RES-2021-066RESOLUTION NO. 2021- 0 6 6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING A REVISED SCHEDULE OF SANITATION FEES FOR SOLID WASTE AND RESCINDING IN PART RESOLUTION NO. 2019-074 AND DETERMINING SUCH ACTIONS ARE EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT PURSUANT TO PUBLIC RESOURCES CODE SECTION 21080 (b) (8) AND GUIDELINE SECTION 15273 (a). WHEREAS, fees and charges to be collected within the City of Anaheim may be adopted by Resolution of the City Council; and WHEREAS, the City Council has previously adopted Resolution No. 2019-074 adopting a revised schedule of certain sanitation fees or charges; and WHEREAS, the City Council desires to establish a revised schedule of sanitation fees or charges for solid waste; and WHEREAS, the City of Anaheim has complied with the applicable notice and hearing requirements pertaining to fee or charge revisions as required by California state law; and WHEREAS, the revenues derived from the revised fees or charges will not exceed the funds required to provide the property related service; and WHEREAS, the revenues derived from the revised fees or charges will not be used for any purpose other than that for which the fee or charge was imposed; and WHEREAS, the amount of the revised fees or charges imposed upon any parcel or person as an incident of property ownership shall not exceed the proportional cost of the service attributable to the parcel; and WHEREAS, the revised fees or charges shall be imposed for a service that is actually used by, or immediately available to, the owner of the property in question; and WHEREAS, the revised fees or charges are not being imposed for general governmental services, including, but not limited to, police, fire, ambulance, or library services where the service is available to the public at large in substantially the same manner as it is to property owners. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the following solid waste charges be adopted upon the later to occur of (1) July 1, 2021, or (2) adoption of this Resolution. RESIDENTIAL SOLID WASTE COLLECTION CHARGES (a) For standard collection (available to all residential dwelling units) consisting of one solid waste collection per week from 96 -gallon barrels, the sum of Twenty -Four Dollars and Fifty Cents ($24.50) per dwelling unit per month. For each additional 96 -gallon black trash barrel serving any dwelling unit, the sum of Seventeen Dollars and Thirty -Six Cents ($17.36) per month. For each additional 96 -gallon brown yard waste barrel serving any dwelling unit, the sum of Eleven Dollars and Thirty -One Cents ($11.31) per month. (b) For standard collection (available to residential dwelling units where storage space or handling problems render use of 96 -gallon barrels reasonably impractical) consisting of one solid waste collection per week from 64 -gallon barrels, the sum of Twenty -Three Dollars and Forty -Six Cents ($23.46) per dwelling unit per month. For each additional 64 -gallon barrel, the sum of Seventeen Dollars and Thirty -Six Cents ($17.36) per month. For each additional 64 -gallon brown yard waste barrel, the sum of Eleven Dollars and Thirty -One Cents ($11.31) per month. (c) For bulk collection (available only to apartments, condominiums, and mobile home parks which use a two, three, four, and six cubic yard bulk containers supplied by the City's solid waste collection contractor), the volume -based fee per dwelling unit, per month shall be as follows: Pounds Per Unit Monthly Volume -Based Fee Up to 35 I $23.83 36-60 $24.74 61-80 $34.09 81-120 $34.62 121 + $35.34 (d) For bulk collection (available only to single family residences that generate waste in excess of the capacity of four standard 96 -gallon barrels) consisting of two, three, four, and six cubic yard bulk containers, the monthly fees listed in item 2(b) shall apply. (e) For mini -packer collection available only to apartments and mixed-use, the monthly fees listed in item 2(c) shall apply. (f) For special collection (available to residential dwelling units which generate solid waste of a character or quantity which requires special collection), the charges shall be the reasonable cost of the removal and disposal thereof as determined by the Public Works Operations Manager of the City of Anaheim. 2. COMMERCIAL AND INDUSTRIAL SOLID WASTE COLLECTION CHARGES Solid waste collection services are available on a regularly scheduled basis to all commercial and industrial establishments. Such establishments include motels, hotels, recreational vehicle parks, restaurants, professional offices, clubhouses and places of entertainment, manufacturing plants, private schools, and any other organization or business whether of a service, wholesale or retail variety, including non-profit organizations. (a) For standard collection (available to all commercial or industrial establishments) consisting of one solid waste collection per customer per week from a maximum of four disposable or reusable containers, the sum of Fifty -Nine Dollars and Ten Cents ($59.10) per container per month. 2 (b) For bulk collection (available only to establishments which use the two, three, four and six cubic yard bulk containers supplied by the City's solid waste collection contractor), the following monthly fees shall apply: Class of Service Frequency of Collection Monthly Charge 2 -Cubic Yard Monthly Charge 3 -Cubic Yard Monthly Charge 4 -Cubic Yard Monthly Charge 6 -Cubic Yard A 1 per week $155.86 $181.81 $213.89 $271.99 B 2 per week $223.16 $269.79 $324.01 $424.96 C ! 3 per week $290.70 $357.80 $434.07 $577.57 D 4 per week $358.33 $445.83 $544.17 $730.13 E 5 per week $425.28 $533.01 $653.12 $881.14 F 6per week $488.22 $615.12 $755.78 $1,023.59 (c) For collection available only to establishments which use mini -packer containers, the following monthly fees shall apply: Class of Service Frequency of Collection Monthly Charge Mini Packer A 1 per week $312.04 B 2 per week $517.76 C 3 per week $723.51 D 4 per week $929.18 E 5per week $1,134.88 F 6 per week $1,340.66 (d) For commercial customers participating in the Food Scraps Collection and Recycling Program, the following monthly fees shall apply: Class of Service Frequency Of Collection Monthly Charge Food Scraps Collection and Recycling Program 2 -Cubic Yard Bins 64 -Gallon Containers A 1 per week $155.86 $59.10 B 2 per week $223.16 $118.21 C 3 per week $290.70 NA D 4 per week $358.33 NA E 5 per week $425.28 NA F 6 per week $488.22 NA (e) For special collection (available to establishments which generate solid waste of a character or quantity which requires special collection), the charges shall be the reasonable cost of the removal thereof as determined by the Public Works Operations Manager of the City of Anaheim. BE IT FURTHER RESOLVED that the rates established herein shall be effective upon adoption of this Resolution. BE IT FURTHER RESOLVED that Section 3 ("Residential Solid Waste Collection Charges") and Section 4 ("Commercial and Industrial Solid Waste Collection Charges") of Resolution No. 2019-074 are hereby rescinded and Section 1 ("Residential Wastewater Collection and Disposal Charges") and Section 2 ("Commercial and Industrial Wastewater Collection and Disposal Charges") shall remain in full force and effect.
