64-602RESOLUTION NO. 64R-602 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM CONSENTING TO AMEND~NT TO THAT CERTAIN DECLARATION OF RESTRICTIONS RECORDED AUGUST 17, 1960, in BOOK 5379, PAGES 13, 14, 15 and 16, DOCUMENT NO. 144880, IN CONNECTION WITH RECLASSIFICATION NO. 59-60-107. %'~EREAS, the City Planning Commission did receive a petition for reclassification of the hereinafter described property from C-I, Neighborhood-Commercial Zone, Limited, to C-i, Neighborhood-Commercial Zone, Unlimited, and after holding a public hearing thereon in the manner and as prescribed by the Anaheim Municipal Code did recommend to the City Council that said change of zone be denied. Said property is des- cribed as follows: The north 195.00 feet of the west 200.00 feet of the Northwest quarter of the Southwest quarter of Section 7, Township 4 South, Range 10 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as said section is shown on a map recorded in Book 51, Page 10 of Miscellaneous Maps in the Office of the County Recorder of said Orange County. AND WHEREAS, upon receipt of the report and recommenda- tion of the City Planning Commission the City Council did fix the llth day of August, 1964 as the time and the Council Chamber in the City Hall in the City of Anaheim as the place for a public hearing upon said proposed change of zone, and did give notice thereof in the manner as provided in the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon consider the recommendation of the City Planning Commission; and WHEREAS, the City Council does find and determine that the bm reinbefore described property is a portion of and in- cluded in the real property described in Reclassification No. 59-60-107; that said property was reclassified to C-i, Neighborhood-Commercial Zone in said proceedings, and that a Declaration of Restrictions was recorded in connection with said reclassification which limited the uses of the property to those specific uses set forth in said Declaration of Restric- tions; and ~HEREAS, the City Council does find that inasmuch as the hereinbefore described property was reclassified to C-l, Neighborhood-Commercial Zone by Reclassification No. 59-60-107 and the uses thereof limited by deed restrictions, that said restrictions should be amended to permit the establishment and operation of a serwice station on said property hereinbefore described, as requested by the petitioner, subject to certain conditions hereinafter specified. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that that certain Declaration of Restric- tions recorded August 17, 1960, in Book 5379, Pages 13, 14, 15 -t- and 16, Document No. 144880, in the Office of the County Re- corder of Orange County, California, in connection with Reclassification ]Proceedings No. 59-60-107, amended by Docu- ment No. 182605, recorded October 17, 1960, in Book 5467, Page 336, Official Records of Orange County, California, and by Document No. 2765, recorded June 5, 1961, in Book 5744, Page 117, Official Records of Orange County, California, be further amended to permit the establishment and operation of a service station on the property hereinbefore described, which is a portion of the property described in said restric- tions, subject to the following conditions: That trash storage areas shall be provided in ac- cordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. That the owners of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along Crescent and Magnolia Avenues, for tree plant- ing purposes, which amount shall be paid within a period of 180 days from date hereof, or such further time as the City Council may grant. That subject property shall be developed substan- tially in accordance with plans and specifications on file with the City of Anaheim, marked "Exhibit No. 4~; PROVIDED, HOWEVER, that the planting area shown on Exhibit No. 5 shall be incorporated in the proposed development. e That subject property shall also be developed sub- stantially in accordance with City of Anaheim Service Station Minimum Site Development Standards on file in the City Planning Department. BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they are hereby authorized to sign the consent to said amendment to Declaration of Restrictions for and on behalf of the City' of Anaheim.
