Kring thanked the entire City staff for their efforts, thanked business and community leaders for stepping up to help their neighborhoods, thanked the Anaheim Resort for all they are doing for the community, and acknowledges grocery stores for their dedicated hours for seniors and restaurants for delivering and donating food. She encouraged residents to support their local restaurants by ordering take-out and announced that beer, wine, and cocktails were also now available for take-out. She acknowledged that many restaurants were also providing groceries and goods as part of their service. She thanked all volunteers, residents helping their neighbors, and those staying home for their assistance in getting through this together. Council Member Brandman thanked his colleagues for their comments, encouraged residents who may experience price gouging to immediately report it to the Orange County District Attorney, and encouraged the support of neighborhood restaurants where possible during these times of financial stress. Council Member Moreno thanked his colleagues for coming together on the vote to protect residents and small business people and looked forward to continued work on the program. He commended his City Council Minutes of March 24, 2020 Page 13 of 13 colleagues and staff for getting information out to residents and businesses. He acknowledged all neighbors helping each other and the school systems for their swift work on cleanliness, education, and feeding students. He offered to assist the mayor with these efforts and engage additional stakeholders such as schools, non-profits, and faith-based organizations. He thanked staff for their work and encouraged the City Manager to continue monitoring employee health and well-being. He requested a future agenda item to consider freezing rent increases during this time (request failed for lack of concurrences). He expressed sorrow regarding the death of Jerome Reiss. Council Member Barnes encouraged everyone to reach out to the city as a whole, was grateful to Mayor Pro Tern Faessel for representing the city at events, and requested consideration of funding for Love Anaheim to continue providing food to senior mobile home parks. She encouraged staff to fully complete the action taken tonight and provide resources to residents, businesses, and landlords to ensure a smooth process. She encouraged seniors who need food or resources, to call her office and offered thanks for all the acts of kindness and patience. Council Member O'Neil thanked the mayor for his leadership, staff for their work, Visit Anaheim and the Chamber of Commerce for being resources to the business community, economic stakeholders for their commitment to workers and residents in the community, essential services workers making sure people are cared for and stores were stocked, those heeding health warnings and staying home, and for those supporting small businesses. He expressed confidence that the City will get through this and be stronger than ever before. Mayor Sidhu thanked his colleagues for weighing in on such important issues to care for residents and businesses, offered special thanks to the staff for their work and for communicating with residents, and noted everyone was in this together. When a guest cancels, I have to refund them their payment in whole as they are in hardship as well. My accounts are running low and I am doing my best to pay my 2 salary employees and my 3 hourly employees. We also have 8 individuals who clean our houses and work in crews of 2-3, our service techs along with all of the other expenses that go into running a business and having a family. I am doing my best to support my whole team during this very tumultuous time. I have had ALL bookings cancel from 3/12/20-4/30/20 and as mentioned, guest cancelling as far out as August. I can help my team out for another month or two if I can receive some relievement on paying TOTS. This will go far for my team and will give us the opportunity to be up and running with our staff in place once our society can get a handle on this situation. We have been great citizens to the City of Anaheim, paying out taxes, bringing in tourism, fixing up dilapidated homes and always supporting local vendors and shops. There should be no burden on tenants to prove hardship due to the current public health crisis. It impacts our families, loved ones, and the community as a whole in many ways. The availability of assistance, if needed, should not be conditional, and promotes the general welfare of our city and surrounding communities. Striking this section would also requires striking out " If a tenant complies with the requirements of this ordinance" from section 2(E) Section 5(A) There is no language in this section differntiating between commercial and residential tenants. The 90 day payback period should be extended to a minimum of six months (180 days) for residential tenants. If a State or National stay-at-home or shelter -in-place order is in effect for months, not weeks, you should also consider extending the payback period further with a subsequent ordinance or amendment. School closures have occurred and may continue. Employees have been advised to work at home. As a result, restaurant and retail business has significantly declined and workers have been impacted by lost wages and layoffs. Parents have had to miss work to care for