WHEREAS, the City Planning Commission of the City o.f Anaheim did receive an application for a Conditional Use Permit from $. H. P~iICE~ 723 %Test La Palma Avenue~ Anaheim, California, .for a Conditional Use Permit to allow the establishment of a ,>--if~ and antique shop in an existing residence~ and permitting a waivez~ of the minumum parking space requirement~ on the follow- ins described pz~operty s-~tuated in the City of Anaheim, County of Orange~ State of Caiifornia~ to wit: The South 308.21 feet of that portion of Lot 11 of the Miles ~ancho~ in the City of Anaheim~ as shown on a map thereof recorded in Book 4, page 7, Mis- cellaneous Maps~ records of said Orange County~ described as follows: Beginning at a point on the Easterly line of Lot ii~ 652.8 feet South of the Northeast corner of said Lot ii~ and running thence Westerly paral- lelwith the Northerly line of said Lot il, 106 feet; thence Southerly parallel with the Easterly line of said Lot !i to the Southerly line thereof; ~hence Easteziy along said Southerly line to the $outheastez'ly corner of said Lot 11; thence Northe~iy along the Easterly line of said Lot 1t to the point of beginning; EXCEPTING T~i~FiIOM the East 44 feet thereof; ALSO EXCEPTING T~i~FiIOM the North 180.21 feet thereof~ AND WHEREAS, =he City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on August 17 , 196.4 , notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chap=er 18.76 of =he Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies m~de by itself and in its behalf and after due consideration of all evidence and reports offered a~ said hearing did adopt its Resolution No. 1297 Series 1964-6~ , ~rantin~ Conditional Use Permit No. 611 subject to t~ c°ndi~ions therein s~t forth ; and -1- W~,EREAS, thereafter, within twenty-two {22) days from nne da~;e of th~ adoption of said resolution, the City Council did ele,ct~ upo~. its o~ motioned, to ~~ew the action of ~he Cit~ fla~ng Co~ission in granting said Conditional' Use P~ '~ t~'~- 22n~day of ~r~ , ~~t ~d did thereupon fix 29 64 , a~s the ti~e and th~ ~f ~.~ City of An~aheim as the place for a public hearing upon ~a:id Cov~d:i~io~:al Us~ P~rmit, and notices of such public hearing ~¥ere duly given a~ required by law and the provisions of Iitle 18, C~apter 18~.76 of th~ Anaheim ~.icip~l Code; and WRERF~$, a~ the time and place fixed for said public n~ri~g,~ ~.?i eg~e~ ? ~Y'a~u~l did duly hold and conduct 'such hear~ ~g ~ d sons in,erected therein an opportunity I.~o b~ he~ard ~pd did receive evidence and reports; and WHERE~S, the City Council fin?s, after careful conside~ o~ the recomme~dat{ons of ~he C~ty Planning Commission evidence and reports offered at said hearing, that~ The proposed use is properly One for 'which a Conditional Use Permit is authorized by the Anaheim Municipal Code~ The proposed use will not adversely affect the ~djoining land u~es and the growth and development of the area in 'which it is proposed to be located. The size ~nd shape of the site proposed for the u~e i~ ~dequate to allow the full deyelopment of the proposed use in a m~ner not'de~'r%mental to the particular area nor to the peace, he~'lth, safety a~5,~ general welfare. ~he traffzc generated by the proposed use wzll not impose an und~ae burden upon' th~s~reets and high- w~y~ designed and improved to carry .the traffic in th~ area~ ~ The granting of the Conditional U~e Permit under the condition~ imposed will not be detrimental to the peace, health, safety and general welfare of the cit~izens of the City of Anaheim. ~OW~ TMEP~FORE~ BE IT RESOLVED by the City Council of the C~ty of Anaheim that the action of the City Planning Com~ ~ission .... ~antiDg___ said Conditional Use Permit be, and the sa~e is hereb~ ~.~t~ined ~ , and that Conditzonal U~e Permit No. 61i_~_~ be, and the same is hereby, granted permitting the establishment of a gift and antique shop in an existing residence~ and a waiver of the [ninimum parking space require- ment~ on the property hereinbefore described, subject to the following conditions- . That trash s'~orage areas shall be provided in accord- ance with approved plans on file in the Office of the Diz~ector of Public Works and Superintendent of Strects~ prior to final building inspection. 2.
