A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING PUBLIC UTILITY EASEMENTS
LOCATED AT 1600 EAST VERMONT AVENUE PURSUANT TO
CALIFORNIA STREETS AND HIGHWAYS CODE SECTION
8330, ET SEQ. - SUMMARY VACATION. (ABA 2021-00406)
WHEREAS, an applicant has requested the vacation of certain public utility
easements generally located at 1600 East Vermont Avenue, in the City of Anaheim, County of
Orange, State of California, as more particularly described below (individually, "Public Service
Easement" and collectively, "Public Service Easements"), in order to clear title because electrical
facilities have been relocated; and
WHEREAS,the City of Anaheim acquired the Public Service Easements for public
utility purposes ("Public Utility Purposes"); and
WHEREAS, the Public Service Easements are not necessary for present or
prospective Public Utility Purposes or any other public purpose; and
WHEREAS, the Public Service Easements to be vacated have been superseded by
relocation and there are no other public facilities located within the Public Service Easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim hereby finds the recitals true and correct and orders the vacation of two Public Service
Easements, (1) recorded September 15, 1992, as Instrument No. 92-617507, Official Records of
Orange County; and (2) recorded April 30, 2007, as Instrument No. 2007000278654, Official
Records Of Orange County.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby
makes this vacation pursuant to the requirements of the California Streets and Highways Code,
Division 9,Part 3, Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be,and is hereby,authorized and
directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder of
the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange,the vacation shall be
complete and the Public Service Easements vacated shall no longer constitute public service
easements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 23 day of March , 2021, by the following roll call vote:
AYES: Mayor Sidhu and Council Members_ Faessel, Diaz, Brandman,
Valencia, and O'Neil
NOES: None
ABSENT: Council Member Moreno
ABSTAIN: None