home -bound school-age children. As the virus spreads, workers may have to stay home and businesses may have to restrict their activities or close for extended periods. D. Many residential and commercial tenants have experienced sudden income or revenue loss, and further income impacts are anticipated. The loss of income and revenue caused by the effects of COVID-19 may impact tenants' ability to pay rent when due, leaving tenants vulnerable to eviction. E. Providing tenants with a short-term protection from eviction due to the inability to pay rent will help avoid increasing the homeless population and stabilize the rental housing and commercial real estate market by reducing displacement. F. During this state of emergency, and in the interests of protecting the public health and preventing transmission of COVID-19, it is essential to avoid unnecessary displacement of tenants. Prohibiting residential and commercial evictions on a temporary basis is necessary until the spread of the virus can be minimized and the emergency restrictions lifted. G. Nothing in this ordinance waives a tenant's obligation to pay back rent owed once this ordinance is no longer effective, under the terms set forth in Section 5, below. SECTION 2. Moratorium on residential evictions due to nonpayment of rent during the COVID-19 emergency. A. This Section 2 will remain in effect until April 30, 2020, unless extended by the City Council. B. No landlord shall initiate proceedings or otherwise take steps to evict a tenant for nonpayment of rent from any residential dwelling (including single family and multi- family homes, mobile homes or other structures lawfully used as a residential dwelling) if the tenant, in accordance with this subsection D, demonstrates that the inability to pay rent is due to COVID-19, the state of emergency regarding COVID-19, or following government -recommended COVID-19 precautions. C. As used in this Section 2, "covered reason for delayed payment" means a tenant's loss of income due to any of the following: (i) the tenant was/is sick with COVID- 19 or caring for a household or family member who was/is sick with COVID-19; (ii) the tenant experienced a lay-off, loss of hours, or other income reduction resulting from COVID-19 or the state of emergency; (iii) the tenant's compliance with a recommendation from a government agency to stay home, self -quarantine, or avoid congregating with others during the state of emergency; or (iv) the tenant's need to miss work to care for a home -bound school-age child. D. To take advantage of the protections afforded under this ordinance, a tenant must do all the following: ii. Notify the landlord in writing before the day rent is due that the tenant has a covered reason for delayed payment; ii. Provide the landlord with verifiable documentation to support the assertion of a covered reason for delayed payment; and iii. Pay the portion of rent that the tenant is able to pay. E. If a tenant complies with the requirements of this ordinance, a landlord shall not serve a notice pursuant to California Code of Civil Procedure sections 1161 and 1162, file or prosecute an unlawful detainer action based on a three-day pay or quit notice, or otherwise take steps to evict the tenant for nonpayment of rent. F. Nothing in this ordinance relieves the tenant of liability for the unpaid rent after expiration of this ordinance. SECTION 3. Moratorium on commercial evictions due to nonpayment of rent during the COVID-19 emergency. A. This Section 3 remains in effect until April 30, 2020, unless extended by the City Council. B. No landlord shall initiate proceedings or otherwise take steps to evict a commercial tenant (a business or commercial enterprise renting or leasing a structure used for business purposes) for nonpayment of rent if the tenant, in accordance with this subsection D, demonstrates that the inability to pay rent is due to COVID-19, the state of emergency regarding COVID-19, or following government -recommended COVID-19 precautions. C. As used in this Section 3, "covered reason for delayed payment" means a tenant's loss of business income due to any of the following: (i) the owner, management personnel, or key employees of the business were/are sick with COVID-19 or caring for household or family members who were/are sick with COVID-19; (ii) the business experienced income reduction resulting from COVID-19 or the state of emergency; (iii) the business's compliance with a recommendation from a government agency to close, reduce service, or limit contact between members of the public and its personnel/employees; or (iv) key employee(s) of the business need to miss work to care for a home -bound school-age child. D. To take advantage of the protections afforded under this ordinance, a tenant must do all the following: i. Notify the landlord in writing before the day rent is due that the tenant has a covered reason for delayed payment; ii. Provide the landlord with verifiable documentation to support the assertion of a covered reason for delayed payment; and iii. Pay the portion of rent that the tenant is able to pay. E. If a tenant complies with the requirements of this ordinance, a landlord shall not serve a notice pursuant to California Code of Civil Procedure sections 1161 and 1162, file or prosecute an unlawful detainer action based on a three-day pay or quit notice, or otherwise take steps