RESOLUTION NO. 87R-547
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DENYING VARIANCE NO. 3685.
WHEREAS, after a request for variance by ROBERT D.
SCHAFER, 292 Wilshire Avenue, #107, Anaheim, CA 92801, owner,
and MASSOUD MONSHIZADEH, 1524 Victoria Way, Placentia, CA 92670,
agent, was received, a public hearing before the Planning
Commission of the City of Anaheim was held upon due and proper
notice, a result of which Variance No. 3685 was denied covering
the following described property:
PARCEL A: THAT PORTION OF THE EAST HALF OF LOT 9 OF
HELEN AND LYNCH'S ADDITION TO ANAHEIM, IN THE CITY OF
ANAHEIM, AS SHOWN ON A MAP RECORDED IN BOOK 442, PAGE
158 OF DEEDS, RECORDS OF LOS ANGELES COUNTY,
CALIFORNIA, DESCRIBED AS FOLLOWS:
BEGINNING AT THE NORTHEAST CORNER OF SAID LOT 9;
THENCE SOUTH 880 54' 42" WEST 239.06 FEET ALONG THE
NORTH LINE OF SAID LOT 9 TO THE TRUE POINT OF
BEGINNING; THENCE SOUTH 0° 10 08" EAST 142.41 FEET
ALONG A LINE PARALLEL TO THE EAST LINE OF SAID LOT 9;
THENCE NORTH 88° 54' 42" EAST 73.63 FEET; THENCE
SOUTH 0° 10' 08" EAST 91.61 FEET TO A POINT ON A
CURVE CONCAVE SOUTHEASTERLY HAVING A RADIUS OF 45.00
FEET; THENCE SOUTHEASTERLY ALONG SAID CURVE FROM A
TANGENT BEARING SOUTH 70° 10' 11" EAST, AN ARC
DISTANCE OF 81.33 FEET TO A REVERSE CURVE, HAVING A
RADIUS OF 45.00 FEET, A RADIAL FROM THIS POINT HAVING
A BEARING OF NORTH 56° 36' 42" WEST; THENCE
SOUTHERLY AN ARC DISTANCE OF 10.27 FEET ALONG SAID
CURVE THROUGH A CENTRAL ANGLE OF 130 04' 12"; THENCE
NORTH 89° 02' 14" EAST 118.24 FEET TO THE WEST LINE
OF THE EAST 30.00 FEET OF SAID LOT 9; THENCE ALONG
SAID WEST LINE NORTH 0° 10' 08" WEST 310.84 FEET TO
THE NORTH LINE OF SAID LOT 9; THENCE ALONG SAID NORTH
LINE, SOUTH 88° 54' 42" WEST 209.06 FEET TO THE TRUE
POINT OF BEGINNING.
PARCEL B: LOT A OF TRACT 9201, IN THE CITY OF
ANAHEIM, AS SHOWN ON A MAP RECORDED IN BOOK 380, PAGES
23, 24, 25, and 26, OF MISCELLANEOUS MAPS, RECORDS OF
SAID ORANGE COUNTY, CALIFORNIA; and

WHEREAS, thereafter, within the time prescribed by law,
an interested party or the City Council, on its own motion, caused
the review of said Planning Commission action at a public hearing
noticed and held as prescribed by law and, as a result thereof,
the City Council does hereby make the following findings:
1. That there no special circumstances app1icable to the
property which do not apply to other property in the same vicinity
and zone.
2. That strict application of the zoning code does not
deprive the property of privileges enjoyed by other property in
the same vicinity and zone.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that said Variance be, and the same is hereby,
denied.
BE IT FURTHER RESOLVED that the time within which
rehearings must be sought is governed by the provisions of Section
1.12.100 of the Anaheim Municipal Code and the time within which
judicial review of final decisions must be sought is governed by
Section 1094.6 of the Code of Civil Procedure and Anaheim City
Council Resolution No. 79R-524.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 29th day of December,
1987.
