RES-2021-046RESOLUTION NO. 2021-046 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM MAKING APPLICATION TO AND REQUESTING THE ORANGE COUNTY LOCAL AGENCY FORMATION COMMISSION TO TAKE PROCEEDINGS PURSUANT TO THE CORTESE-KNOX-HERTZBERG LOCAL GOVERNMENT REORGANIZATION ACT OF 2000 FOR THE CITY OF ANAHEIM TO ANNEX APPROXIMATELY 0.35 ACRES OF PROPERTY WITHIN THE CITY OF ORANGE'S BOUNDARY AND SPHERE OF INFLUENCE AND FILE AN APPLICATION FOR REORGANIZATION NO. RO 21-04 AND DETERMINING SAID ACTIONS ARE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO SECTION 15301 (CLASS 1, EXISTING FACLITIES). WHEREAS, on September 29, 2020, the City Council approved Resolution No. 2020-118, directing City to file an application for reorganization with the Orange County Local Agency Formation Commission (OC LAFCO) for the City of Anaheim to annex approximately 9.8 acres of property (Annexation No. RO-06); and WHEREAS, on November 24, 2020, the City Council approved Resolution No. 2020-137 clarifying the following: the 9.8 acre area to be incorporated into the City of Anaheim is within City of Orange's Boundary and Sphere of Influence, the reorganization includes the detachment of area from a Municipal Water District of Orange County territory and clarification that the application to OC LAFCO is for reorganization and rescinding Resolution No. 2020-118 (hereinafter referred to as the "Original Request"); and WHEREAS, as part of the Angel Stadium of Anaheim Purchase and Sale Agreement, the City agreed to complete the annexation of an approximate 0.35 -acre portion (depicted as Area 2A (Stadium Sliver) of the 9.8 acre area identified in Resolution No. 2020-137; and WHEREAS, following the adoption of Resolution No. 2020-137, the City determined that because the Stadium Sliver is pre -zoned from Open Space to Mixed -Use Urban Core with the Platinum Triangle Mixed -Use Overlay Zone, which pre -zoning received environmental clearance concurrent with the approval of General Plan Amendment 2007-00459 and Reclassification No. 2007-00203 and 2007-00204), bifurcating the Stadium Sliver area from the Original Request will expedite the application for reorganization; and WHEREAS, the City Council now desires to adopt this resolution to bifurcate the application process to request a separate application for Stadium Sliver area depicted in Exhibit A and initiate proceedings pursuant to the Cortese -Knox -Hertzberg Local Reorganization Act of 2000, Division 3, commencing with Section 56000 of the Government Code, for the annexation of territory to the City; and WHEREAS, the proposed changes of organization include the following jurisdictional changes and sphere of influence actions: (1) Detachment of approximately 0.35 acres from the City of Orange city limits and sphere of influence, and detachment of the same territory from the Municipal Water District of Orange County along the Santa Ana River between Orangewood Avenue and approximately 650 feet north of Orangewood Avenue so that the new boundaries between the Cities of Anaheim and Orange align along the Santa Ana River Trail; and WHEREAS, the reasons for the proposed changes of organization are as follows: Exhibit A - The proposed annexation would realign a sliver of the Angel Stadium property at the southeast corner, located in the City of Orange, to allow the entire parcel to be located within the Anaheim city limits. The sliver would continue to provide parking for Angel Stadium and, in anticipation of the annexation, along with the Angel Stadium property is under review for development consistent with the General Plan Mixed - Use Urban Core land use designation and the Platinum Triangle Mixed -Use Overlay Zone; and WHEREAS, the territory subject to the proposed changes of organization is uninhabited, and a description of the external boundary of the territory is set forth in Exhibit "A" attached hereto and by this reference incorporated herein; and WHEREAS, the proposed annexation area is within the City of Orange's Sphere of Influence; and WHEREAS, the proposed annexation shall be subject to the following terms and conditions: the annexation shall be consistent with Government Code Section 56886 and other applicable law existing as of the date of the filing of this Resolution; and WHEREAS, pursuant to and in accordance with the provisions of the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as "CEQA"), the State of California Guidelines for Implementation of the California Environmental Quality Act (Title 14 of the California Code of Regulations; herein referred to as the "CEQA Guidelines"), and the City's Local CEQA Procedures, the City of Anaheim is the "lead agency" for the preparation and consideration of environmental documents for the proposed annexation application; and WHEREAS, City and Local Agency Formation Commission of Orange County (OC LAFCO) staff held a pre -filing meeting on July 31, 2020 and will hold a futuremeeting/public hearing for the residents and property owners to address any concerns about the proposed annexation; and NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Anaheim, California, does hereby approve the Resolution of Application for Reorganization No. RO 21-04, and requests the Orange County Local Agency Formation Commission to take proceedings for the annexation of territory to the City as shown in Exhibit "A", attached hereto and incorporated herein by this reference, according to the terms and conditions stated above and in the manner provided by the Cortese -Knox -Hertzberg Local Government Reorganization Act of 2000. BE IT FUTHER RESOLVED that the City Council of the City of Anaheim finds and determines that the effects of the proposed application for annexation of the Stadium Sliver to the City of Anaheim are typical of those within that class of projects (i. e. , Class 1 — Existing Facilities) which consist of the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use, and that, therefore, pursuant to Section 15301 of the CEQA Guidelines, this action will not cause a significant effect on the environment and is, therefore, categorically exempt from the provisions of CEQA.