to evict the tenant for nonpayment of rent. F. Nothing in this ordinance relieves the tenant of liability for the unpaid rent after expiration of this ordinance. SECTION 4. Effective Date. This ordinance takes effect immediately upon enactment. SECTION 5. Ninety -Day Payback Period. A. A tenant afforded eviction protection under Sections 2 or 3 of this ordinance shall have up to ninety (90) days after the expiration of this ordinance to pay its landlord unpaid rent. The terms of the repayment plan are to be agreed upon between the landlord and tenant, provided that, if no agreement is reached between the landlord and tenant, the back/past rent due shall be repaid in three (3) equal installments to be paid in monthly intervals beginning thirty (30) days after the date the rent becomes due pursuant to the terms of this ordinance. No late fees, costs or other penalties shall be assessed or due from the tenant based on the delay in paying rent as provided for in this ordinance. During this 90 -day period, the protections against eviction set forth in Sections 2 and 3 of this ordinance shall apply to such tenants. B. The date upon which a delayed payment comes due for the purposes of Code of Civil Procedure Section 1161(2) shall be the date agreed upon by the landlord and tenant in a repayment plan, or, if no agreement is reached as specified in subsection (A) above. SECTION 6. Additional Direction by the City Council. A. The City Council directs the City Manager to develop and disseminate materials explaining the provisions of this ordinance to residential and commercial tenants and landlords in Anaheim. B. The City Council finds that the impact of non-payment of rent could have severe consequences on rental property owners, which harm could be mitigated by federal housing assistance and funding. The Council accordingly directs the City Manager, at the earliest possible opportunity, to request that the federal government include an increase in federal housing funding to support tenants and landlords negatively impacted by the COVID-19 crisis and reimburse cities who assist tenants and landlords. 4 C. The City Council finds that the recently adopted Senior Safety Net Program, which utilizes state and federal housing funds to assist Anaheim Senior Citizens with housing costs, could be expanded to include all Anaheim residents impacted by the COVID-19 crisis, and directs the City Manager to report to the City Council at the earliest possible date the viability of expanding this program to all residents impacted by the COVID-19 crisis. D. The City Council acknowledges the Governor's Executive Order N-33-20, also known as the "Stay at Home Except for Essential Needs" order. The City Council directs the City Manager to report back to the City Council at the earliest possible date a local implementation plan for this order to the extent local flexibility is allowed. E. The City Council acknowledges the severe economic impact of the COVID-19 crisis and related government actions, and directs the City Manager to work with affected stakeholders and report back to the City Council at the earliest possible date a package of economic assistance and recovery recommendations for the Council to consider to have Anaheim prepared for economic recovery. SECTION 7. Emergency Declaration. The City Council declares this ordinance to be an emergency measure, to take effect immediately upon adoption by a four-fifths vote pursuant to Anaheim City Charter section 511. The facts constituting the emergency are as follows: The directives from health officials to contain the spread of COVID-19 have resulted in loss of business, furloughs, lost wages, and lack of work for employees. To protect the public health, safety, and welfare, the City must act, on an emergency basis, to temporarily prohibit the eviction of residential and commercial tenants who are unable to pay rent due to income losses caused by the effects of COVID-19, SECTION 8. The City Clerk shall certify to the passage of this Ordinance and shall cause this Ordinance or a summary thereof to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in the City of Anaheim. I am writing in support of agenda item #12. Although Anaheim needs to do more to protect its most vulnerable residents, the proposed ordinance is a start and I urge you to vote in favor of adopting this ordinance. The problem with this ordinance is that many tenants will not be able to take advantage of its protections. Section 2D requires the tenant to meet several ill-defined benchmarks before protections kick in. These include the requirement of so-called verifiable documentation which is not defined in the ordinance. For tenants who are self-employed, have irregular work hours, or are seasonally employed, such documentation may be difficult to produce if it exists at all. Section 21)(iii) requires the tenant to "pay the portion of the rent that the tenant is able to pay" without explaining how that amount is to be determined. Let's suppose the tenant claims they can pay 50% of their rent, but the landlord claims they can pay 70%. How will such disputes be resolved? And is the tenant protected while such disputes are being resolved? Section 2F states that tenants are still liable for all unpaid rent, while Section 5 mandates a 90 -day payback period for unpaid rent. Terms of repayment may be negotiated, but in the absence