RES-2021-017 RESOLUTION NO. 2 021 -017 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE FIRE CHIEF OR DESIGNEE TO ACCEPT DISTRIBUTIONS FROM THE DEPARTMENT OF HEALTH AND HUMAN SERVICES CORONAVIRUS AID, RELIEF, AND ECONOMIC SECURITY (CARES) ACT PROVIDER RELIEF FUND ON BEHALF OF THE CITY OF ANAHEIM AND AMENDING THE BUDGET ACCORDINGLY WHEREAS, the U.S. Department of Health and Human Services as heretofore established the Coronavirus Aid, Relief, and Economic Security(CARES)Act Provider Relief Fund("PRF") to support American families, workers, and healthcare providers in the battle against the COVID- 19 outbreak; and WHEREAS, the Department of Health and Human Services (HHS) has identified $50 Billion for general distributions from a Provider Relief Fund (PRF) to Medicare Providers; and WHEREAS, the City of Anaheim, a Medicare Provider by way of its Emergency Medical Services(EMS) ambulance program,received PRF distributions in Round 1 and Round 3,totaling $531,281; and WHEREAS, in order to retain these funds, HHS requires recipients to acknowledge and agree to reporting on and documenting the use of said funds; and WHEREAS, recipient Medicare Providers may use PRF distributions only to "prevent, prepare for, and respond to coronavirus"and for"health care related expenses or lost revenues that are attributable to coronavirus" under categories including medical supplies and equipment, personal protective equipment (PPE), testing supplies, vaccine distribution, applicable labor and training, and surge capacity; and WHEREAS,the City is familiar with the terms, conditions and limitations of such funding and is willing and able to conform to each of the terms, conditions and limitations imposed upon any such funding distributed to the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The Anaheim Fire Chief or designee is hereby authorized to accept distributions of funding from the Coronavirus Aid, Relief, and Economic Security(CARES)Act Provider Relief Fund on behalf of the City of Anaheim from the Department of Health and Human Services. 1 2. The City Council of the City of Anaheim hereby agrees to, and by this resolution, does accept any such funding distributed to the City of Anaheim without further action of the City Council being required therefor. 3. The City of Anaheim hereby agrees to comply with each and all of the terms, conditions and limitations imposed by the Department of Health and Human Services, and the Anaheim Fire Chief or designee is hereby authorized and directed to execute any agreements, assurances, or other documents as may be necessary in connection with the acceptance of said funding as may be required by the Department of Health and Human Services. 4. The annual budget of the City of Anaheim is hereby amended by increasing revenue and expenditures in an amount equal to the amount of the funds received by the City.
