64-599 Z~ESOLUTION NO~ 64R-5~_~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ORAN?lNG VARIANCE NO. 1647 o WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Fisher_A~_Stuart L. Johnson and Paul Pletz and Clada M. Pletz_~ owners of certain real property situated ~n the City of Anaheim, County of Orange~ State of California, described as foliows~ PARCEL 1: That portion of the Southeast quarter of the Northeast quarter of Section 15, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, in the City of Anaheim, as shown on a map thereof recorded in Book 51, page 11, Miscellaneous Maps, records of said Orange County; Beginning at the Southeast corner of the Northeast quarter of the Southeast quarter of the Northeast quarter of said Section 15, thence Westerly 495 feet along the Southerly boundary thereof; thence North 88 feet; thence East 495 feet and parallel to the Southerly boundary of the Northeast quarter of the Southeast quarter of the Northeast quarter; thence South 88 feet to the point of beginning. PARCEL 2: That portion of the Northeast quarter of Section 15, Township 4 South, Range 11 West, in the Rancho Los COyotes, in the City of Anaheim, as per map thereof recorded in Book 51, page 11, Miscel- laneous Maps, records of said Orange County, described as follows: Beginning at a point North 88.00 feet from the Southeast corner of the Northeast quarter of the Southeast quarter of said North- east quarter; thence West 495.00 feet parallel with the South line of said Northeast quarter of the Southeast quarter of the Northeast quarter; thence North 88.00 feet; thence East 495.00 feet parallel with said South line to the East line of said Section; thence South 88.00 feet to the point of beginning. AND WHEREAS, the City Planning Comm~z~ion did hold a public hearing at the City Hail in the City of Anaheim upcn said petition on ~__Jul~.u~l_9_64~' , not,ce of which said public hear~n9 wa~ duly 9ivan as requ!r~d by law and the prcvi=. sion~ of 7~tle !8~ Chapter 18076 of the Anaheim Municipal C:ode~ 8nd WHEREAS, said City Planning Commission~ after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of ali evidence and reports offered at said hearing, did adopt Resolution Noo ~ SEries 19 6~-65 ~ recommending that Variance Noo 1647 be d,enied ~ ~ ~nd WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in denying said variance amd did set a public hearing thereon to be held on the llth day of August , 1964 , at 7:00 o~clock-l~oM, in the City Hall in the City o--~aheim and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: There are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. o That such a variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. That the granting of such variance will not adversely affect the comprehensive general zoning plan~ NOW~ THEREFORE~ BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting a waiver of the one-story height limitation within 150 feet of Residential-Agricultural Zoned property, a waiver of the garage requirement to permit the construction of carports, and a waiver of the minimum side yard width requirement on the property hereinbefore described, subject to the following conditions: That subject property shall be developed sub- stantially in accordance with revised plans on file with the City of Anaheim, marked "Exhibit No. 1, Revision No. 2," dated August 11, 19647 and signed by Mayor Chandler. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. -2- o That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department~ said fire hydrants to be installed prior to final building inspection. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 5. That this variance is granted subject to the completion of Reclassification Proceedings No. 64-65-1 now pending. 6. That subject property shall be developed within a period of one year from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