of any negotiations, the payback must occur within 90 days. So let's suppose this ordinance remains in effect for one month. I would expect most landlords will insist on the 90 -day payback period, since there is very little incentive for them to negotiate anything else. That means the effective rent for those 3 months will increase by 33%. If the ordinance is in effect for 2 months, the effective increase would be 67%. How many tenants in Anaheim will be able to afford a 33% increase, let alone 67%? Not many, I suspect. This ordinance is better than nothing, which is why I want you to pass it, but it could be much better. Anaheim needs to do more - YOU need to do more - to protect this city's most vulnerable residents and avoid causing more people to become homeless. The ruling of "to make public meetings accessible telephonically or otherwise" requires comments to be made "telephonic," which is by voice. Mayor Harish S. Sidue and his cabal on the city council have maliciously interpreted the rule to mean only in writing, not telephonic. Several methods could be used to allow "The Rights to Freedom of Speech" voice comments for the residents of Anaheim. One method would be a simple telephone -answering unit limiting incoming public comments to three minutes, then playing the recordings at the council meeting during the public comment periods. It is known from the idiotic questions made by council members to their staff that they have rarely bothered to read written critical staff reports given to them prior to council meetings. Therefore, since they rerely read critical written reports, they will almost never read any written public comments. As a bare minimum, the city council should have a clerk read the submitted written public comments during the public comments periods at the council meetings. If my tenants do not pay rent I cannot pay my own house payment or pay my bills let alone the property expenses including property tax, insurance, pool maintenance, gardeners, mortgage payments, plus repairs that I am required to pay no matter whether rent is received or not. I am not alone in this situation. Rental units are bought by the owner to have income. If you take away their income, why own the property? Selling may be the only available recourse or a final decision to sell because of the risk, time, stress involved in owning. If you want to help tenants then I suggest the City of Anaheim pay their rent. Paying tenants rent will stabilize the City keeping tenants in housing and the existing houses for rent and neighborhoods intact. If a landlord does not receive rent, then property must be sold and if many rental houses are sold it will decrease the value of all properties in Anaheim/ Orange County/California. Of course, then there will also be fewer rental houses. Suggesting that tenants have months to make up missed payments does not help landlords exist because in the majority of properties there is a small profit when you consider property tax, insurance, repairs, and vacancy. The cost alone of repairs has become prohibited. Labor and hardware are very expensive now. Allowing tenants to not pay rent is stealing from the owner of the properties. Deferring rent payments puts an extreme hardship on owners. The difference between stock and real estate is when stock goes down you lose money with no addition responsibilities but when real estate income is lost you still have the responsibility of the upkeep, mortgage, tax, insurance, and tax liability and without income. Real estate affects the whole community while the decline of stock prices affect individuals and perhaps the individual company. Please consider other alternatives to this proposal to include the financial risks to property owners as well as tenants. However, if a tenant tries in bad faith to use improper documents, a good faith landlord may not have the means to verify those documents; they will be victimized as a result of this Anaheim ordinance. Similarly, a tenant who tries to use documents in good faith with a landlord who acts in bad faith will be victimized, as the landlord will just reject the `verifiable' portion, or the documents themselves, or otherwise reject the documents. The balance of harms falls differently on a landlord than on a tenant, however. If a landlord is taken in by `unverifiable' documents, that landlord may have a delay on the payment of rent, the same harm the landlord already faced before this ordinance was issued. Businesses and residences should not be held accountable for missed payments when a global health emergency is responsible for the non-payment. While measures have been suggested by Gov. My father and his brother co-own one 30 -unit apartment complex that our family invested in decades ago. Our family is part of the Anaheim community, and as members of the community, we work with Anaheim Housing Authority to rent to people who receive section 8 vouchers; we care about doing our part to make housing accessible. We are a small, family -run business, if you could call this a business --this building is the only apartment complex they own. At the same time, both my father and uncle are retired, senior citizens. My father is disabled and his main source of income is whatever is left over after rent collection after we pay utility bills, insurance, and the general maintenance , repair, and upkeep costs. My mother