RESOLUTION NO. 87R-442
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATlNG A PORTION OF A STORM DRAIN
EASEMENT LOCATED EAST OF WEIR CANYON ROAD AND
NORTH OF SANTA ANA CANYON ROAD. (87-6A)
WHEREAS, the City Council of the City of Anaheim did,
by resolution duly adopted, declare its intention to vacate
certain public streets, highways or public service easements
pursuant to the Public Streets, Highways and Service Easements
Vacation Law; and
WHEREAS, notice of a public hearing to consider said
vacation was posted and published in the manner prescribed by law;
and
WHEREAS, on the 27th day of October, 1987, a public
hearing was held to allow interested persons to submit evidence
concerning said proposed vacation; and
WHEREAS, the City Council does find, from the evidence
submitted, that the street, highway or public service easement
hereinafter specifically described is unnecessary for present or
prospective public purposes including nonmotorized transportation
facilities.
WHEREAS, if and to the extent that there are in place
public utility facilities in use for which easements are not
reserved and excepted by this resolution, the City Council hereby
determines that the public convenience and necessity requires that
no easements be reserved for such facilities.
NOW,fHEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby order the vacation of a portion of
the storm drain easement, more specifically described as follows:
That portion of Parcell, in the City of Anaheim,
County of Orange, State of California, as shown on
that certain "Lot Line Adjustment Plat No. 149"
recorded September 30, 1986 as Instrument No.
86-455516 of official records of said County, being a
portion of that certain 130.00 foot wide easement for
storm drain purposes as shown on said plat lying
northeasterly and northwesterly of the following
described line:

Commencing at the intersection of the northeasterly
right of way line of said easement with the
southeasterly line of said Parcell; thence N 26 24'
28" W, 22.58 feet along said right of way line to the
beginning of a 165.00 foot radius curve therein that
is concave southwesterly; thence Northwesterly 51.38
feet along said curve through a central angle of 17
50' 30" to the True Point of Beginning; thence the
following desr i bed courses: S 63 59' 59" W, 41.69
feet; N 52 33' 55" h, 53.66 feet; N 26 00' 01" W,
37.97 feet to the northeasterly right of way line of
said storm drain easement.
BE IT ~URTHER RESOLVED that the vacation authorized by
this resolution shall not be effective until a certified copy of
this resolution is recorded in the Office of the Recorder of
Orange County.
BE IT fURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to cause a certified copy of
this resolution to be recorded in the Office of the Recorder of
the County of Orange at such time as all of the following
conditions precedent to said vacation have been fulfilled:
1.
The City of Anaheim shall be paid the sum of Four
Thousand Dollars ($4,000.00).
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 27th day of October, 1~87.
