RESOLUTION NO. 87R-525
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AN AMENDMENT TO CERTAIN
CONDITIONS OF APPROVAL IN CUP NO. 2278 AND
AMENDING RESOLUTION NO. 82R-89.
WHEREAS, the City Council of the City of Anaheim
heretofore adopted Resolution No. 82R-89, as amended by Resolution
No. 85R-223, approving CUP No. 2278, subject to certain conditions
specified therein; and
WHEREAS, the permittee has now requested an amendment to
certain of said conditions of approval, particulary to delete
condition No.7 related to time limit upon the use; and
WHEREAS, the City Council held a duly noticed public
hearing on December 15, 1987, at which hearing the City Council
did receive and consider evidence, both oral and documentary,
relating to said request; and
WHEREAS, the City Council hereby finds and determines
that the amendment of said conditions of approval in the manner
hereinafter set forth is reasonably necessary to permit reasonable
operation under said Conditional Use Permit; and
WHEREAS, the City Council further finds and determines
that the permit is being exercised in a manner not detrimental to
the area and surrounding land uses, nor to the public peace,
health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that the conditions of approval heretofore imposed
in CUP No. 2278 be, and the same are hereby, amended by the
deletion of the time limit set forth in Condition No.7 as set
forth in Resolution No. 82R-89, as amended by Resolution 85R-223;
BE IT FURTHER RESOLVED that, except as expressly amended
herein, Conditional Use Permit No. 2278 granted by Resolution
No. 82R-89 shall remain in full force and effect.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 15th day of December,
1987.