works, but her salary is low because she is a public school employee, and will likely be forced into retirement in 2 years. Some people have a misconception that landlords are rich and lazy, but that is not the case for my family. We are not millionaires; in fact, when my father had to stop working after becoming disabled, my mother worked part-time at Macy's to make ends meet, until the location she worked at closed. My family relies on the income from the apartment complex. I fear that a ban on evictions will leave no recourse for families like mine, who are property owners but not wealthy and too old to work. How would tenants be incentivized to pay rent on time if they know there are no consequences for failing to do so? It is certainly important to provide relief for those suffering during this economic downturn, but that relief cannot be at the expense of families like mine. This is the perfect situation that shows that our government is more concerned about big business than it is about the people, also that the people running it interest are not in the best interest of the people. Disneyland and it's resorts because of the shutdown had more toilet paper than anyone in the city of Anaheim. Did our leaders approach and try to strike a deal with Disneyland? No, they left you out there trying to get it on your own. Leaving some people in very precarious existence. City of Anaheim is over Two Billion dollars in debt and that amount is growing because of the speculation of taxes that were supposed to be collected on hotels. Provide the landlord with verifiable documentation to support the assertion of a covered reason for delayed payment; and iii. Pay the portion of rent that the tenant is able to pay. What that mechanism means, in practice, is that Anaheim's ordinance would ONLY restrict landlords if the tenant takes other steps. A tenant fighting an eviction who fails to give a landlord the notice provided for in (i)? Nothing. A tenant fighting a landlord who fails to provide 'verifiable documentation'? Nothing. A tenant who doesn't pay 'the portion a tenant is able to pay'? Nothing. Comparatively, any size shop in Anaheim - even the smallest business renting a building - is in a better position than the majority of poor renters - they can hire a bookkeeper, maintain their proof of income, and file the forms to meet the three criteria. Most residential renters cannot do that. We should not have the same standards applied for poor renters that we do for giant big box stores. If we do, then the end result will be that the protection in this moratorium falls to the richest business owners, but not to the poorest renters who need it the most but are often the least capable of utilizing these protections. None of us want to see an increase in homelessness due to a poorly written ordinance. I urge you to instead use a tenants rights lawyer or advocate to improve any ordinance before voting on it. C. The City of Anaheim has been impacted by the health crisis of this global pandemic. Sporting events, concerts, plays, and conferences have been cancelled. School closures have occurred and may continue. Employees have been advised to work at home. As a result, restaurant and retail business has significantly declined and workers have been impacted by lost wages and layoffs. Parents have had to miss work to care for home -bound school-age children. As the virus spreads, workers may have to stay home and businesses may have to restrict their activities or close for extended periods. D. Many residential and commercial tenants have experienced sudden income or revenue loss, and further income impacts are anticipated. The loss of income and revenue caused by the effects of COVID-19 may impact tenants' ability to pay rent when due, leaving tenants vulnerable to eviction. E. Providing tenants with a short-term protection from eviction due to the inability to pay rent will help avoid increasing the homeless population and stabilize the rental housing and commercial real estate market by reducing displacement. 1 F. During this state of emergency, and in the interests of protecting the public health and preventing transmission of COVID-19, it is essential to avoid unnecessary displacement of tenants. Prohibiting residential and commercial evictions on a temporary basis is necessary until the spread of the virus can be minimized and the emergency restrictions lifted. G. Nothing in this ordinance waives a tenant's obligation to pay back rent owed once this ordinance is no longer effective, under the terms set forth in Section 5, below. SECTION 2. Moratorium on residential evictions due to nonpayment of rent during the COVID-19 emergency. A. This Section 2 will remain in effect until April 30, 2020, unless extended by the City Council. B. No landlord shall initiate proceedings or otherwise take steps to evict a tenant for nonpayment of rent from any residential dwelling (including single family and multi- family homes, mobile homes or other structures lawfully used as a residential dwelling) if the tenant, in accordance with this subsection D, demonstrates that the inability to pay rent is due to COVID-19, the state of emergency regarding COVID-19, or following government -recommended COVID-19 precautions. C. As used in this Section 2, "covered reason for delayed payment" means a tenant's loss of income due to any of the following: (i) the tenant was/is sick with COVID- 19 or caring for a household or family member who was/is sick with COVID-19; (ii) the tenant experienced a lay-off, loss of hours, or other income reduction resulting from COVID-19 or the state of emergency; (iii) the tenant's compliance with a recommendation from a government agency to stay home, self -quarantine, or avoid congregating with others during the state of emergency; or (iv) the tenant's need to miss work to care for a home -bound school-age child. D. To take advantage of the protections afforded under this ordinance, a tenant must do all the following: ii. Notify the landlord in writing before the day rent is due that the tenant has a covered reason for delayed payment; ii. Provide the landlord with verifiable documentation to support the assertion of a covered reason for delayed payment; and iii. Pay the portion of rent that the tenant is able to pay. 2 E. If a tenant complies with the requirements of this ordinance, a landlord shall not serve a notice pursuant to California Code of Civil Procedure sections 1161 and 1162, file or prosecute an unlawful detainer action based on a three-day pay or quit notice, or otherwise take steps to evict the tenant for nonpayment of rent. F. Nothing in this ordinance relieves the tenant of liability for the unpaid rent after expiration of this ordinance. SECTION 3. Moratorium on commercial evictions due to nonpayment of rent during the COVID-19 emergency. A. This Section 3 remains in effect until April 30, 2020, unless extended by the City Council. B. No landlord shall initiate proceedings or otherwise take steps to evict a commercial tenant (a business or commercial enterprise renting or leasing a structure used for business purposes) for nonpayment of rent if the tenant, in accordance with this subsection D, demonstrates that the inability to pay rent is due to COVID-19, the state of emergency regarding COVID-19, or following government -recommended COVID-19 precautions. C. As used in this Section 3, "covered reason for delayed payment" means a tenant's loss of business income due to any of the following: (i) the owner, management personnel, or key employees of the business were/are sick with COVID-19 or caring for household or family members who were/are sick with COVID-19; (ii) the business experienced income reduction resulting from COVID-19 or the state of emergency; (iii) the business's compliance with a recommendation from a government agency to close, reduce service, or limit contact between members of the public and its personnel/employees; or (iv) key employee(s) of the business need to miss work to care for a home -bound school-age child. D. To take advantage of the protections afforded under this ordinance, a tenant must do all the following: i. Notify the landlord in writing before the day rent is due that the tenant has a covered reason for delayed payment; ii. Provide the landlord with verifiable documentation to support the assertion of a covered reason for delayed payment; and iii. Pay the portion of rent that the tenant is able to pay. E. If a tenant complies with the requirements of this ordinance, a landlord shall not serve a notice pursuant to California Code of Civil Procedure sections 1161 and 1162, file or prosecute an unlawful detainer action based on a three-day pay or quit notice, or otherwise take steps to evict the tenant for nonpayment of rent. F. Nothing in this ordinance relieves the tenant of liability for the unpaid rent after expiration of this ordinance. SECTION 4. Effective Date. This ordinance takes effect immediately upon enactment. SECTION 5. Ninety -Day Payback Period. A. A tenant afforded eviction protection under Sections 2 or 3 of this ordinance shall have up to ninety (90) days after the expiration of this ordinance to pay its landlord unpaid rent. The terms of the repayment plan are to be agreed upon between the landlord and tenant, provided that, if no agreement is reached between the landlord and tenant, the back/past rent due shall be repaid in three (3) equal installments to be paid in monthly intervals beginning thirty (30) days after the date the rent becomes due pursuant to the terms of this ordinance. No late fees, costs or other penalties shall be assessed or due from the tenant based on the delay in paying rent as provided for in this ordinance. During this 90 -day period, the protections against eviction set forth in Sections 2 and 3 of this ordinance shall apply to such tenants. B. The date upon which a delayed payment comes due for the purposes of Code of Civil Procedure Section 1161(2) shall be the date agreed upon by the landlord and tenant in a repayment plan, or, if no agreement is reached as specified in subsection (A) above. SECTION 6. Additional Direction by the City Council. A. The City Council directs the City Manager to develop and disseminate materials explaining the provisions of this ordinance to residential and commercial tenants and landlords in Anaheim. B. The City Council finds that the impact of non-payment of rent could have severe consequences on rental property owners, which harm could be mitigated by federal housing assistance and funding. The Council accordingly directs the City Manager, at the earliest possible opportunity, to request that the federal government include an increase in federal housing funding to support tenants and landlords negatively