A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO APPROVE,
ACCEPT, AND CONSENT TO EASEMENTS, GRANT DEEDS, QUITCLAIM
DEEDS, OTHER CONVEYANCE INSTRUMENTS, AND FEE SIMPLE
DEDICATIONS FOR STREETS, ROADWAYS, UTILITIES, RIGHTS-OF-WAY,
AND OTHER PURPOSES ON BEHALF OF THE CITY
WHEREAS, Government Code Section 27281 provides that deeds or grants
conveying an interest in real property to the City may not be accepted for recordation
without the consent of the grantee evidenced by a Certificate of Acceptance; and
WHEREAS, Government Code Section 27281 also provides that the City Council
may, by a general resolution, authorize one or more officers to accept and consent to such
deeds or grants; and
WHEREAS, applicants for an entitlements and/or City permits may be conditioned
by the City's Planning Commission and/or required by the Anaheim Municipal Code to
provide various easements and dedications for the orderly development of projects; and
WHEREAS, in the course of the City's business, various departments from time to
time may need to obtain additional easements for public utilities and rights-of-way for
streets and roadways and other specified purposes; and
WHEREAS, City of Anaheim is desirous of having an efficient and prompt method
for approving and accepting various easements and fee simple dedications.
NOW THEREFORE, the City Council of the City of Anaheim does hereby resolve
that:
1. The Public Works Director is hereby authorized, on behalf of the City, to approve,
accept and consent to easements, grant deeds, quitclaim deeds, other conveyance
instruments, and fee simple dedications for streets, roadways, utilities, rights-of-way,
or other purposes, so long as each is evidenced by a written instrument signed by the
offering property owner. The Public Works Director is also authorized, on behalf of
the City, to execute these instruments, or any certificates, when it is required or
necessary.
2. Prior to accepting an interest in real property, the Office of the City Attorney shall
ensure the document or instrument is in a legally acceptable format.
3. The City Clerk is authorized to attest to grants of easements, grant deeds, quitclaim
deeds, or other conveyance documents for streets, roadways, utilities, rights-of-way, or
other purposes and thereafter, transmit said documents, utilizing a Certificate of
Acceptance in substantial form with Government Code Section 27281, to the Office of
the County Recorder of the County of Orange for recordation.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 11 th day of May , 2021, by the following roll -call
vote:
AYES: Mayor Sidhu and Council Members Faessel, Diaz,
Brandman, Moreno, Valencia, and O'Neil
