RESOLUTION NO. 87R-432
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE CITY ATTORNEY TO
COMPROMISE AND SETTLE CERTAIN CLAIMS, DEMANDS
AND LAWSUITS PROSECUTED ON BEHALF OF THE CITY
FOR THE RECOVERY OF SUMS OF MONEY IN THE
AMOUNTS AND PURSUANT TO THE CONDITIONS
SPECIFIED HEREIN.
WHEREAS, pursuant to City of Anaheim Charter Section 706,
the City Attorney has the duty to represent and appear for the
City in all actions or proceedings in which the City is concerned
or is a party; and
WHEREAS, in connection with said Charter Section 706, the
City Attorney represents the City in numerous actions involving
legal claims, demands or rights of the City to recover sums of
money, which claims, demands or rights are disputed relative to
either liability or amount of damages or both; and
WHEREAS, in many instances, the City Attorney is able to
negotiate a settlement of such claims, demands or lawsuits on the
basis of an evaluation of the available evidence and a
determination of the City's chances of prevailing in trial of the
actions; and
WHEREAS, the City Council desires to authorize the City
\ttorney to settle certain claims, demands and lawsuits brought on
behalf of the City for the recovery of sums of money pursuant the
limitations and conditions contained herein.
NOW, THEREFORE, BE [T RESOLVED by the City Council of the
City of Anaheim as follows:
1.
The City Attorney is hereby authorized to compromise,
settle and to execute releases for any and all claims,
lawsuits, or rights of the City for the recovery of sums
of money wherein the amount of said settlement or
compromise does not reduce the amount of the City's
liquidated claim, demand or out of pocket cost by more
than $15,000.00.
2.
~s a condition precedent to any such compromise or
settlement, the City Attorney shall obtain the
concurrence of the City Manager, or the department
of the department for which such claim or right is
asserted, or his/her designee.