impacted by the COVID-19 crisis and reimburse cities who assist tenants and landlords. C. The City Council finds that the recently adopted Senior Safety Net Program, which utilizes state and federal housing funds to assist Anaheim Senior Citizens with housing costs, could be expanded to include all Anaheim residents impacted by the COVID-19 crisis, and directs the City Manager to report to the City Council at the earliest possible date the viability of expanding this program to all residents impacted by the COVID-19 crisis. D. The City Council acknowledges the Governor's Executive Order N-33-20, also known as the "Stay at Home Except for Essential Needs" order. The City Council directs the City Manager to report back to the City Council at the earliest possible date a local implementation plan for this order to the extent local flexibility is allowed. E. The City Council acknowledges the severe economic impact of the COVID-19 crisis and related government actions, and directs the City Manager to work with affected stakeholders and report back to the City Council at the earliest possible date a package of economic assistance and recovery recommendations for the Council to consider to have Anaheim prepared for economic recovery. SECTION 7. Emergency Declaration. The City Council declares this ordinance to be an emergency measure, to take effect immediately upon adoption by a four-fifths vote pursuant to Anaheim City Charter section 511. The facts constituting the emergency are as follows: The directives from health officials to contain the spread of COVID-19 have resulted in loss of business, furloughs, lost wages, and lack of work for employees. To protect the public health, safety, and welfare, the City must act, on an emergency basis, to temporarily prohibit the eviction of residential and commercial tenants who are unable to pay rent due to income losses caused by the effects of COVID-19. But I'm of the opinion the time to pay back rent is way too short. I believe that if a landlord and tenant cannot come to an agreement on how to pay what is owed, then the latter should be given up to six months to do it—not three. Here is my rationale for this: First, it will be much easier to pay back rent if it is made in installments that are spread out over a six month period. The net result is that the monthly payments will be lower, making it less burdensome on tenants. If you keep the period at three months, the payments for back rent will be much higher, increasing the chances tenants might default, spurring more evictions, homelessness, and further destabilization of the real estate market. Second, I expect President Donald Trump will support a Keynesian stimulus package that will pump at least a trillion dollars into local and state economies to boost aggregate demand. But understand the effects of this won't be seen immediately: It might take a few months for it to have a ripple effect. A lower monthly payment to pay back rent will give tenants more disposable income to buy things, which in turn spurs an economic recovery. Regardless of what the situation might be, I feel that any ordinance the city council passes which imposes a temporary moratorium on all residential and commercial evictions is better than no ordinance at all. Nevertheless, I do believe giving tenants up to six months to pay back rent is quite prudent given the uncertainty we are facing. A lot of the community if not everyone has suffered some major change in their finances. So I plead with you to give the many families and business owners who love Anaheim so much the break they need to get back on their feet. No one should be kicked out of their houses or businesses during a health crisis such as the one we are facing now. We are counting on you our leaders to lead us safely into a better tomorrow. I also want to add, to lengthen the time to be able to pay back will help a lot. I know 3 months has been in the conversation but I would like to encourage you to stretch it out to 6 months. Because realistically speaking most families and even businesses would struggle to pay back in such a short amount of time. This would create an unnecessary animosity. Show the business community that Anaheim is a business city for small business owners as well. You are jumping the gun and about to cause MORE HARM TO SMALL BUSINESSES! A Landlord MUST pay the mortgage! And now you want to implement an Order so that renters can take up to 90 days to pay back rent, of which they didn't have the money to pay rent in the first place? What makes you think they will have money after 90 days of being unemployed? Landlords will NEVER GET PAID! And rely, with your fingers crossed, that the Federal Government will eventually assist landlords? NO NO NO! It is not the responsibility, to HOUSE FOR FREE, tenants because our Federal Government dropped the ball! DON'T START A PRECEDENT! THERE IS NO WAY A LANDLORD WILL EVER RE -COUP THEIR LOSSES! DON'T GET INVOLVED! THE COUNCIL CONTINUES TO BUTT THEIR NOSE INTO ITEMS THAT THEY SHOULD BE STAYING OUT OF! DON'T DO IT! If these renters don't have the money to pay rent, get a roommate! Or move back home! Better yet, let the landlords work with their tenants on a case by case basis. Stop putting your nose where it does not belong. We are tired of working hard and getting screwed time and time AND TIME AGAIN! STOP THIS NONSENSE! BUTT OUT!
