RES-2021-056RESOLUTION NO. 2021- 0 5 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING THE 2020 URBAN WATER MANAGEMENT PLAN INCLUDING THE WATER SHORTAGE CONTINGENCY PLAN, AS MAY BE MODIFIED, AND AMENDMENTS TO THE 2015 URBAN WATER MANAGEMENT PLAN, AND AUTHORIZING THE PUBLIC UTILITIES GENERAL MANAGER OR DESIGNEE TO FILE THE URBAN WATER MANAGEMENT PLANS AND TAKE SUCH OTHER NECESSARY ACTIONS TO IMPLEMENT AND ADMINISTER THE PLANS. WHEREAS, the California Legislature enacted Assembly Bill 797 (Water Code Section 10610 et seq., known as the Urban Water Management Planning Act or the "Act") during the 1983-1984 Regular Session, and as amended subsequently, which mandates that every supplier providing water for municipal purposes to more than 3,000 customers or supplying more than 3,000 acre feet of water annually, prepare an urban water management plan with a water shortage contingency plan, the primary objective of which is to plan for the conservation and efficient use of water; and, WHEREAS, the City of Anaheim ("Anaheim") is an urban supplier of water providing water to over 300,000 residents, and it is therefore subject to the requirements of the Act; and, WHEREAS, the Act requires that an urban water management plan be periodically reviewed at least once every five years, and it also requires urban water suppliers to make any amendments or changes to their plan which are required as a result of their review; and, WHEREAS, on June 14, 2016, the City Council adopted Anaheim's 2015 Urban Water Management Plan ("2015 Urban Water Management Plan") which was submitted to the California Department of Water Resources (DWR) for review; and, WHEREAS, after the DWR completed its review, it requested amendments to the 2015 Urban Water Management Plan through an advisory letter; and, WHEREAS, in response to the advisory letter, Anaheim staff prepared revisions to the 2015 Urban Water Management Plan, which the City Council adopted on December 20, 2016; and, WHEREAS, since this last review and update, Anaheim's urban water management plan must again be reviewed and updated in compliance with the Act's five-year review and adoption requirements; and. 1 WHEREAS, accordingly, Anaheim must review and adopt its urban water management plan, with any amendments, after public review and hearing; thereafter, Anaheim must submit the adopted urban water management plan to the DWR on or before July 1, 2021; and, WHEREAS, in compliance with the Act's requirements, Anaheim prepared and circulated for public review a draft 2020 Urban Water Management Plan ("2020 Urban Water Management Plan"), a draft water shortage contingency plan ("Water Shortage Contingency Plan") contained therein; the 2020 Urban Water Management Plan and Water Shortage Contingency Plan are attached to the staff report accompanying this resolution; and WHEREAS, additional amendments are required of the 2015 Urban Water Management Plan because urban water suppliers, like Anaheim, that anticipate participating in or receiving water from a proposed project in the Sacramento -San Joaquin Delta should provide information in their 2015 and 2020 urban water management plans that can be used to demonstrate consistency with Delta Plan Policy WR P1, Reduced Reliance on the Delta Through Improved Regional Water Self -Reliance; these proposed amendments are attached to the staff report accompanying this resolution ("2015 Urban Water Management Plan Amendment") and, WHEREAS, in compliance with the Act's requirements, Anaheim prepared and circulated for public review the draft 2015 Urban Water Management Plan Amendment with the 2020 Urban Water Management Plan; and, WHEREAS, the Anaheim Public Utilities Board held a properly noticed public hearing regarding the 2020 Urban Water Management Plan and 2015 Urban Water Management Plan Amendment on May 26, 2021 ("Public Hearing"). NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The 2015 Urban Water Management Plan Amendment and 2020 Urban Water Management Plan and its Water Shortage Contingency Plan are hereby adopted, including modifications to the 2015 Urban Water Management Plan Amendment and 2020 Urban Water Management Plan made after the Public Hearing by the Public Utilities General Manager or designee limited to (a) de minimis refinements; and (b) such changes to address public input received (if any) at the Public Hearing. 2. The Public Utilities General Manager or designee, is hereby authorized and directed to file the 2015 Urban Water Management Plan Amendment and 2020 Urban Water Management Plan within thirty (30) days after their adoption with the California Department of Water Resources, the California State Library, and any city or county within which Anaheim provides water supplies, and 3.
